OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, November 2, 2010 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. Ernest Rowley, County Survey/Recorder, noted that among Ms. Folkman’s duties, she works at the front counter and she greets the public with a smile. Commissioner Dearden noted that this nomination comes from the employee’s peers. The Commission presented her with a plaque, a Seal of Service pin and $100 for her excellence in customer service.

Commissioner Dearden moved to approve the consent items; Commissioner Zogmaister seconded, all voting aye.
F. Action Items:
1. Contract with the U.S. Forest Service for law enforcement patrol duties on Forest Service ground - Contract C2010-204
Weber County Sheriff Brad Slater presented this standard annual Financial and Operating Plan for reimbursement of patrol activities around Pineview Reservoir, Snowbasin and South Fork Canyon. The contract amount is $60,413, which has not changed significantly over the last several years.
Commissioner Zogmaister moved to approve Contract C2010-204 with the U.S. Forest Service for law enforcement patrol duties on Forest Service ground; Commissioner Dearden seconded, all voting aye.
2. Resolution appointing a County representative and an alternate representative for the Utah Counties Insurance Pool annual membership meeting - Resolution 28-2010
David Wilson, Deputy County Attorney, stated that UCIP’s by-laws require that for the annual membership meeting the counties adopt a resolution appointing a representative and an alternate.
Commissioner Dearden moved to adopt Resolution 28-2010 appointing Kenneth A. Bischoff as the Weber County representative and Brad Dee as the alternate representative for the Utah Counties Insurance Pool annual membership meeting; Commissioner Zogmaister seconded.

3. Contract modification with Morrison-Maierle, Inc. and UDOT required to add cost for additional testing and document preparation for rebid of project - Contract C2010-205
Curtis Christensen, County Engineer, noted that the county had a contract with Morrison-Maierle for engineering work on the North Ogden Divide project. Last week the Commission approved a contract that added $150,000 to that contract to re-bid the project–additional testing and document preparation is needed to re-bid it. This modification is in the amount of $10,470.91. There are no additional match funds required for this contract. Mr. Christensen addressed Commissioner Zogmaister’s question stating that the project was bid last Summer and there were not sufficient funds to award the contract. The bid had come in higher than anticipated and there are some unknown issues. This modification is to obtain geotechnical information for the contractors, which was not done previously. The county asked Federal Highways and the State for additional funding, which was related to the contract approved last week. The delay was in obtaining the additional funding.

4. Second reading and enactment of an ordinance of Weber County making certain amendments to the Weber County Fee Ordinance relating to Parks, Recreation and Animal control services - Ordinance 2010-25
David Wilson, Deputy County Attorney, noted that the first reading of this ordinance occurred last week. Reed Richards, Deputy County Attorney, outlined some changes suggested at the first reading, including that the license fees and the minimum fees for boarding services are for contracting municipalities only, and entities that do not join the interlocal agreement will be charged an additional 20% above the indicated fees.
Commissioner Dearden moved to adopt Ordinance 2010-25 making certain amendments to the Weber County Fee Ordinance relating to Parks, Recreation and Animal Control services; Commissioner Zogmaister seconded.

G. Public hearings:
1. Commissioner Zogmaister moved to adjourn the public meeting and convene the public hearing; Commissioner Dearden seconded, all voting aye.
2. Public hearing regarding the Community Block Grant program to provide an opportunity for representatives from non-profit organizations as well as others to discuss potential projects (including county projects)
Chad Meyerhoffer, of County Engineering, stated that this public hearing was to provide information regarding the 2011 Community Development Block Grant (CDBG) program, to solicit possible projects that may be eligible for the funds, and to field possible suggestions and questions about the projects from citizens. The national objective is for grant money to primarily be spent to benefit low to moderate income persons but other national objectives include using funds to aid in the prevention or elimination of slums or blight and may also be used to meet urgent needs because existing conditions pose a serious and immediate threat to health and welfare. Eligible activities are identified in the CDBG application guide that is available for review by interested parties. Examples for possible CDBG projects include ADA improvements, public works infrastructure projects in qualifying areas, property acquisition, public services, such as food banks and homeless shelters, and loan programs for private businesses that hire low income persons or for persons who own rental housing and rent to low income persons.
Projects for 2011 will compete between Weber, Morgan, and Tooele Counties and about $1,500,000 can be expected in CDBG funds. Projects will be rated by a regional council made up of an elected official and a staff member from each county to determine what projects can proceed with final application. All pre-applications must be submitted to the Wasatch Front Regional Council by 12/2/10.
The unincorporated county does not currently have any active grant projects. The county as a whole has sponsored the Weber Housing Authority in an active project that offers incentives for first time home buyers. In the past, Weber County has received grants for modification of restrooms for the Weber County Library to bring them more in compliance with ADA standards and an emergency housing rehabilitation project that is administered through the Weber County Housing Authority, developing ADA compliant campsites, installing ADA compliant door hardware at the fairgrounds, installing storm drains in low to moderate income communities to reduce flooding, installing wheelchair ramps at street intersections to make pedestrian sidewalks more accessible, as well as sponsoring non-profit agencies such as Your Community Connection, Ogden Weber Community Action Agency, Catholic Community Services and others.
All possible projects in which funding may be applied for are indicated in the regional Consolidated Plan and is available for review in the Weber County Planning Office. A possible county project for the 2011 funding year is ADA upgrades at the fairgrounds. Also the Weber County Housing Authority would like to apply for funds to offer incentives to first time home buyers as well as funds for a home repair program. Two non-profit agencies attended the CDBG How to Apply Workshop: Catholic Community Services and St. Ann’s Center. However, Mr. Meyerhoffer didn’t believe they were looking to the county to sponsor projects. He had sent them emails but did not received a response.
Landon Halverson, of the Weber Housing Authority, stated that last year the Housing Authority made application for and received a CDBG grant and to date has provided assistance for 12 new home owners in the county, with 12 more anticipated to close within the next 45 days. The Housing Authority would like to apply again for CDBG funding to continue this service. In addition, they would like to apply for a home repair program offering loans up to $7,500 and the loans would be secured as a lien against the properties. Mr. Halverson addressed Chair Bischoff’s question on the event of default on the loans stating that would depend the Housing Authority Board of Directors.
Chair Bischoff invited public comments and Brice Penrod, of Pleasant View, stated that he had noticed a couple of physically handicapped people trying to enter at the Fairgrounds and suggested that push doors be installed through this program.
3. Commissioner Dearden moved to adjourn the public hearing and reconvene the public meeting; Commissioner Zogmaister seconded, all voting aye.
4. Action on public hearings:
G.2. - Request to add possible Community Block Grant Project to Weber County’s Capital Improvements for 2011-2016
Mr. Meyerhoffer noted that the CDBG program requires the Commission to adopt a Capital Improvement Plan. It is a 5-year plan with the additions of the Weber Housing Authority for first time home buyer incentives and the home repair program as possible projects. Under the original consolidated plan, the county also looks at stormwater projects, flood control, ADA standards, infrastructure upgrades and programs to assist low-income families/families at risk.
Commissioner Zogmaister moved to accept the presentation for the CDBG program and approve the additions to the Capital Improvement Plan for 2011-2016; Commissioner Dearden seconded, all voting aye.
H. Assign Pledge of Allegiance & Thought of the Day for Tuesday, November 10, 2010 , 10 a.m.
I. Public Comments:
Brice Penrod, of Pleasant View, asked if the ADA improvements he had suggested under the public hearing would be considered and the commissioners said that it had been added.
