OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, August 3, 2010 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Commissioner Dearden moved to approve the consent items as presented; Commissioner Zogmaister seconded, all voting aye.
E. Action Items:
1. Release approximately $4,000 to Jack V. Stoker for complying with all of the improvements and requirements set forth in an ‘Escrow Agreement’ dated 6 June 1974 in reference to an Excavation and Rehabilitation Plan outlined for Mr. Stoker’s gravel pit located northeast of Huntsville
John Bond, County Treasurer, stated that Mr. Stoker requested the release of about $4,000 from an escrow account held by the county. Curtis Christensen, County Engineer, has also approved the funds release stating that his office has inspected Mr. Stoker’s property and approved the improvements made to Mr. Stoker’s property. Mr. Bond verified the balance with Key Bank, which has agreed to release the funds to the county. Mr. Bond addressed Commissioner Dearden’s question stating that the bank would not release the exact amount without a letter from the Commission. Commissioner Zogmaister noted that the escrow was established in 1974 and required a certain level of restoration and asked if it met the current standards. Iris Hennon, County Planning Division, stated that $2,000 was originally procured for the restoration in 1974 but was determined in 1997 not to be sufficient and negotiations began. In 2002 it was determined that an additional $2,000 was needed. Mr. Stoker finally brought the property into compliance in 2005. The county was not aware that there was still money in an escrow and subsequently made Mr. Stoker aware of it.
Commissioner Zogmaister moved to authorize the release approximately $4,000 to Jack V. Stoker for complying with all of the improvements and requirements set forth in an ‘Escrow Agreement’ dated 6 June 1974 in reference to an Excavation and Rehabilitation Plan outlined for Mr. Stoker’s gravel pit located northeast of Huntsville; Commissioner Dearden seconded, all voting aye.
2. Quit Claim Deed for Wilford M. Hale and Genine Hale, Trustees of the Wilford and Genine Hale Family Trust
Nate Pierce, County Operations Director, stated that on 3/2010 the county declared surplus a small parcel (0.064 acres) at the top of Douglas Street adjacent to a parcel owned by Wilford Hale. The county negotiated a sale of this parcel to Mr. Hale and the Commission approved the real estate sales agreement on 5/11/2010. At that time, a quit claim deed was also approved in the name of Wilford M. Hale. A condition of the quit claim deed and sales agreement required Mr. Hale to combine his new parcel with his existing parcel to the west. When Mr. Hale attempted to do so with Ogden City, they would not allow it because the name on the parcel to the west was different than the name on the quit claim deed for the new parcel. Today’s action corrects the problem, reflecting the Family Trust, and allows the Hales to combine the new parcel with their existing one.
Commissioner Dearden moved to approve the Quit Claim Deed for Wilford M. Hale and Genine Hale, Trustees of the Wilford and Genine Hale Family Trust; Commissioner Zogmaister seconded, all voting aye.
3. Contract with Tammy Hunt to have hand painted signs for the 2010 Weber County Fair - Contract C2010-162
Jan Wilson, County Fair, presented this contract in the amount of $1,800. Commissioner Zogmaister noted that the Worker’s Compensation section had not been filled out and Ms. Wilson said that Ms. Hunt has no employees and has fully executed a contract that is on the County Comptroller’s desk.
Commissioner Zogmaister moved to approve Contract C2010-162 with Tammy Hunt to have hand painted signs for the 2010 Weber County Fair; Commissioner Dearden seconded, all voting aye.
4. Contract with Rockin’ Roadshow/Radio Disney Group, LLC, to have Rockin’ Roadshow perform at the 2010 Weber County Fair - Contract C2010-163
Jan Wilson, County Fair, presented this contract, which is in the amount of $1,995. Commissioner Zogmaister noted that the Worker’s Compensation section had not been filled out and Ms. Wilson said that she would call them to check on it.
Commissioner Dearden moved to approve Contract C2010-163 with Rockin’ Roadshow/Radio Disney Group, LLC, for Rockin’ Roadshow to perform at the 2010 Weber County Fair contingent upon completion of the Worker’s Compensation section of the contract; Commissioner Zogmaister seconded, all voting aye.
5. Contract with Josh Shelton to have the Weber County Fair Rock Band Competition at the 2010 Weber County Fair - Contract C2010-164
Jan Wilson, County Fair, presented this contract, which is in the amount of $2,000.
Commissioner Zogmaister moved to approve Contract C2010-164 with Josh Shelton for the Weber County Fair Rock Band Competition at the 2010 Weber County Fair; Commissioner Dearden seconded, all voting aye.
6. Designate the Weber Arts Council as a “Local Arts Agency” for consideration by the Utah Division of Arts and Museums
Commissioner Zogmaister noted that the Utah Division of Arts & Museums recognizes official local arts agencies for general support funding to ensure cultural, civic, educational and economic benefits of the arts are accessible to every community in the State. To be designated as an official local arts agency, the organization must be designated by the city/county government for the defined community they serve and the organization must offer its community at least three listed services.
Commissioner Zogmaister moved to designate the Weber Arts Council as a “Local Arts Agency” for funding consideration by the Utah Division of Arts and Museums; Commissioner Dearden seconded, all voting aye.
