OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, September 21, 2010 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. D. Presentation of a resolution designating October 2010 as Community Planning Month - Resolution 25-2010
Rob Scott, County Planning Division Director, presented this resolution sponsored by the National American Planning Association recognizing the valuable contribution of land use planning nationwide. He expressed appreciation to his great staff and the County Commission for their support relating to projects such as the Ogden Valley Destination & Recreation Resort Zone and Sensitive Land ordinances. The commissioners expressed their appreciation to the Planning staff and for Mr. Scott’s leadership. Commissioner Dearden moved to adopt Resolution 25-2010 designating October 2010 as Community Planning Month; Commissioner Zogmaister seconded.

Commissioner Zogmaister moved to approve the consent items, with a correction to the ACH payment year; Commissioner Dearden seconded, all voting aye.
F. Action Items:
1. Approval of road dedication plats associated with new road improvements on the Old Trappers Loop Road (7450 East) right of way
Sean Wilkinson, of the County Planning Division, stated that the Old Trappers Loop Road right-of-way has existed in its current location since the late 1800s. As part of the Trappers Crossing Subdivision, a new road has recently been constructed in a portion of what was the Old Trappers Loop right-of-way. Parts of the new subdivision road are located outside of what is recognized as the existing right-of-way in order to place the road as much as possible on property owned by the subdivision developer and these road dedications take in the new area where the new road has been constructed. The property owner is dedicating the additional right-of-way area to Weber County for public road purposes.
Three other property owners (Chris Peterson, Snow Basin and the Ogden River Opportunities (a very small parcel) are involved in this road dedication plat but most of the road dedication encompasses that portion of the Old Trappers Loop right-of-way within the Trappers Crossing Subdivision. At this time there are signatures by Mr. Peterson, Snow Basin and PC Land Development, LLC (Trappers Crossing Subdivision) but no signature for the Ogden River Opportunities, which will be required prior to the subdivision plat being recorded. Mr. Wilkinson did not know the reason for the delay in obtaining that signature but stated that the developer was aware of the requirement.
Because it appears that this item will move forward, Commissioner Dearden moved to approve the road dedication plats associated with new road improvements on the Old Trappers Loop Road (7450 East) right of way; Commissioner Zogmaister seconded, all voting aye.
2. Contract with Wasatch Integrated Mgmt District for Weber County to receive construction and demolition waste - Contract C2010-190
Gary Laird, County Solid Waste Management, noted that the State requires that all of these contracts to receive C&D waste be reviewed by the State and that they requested some changes. The major change requires that the permit now be incorporated as part of the agreement, as an exhibit, and that all waste delivered to the landfill must meet the permit requirements. A price schedule has been included in the contract and the State can review any future changes with a 30-day notice.
Commissioner Zogmaister moved to approve Contract C2010-190 with Wasatch Integrated Management District for Weber County to receive construction and demolition waste; Commissioner Dearden seconded, all voting aye.
3. Contract with West Haven City for a RAMP grant - Contract C2010-191
Michael Caldwell, County Public Information Officer, presented this major RAMP project contract.
Commissioner Dearden moved to approve Contract C2010-191 with West Haven City for a RAMP grant; Commissioner Zogmaister seconded, all voting aye.
G. Assign Pledge of Allegiance & Thought of the Day for Tuesday, September 21, 2010, 10 a.m.
H. Public Comments:
Brice Penrod, of Pleasant View, stated his opposition to the agreement with Wasatch Integrated Management District. He had sent a letter to the Commission in June about how he felt but had not received return comment. He said that to his knowledge no public hearing had been held when the county decided to create a regional C&D landfill and felt that the public has a right to participate in the creation of such a landfill. When the Commission held the initial public meeting for the landfill, they had stated that the county would receive waste from within Weber County but had since changed its position. Mr. Penrod believes the taxpayers, having once paid for that landfill in its entirety, should not have to subsidize the taxpayers of Davis County or any other county, that Weber County should require any other government entity, with which the county intends to accept its waste at the landfill, to participate to at least the same extent that the taxpayers of Weber County did, and that the Commission has a duty to ensure, in their representation of the taxpayers that they do not allow this to go forward in any other way.

Commissioner Zogmaister moved to convene a closed executive session on strategy relating to the purchase or sale of real estate and strategy relating to imminent or ongoing litigation; Commissioner Dearden seconded.
