MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, September 14, 2010 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. Commissioner Dearden moved to approve the consent items as presented; Commissioner Zogmaister seconded, all voting aye.
E. Action Items:
1. Request from Rocky Mountain Power for an Underground Right of Way Easement for the purpose of installing an underground utility line to service properties on the east side of Washington Boulevard between 23rd and 24th Streets
Nate Pierce, County Operations Department Director, presented this request by Rocky Mountain Power and Ogden City for a power easement. Ogden City has been trying for some time to entice viable businesses to occupy the subject area. A new underground power line is needed. Weber County owns a small parcel (5' X 80') that runs along the rear of those properties. This parcel has no other viable use. Leonard Call, County Information Technology Department Director, noted that the county has a lot of fiber optics all around the Weber Center and wanted to ensure it would not be impacted.
Commissioner Zogmaister moved to approve the request for an Underground Right of Way Easement to install an underground utility line to service properties on the east side of Washington Boulevard between 23rd and 24th Streets as long as it does not interfere with the county’s fiber optics; Commissioner Dearden seconded, all voting aye.
F. Public hearing
1. Commissioner Dearden moved to adjourn the public meeting and convene the pubic hearing; Commissioner Zogmaister seconded, all voting aye.
2. Public hearing regarding amendments to the Weber County Zoning Ordinance Chapter 28 (Nonconforming Buildings, Uses and Parcels), Chapter 1 (General Provisions), and Chapter 45 (Planning Commission)
Sean Wilkinson, of the County Planning Division, stated that Planning staff is proposing several amendments to the County Zoning Ordinance which include new definitions for “nonconforming uses/parcels” and “noncomplying structure” to Chapter 1; the definitions originally proposed as part of the Destination and Recreation Resort Zone were inadvertently left out during the most recent amendments to Chapter 1 and are now being added; eliminating a reference to the boundary between the Ogden Valley Township and the Western Weber County Township because that same reference is already in Chapter 45; and a map delineating this boundary is being adopted as part of Chapter 45. The amendments to Chapter 28 consist mainly of minor language changes. The significant change deals with parcels that were created in the Ogden Valley without going through the appropriate subdivision process. These can be made legal by going through that process. However, as part of the subdivision process, these parcels are required to dedicate area for the road right-of-way, which brings the lot area below what the Zoning Ordinance requires. This amendment allows these parcels to continue through the subdivision process, despite that they do not meet the area requirement. Mr. Wilkinson addressed Commissioner Zogmaister’s question stating that a rebuild notice will be recorded with the abstracted titles of those properties. Chair Bischoff invited public comments and none were offered.
3. Commissioner Zogmaister moved to adjourn the public hearing and reconvene the public meeting; Commissioner Dearden seconded, all voting aye.

Commissioner Dearden moved to adopt Ordinance 2010-22 amending the Zoning Ordinance, Chapter 28, Chapter 1 and Chapter 45; Commissioner Zogmaister seconded.
