OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, August 24, 2010 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. 5. Set public hearing for September 14, 2010, 10 a.m., regarding amendments to the Weber County Zoning Ordinance Chapter 28 (Nonconforming Buildings, Uses and Parcels), Chapter 1 (General Provisions), and Chapter 45 (Planning Commission)
Commissioner Dearden moved to approve the consent items as presented; Commissioner Zogmaister seconded, all voting aye.
E. Action Items:
1. Request for Contract with US Forest Service to provide law enforcement for drug trafficking in Forest Service areas

3. Final approval of Cottonwood Creek Subdivision (1 lot)
Sean Wilkinson, County Planning Division, stated that this subdivision is located north of the Wolf Creek area. It has access from Powder Mountain Road and UDOT has granted that access. The subdivision complies with all the pertinent ordinance requirements. The Planning Commission unanimously recommended final approval in June 2010.
Commissioner Zogmaister moved to grant final approval of Cottonwood Creek Subdivision (1 lot); Commissioner Dearden seconded, all voting aye.
4. Resolution of the Board of Commissioners of Weber County authorizing issuance/sale of not more than $6,800,000 aggregate principal amount of the county’s manufacturing facility revenue bonds, series 2010 (Great Salt Lake Brine Shrimp Project) to finance and/or refinance the costs of the acquisition, construction, equipping and improvement of manufacturing facilities and related improvements for the Great Salt Lake Brine Shrimp Cooperative, Inc.; providing for the publication of a notice of bonds to be issued and a notice of public hearing; providing for the running of a contest period; and related matters - Resolution 23-2010
Dan Olsen, County Comptroller, stated that this was a request for the county to act as the conduit debt issuer on behalf of a private company, a process the county has entered into in the past. The county pledges its credit but is not liable or obligated for the debt in any way.
Gary Goff, of Zions Bank, stated that Zions Bank has approved the financing for this project, which received 100% support by the Private Activity Board. Doug Swenson, representing the Great Salt Lake Brine Shrimp Cooperative, stated that the brine shrimp business has a lot of support from the State and it historically has been made up of smaller, locally owned operators, who in 2006 formed a non-profit cooperative organization to represent them and bring efficiency to an otherwise competitive and erratic business. One of their drawbacks to being in a co-op was that they were operating under smaller operations that were not logistically advantageous for a group. They purchased property in the Ogden Industrial Park and have started construction of their manufacturing facilities. Commissioner Zogmaister had met with representatives from their organization and said it was good to have them in Weber County. Chair Bischoff noted that the Commission had previously written a letter of support for their organization. Brad Patterson, Ballard Spahr, was present.

F. Public Hearing:
1.Commissioner Dearden moved to adjourn the public meeting and convene the public hearing; Commissioner Zogmaister seconded, all voting aye.
2. Public hearing on Zoning Petition to amend the Weber County Zoning Ordinance, Chapter 31 Administration
Jim Gentry, County Planning Division, stated that home occupations with visiting clientele was added to the Administrative Authority section and written notice of decision to the applicant was also added to this chapter. Both Planning Commissions unanimously recommended approval. Commissioner Zogmaister asked what prompted the amendment and Mr. Gentry said that there have been some changes in State statute that allows for greater administrative approval by Planning staff. This should give the Planning Commissions more time to work on ordinances and general plan amendments.
Chair Bischoff invited public comments and none were offered.
3.Commissioner Zogmaister moved to adjourn the public hearing and reconvene the public meeting; Commissioner Dearden seconded, all voting aye.
4. Action on public hearing:
F.2. - Amend County Zoning Ordinance, Chapter 31 - Ordinance 2010-20
Commissioner Dearden moved to adopt Ordinance 2010-20, amending the Weber County Zoning Ordinance, Chapter 31, Administration, to clarify language and identify uses that can be approved administratively; Commissioner Zogmaister seconded.
