OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, July 27, 2010 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. D. Presentation of seal of service award to Iris Mabrey from the Planning Division
Nate Pierce, County Planning Division Director, outlined Ms. Mabrey’s duties, noting her positive attitude as the county’s code enforcement officer and her willingness to help others. The Commission presented Ms. Mabrey with a Seal of Service pin, a plaque and $100 and expressed their thanks for her dedication.
E. Consent Items:
1. Purchase Orders in the amount of $53,233.33
2. Warrants #264233-264642 in the amount of $2,774,063.06
3. Minutes for the meetings held on July 13, and July 20, 2010
4. ACH payment to US Bank in the amount of $61,980.27 for purchasing card transactions made through the billing cycle ending July 15, 2010

Commissioner Dearden moved to approve the consent items as presented; Commissioner Zogmaister seconded, all voting aye.
F. Action Items:
1. Second reading and enactment of an ordinance approving certain changes in fees for services at the County Solid Waste Transfer Station, the County Composting Facility and the Weber County Construction and Demolition Landfill - Ordinance 2010-14
Gary Laird, County Solid Waste Management, noted there had been no changes since the first reading. Two main changes, discussed at the previous meeting, are the addition of the cost of a bag of compost and pricing changes for the construction and demolition landfill.
Commissioner Zogmaister moved to adopt Ordinance 2010-14 approving certain changes in fees for services at the Weber County Solid Waste Transfer Station, the Weber County Composting Facility and the Weber County Construction and Demolition Landfill; Commissioner Dearden seconded. Roll Call Vote:

2. Contract with Buck Consultants to update the county’s estimated costs of providing health insurance benefits to our retirees - Contract C2010-161
Eric Barrett, Clerk/Auditor’s Office, noted that the Governmental Accounting Standards Board requires the county to do an actuarial valuation of its post employment health benefits every two years. Buck Consultants also performed this valuation two years ago. Chair Bischoff asked if this had been bid out and Mr. Barrett responded that it had been bid out two years ago and the county is considering doing a future bid. Commissioner Zogmaister noted that the valuation work cost was $15,000 and for the year 2011 there was a roll-forward valuation price of $4,500 and asked if Buck had done the work previously why was the county not paying the roll-forward cost. Mr. Barrett responded that the $4,500 is for an update for the Comprehensive Annual Financial Report on the year that the valuation is not required and the $2,000 cost reduction was due to the fact they already had a model setup for our county. Commissioner Dearden noted that the $4,500 was for anything needed above the $15,000, including an update. The $2,000 is for an onsite visit, if requested.

3. Resolution reappointing Wayne Andreotti and Doug Hansen to the Western Weber Township Planning Commission - Resolution 21-2010
Nate Pierce, County Operations Director, stated that this item had been before the Commission a couple of times. The county solicited applicants and these two current planning commissioners expressed interest in continuing to serve. Commissioner Zogmaister feels strongly that it is better to give the opportunity to serve to those who have not yet done so, thus educating more people in the process.
Commissioner Dearden moved to adopt Resolution 21-2010 reappointing Wayne Andreotti and Doug Hansen to the Western Weber Township Planning Commission for 4-year terms, expiring 6/30/2014; Chair Bischoff seconded.

G. Public hearing:
1. Commissioner Zogmaister moved to adjourn the public meeting and convene the public hearing; Commissioner Dearden seconded, all voting aye.
2. Public hearing to consider an amendment to Weber County Zoning Ordinance, Chapter 44, Ogden Valley Destination and Recreation Resort Zone
Scott Mendoza, of the County Planning Division, stated that this Chapter, of which transfer of development rights is an integral part, was adopted almost one year ago. After applying the ordinance for the past year some amendments will improve it.
The Ogden Valley CVR-1 Zone offers high development density (i.e., 20 units/acre and no area requirements for commercial development). The amendment to the Calculating Transferable Density Section indicates that due to the high level of development potential and the need for design flexibility on parcels designated CVR-1, according to the county zoning map, transferable development rights may be granted to areas reserved for future development on an approved TDR site plan. Mr. Mendoza explained that this gives the county the option to allow transfers from the CVR-1 Zone and development to occur from within the area within the parcel that made the transfer, allowing some design flexibility for the development projects.
Another amendment states that to be eligible to receive transfer incentive matching units, and/or density bonus units, the units transferred to the resort shall be from an elevation of 6,200 feet and below unless located within an important wildlife habitat area and/or ridgeline area. The Ogden Valley Planning Commission on 3/2010 unanimously recommended approval of both amendments. Chair Bischoff invited public comments and none were offered.
3. Commissioner Dearden moved to adjourn the public hearing and reconvene the public meeting; Commissioner Zogmaister seconded, all voting aye.

G.2. - Amendments to Chapter 44 - Ordinance 2010-15
Commissioner Zogmaister moved to adopt Ordinance 2010-15, amending the Weber County Zoning Ordinance, Chapter 44, Ogden Valley Destination and Recreation Resort Zone; Commissioner Dearden seconded.

H. Assign Pledge of Allegiance & Thought of the Day for Tuesday, August 3, 2010, 10 a.m.
I. Public Comments:
Brice Penrod, of Pleasant View, believed that a scale should be installed at the C&D landfill now rather than using the method discussed under item F.1. above. Mr. Penrod said that the conversion factor the county was using was 37 pounds/cubit foot for the waste density which was akin to cork, and even with the mitigation factor of the density for the cover material, the revenues to the county would be dramatically decreased by his calculation from $18 million to $12 million and a scale could be installed for less than that.
