MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, July 20, 2010 - 10:00 a.m.
Commission Chambers, 2380 Washington Blvd., Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.Commissioners: Kenneth A. Bischoff, Chair, and Jan M. Zogmaister. Craig L. Dearden was excused.

Others Present: Alan D. McEwan, Clerk/Auditor; David C. Wilson, Deputy County Attorney; Fátima Fernelius, of the Clerk/Auditor’s Office, took minutes.

D. Consent Items:
1. Purchase Orders in the amount of $107,435.89
2. Warrants #263991-264232 in the amount of $2,230,989.57
3. Set public hearing for August 17, 2010, 6 p.m., regarding the vacation of lot 85 of Sunridge Subdivision No. 3
4. Set public hearing for August 17, 2010, 6 p.m., to amend the transportation element of the West Central Weber County General Plan
5. Surplus the following items from the IT Department to the Elections Department: (17) HP Compaq nc6120 Laptops, (2) Dell Latitude e6400 Laptops, (1) HP530 Laptop
Commissioner Zogmaister moved to approve the consent items as presented; Chair Bischoff seconded, both voting aye.

E. Action Items:

1. Final approval of the JHL Subdivision (3 lots)

Ben Hatfield, County Planning Division, stated that this subdivision was located at 2020 E. 5950 N., Liberty. The applicant is also requesting vacation of one of the lots (lot 2) of the North Fork Acres, which will be handled later in this meeting. Approximately ½ acre of this lot will be moving to the adjacent property. These lots are in the FV-3 Zone. No road improvements will be put in with this subdivision and a deferral of curb, gutter and sidewalk will be recorded with the subdivision.
Commissioner Zogmaister moved to grant final approval of the JHL Subdivision (3 lots); Chair Bischoff seconded, both voting aye.

2. First Amendment to the Landfill Operating and Management Agreement with Moulding & Sons Landfill LLC - Contract C2010-159

Gary Laird, County Solid Waste Management, noted two changes to the agreement that include that until such time as Moulding and county agree to install scales at the facility, Moulding agrees that monthly payments shall be based on 8% of gross monthly revenue which sum shall be examined and adjusted on an annual basis based on actual volume of waste placed at facility. Additionally, Mr. Laird said that an agreement had been reached to lower the fee schedule because many people who previously used the facility on 21st Street are not using this landfill.
Commissioner Zogmaister moved to approve Contract C2010-159, First Amendment to the Landfill Operating and Management Agreement with Moulding & Sons Landfill LLC; Chair Bischoff seconded, both voting aye.

3. First reading of an amendment to the County Fee Ordinance relating to fees charged at the Weber County C& D Landfill, the Weber County Transfer Station and the Weber County Compost Facility

Gary Laird, County Solid Waste Management, outlined the changes, including adding the bag price for compost and the pricing for the above listed contract.
Commissioner Zogmaister moved to approve the first reading of the amendment to the County Fee Ordinance relating to fees charged at the Weber County C& D Landfill, the Weber County Transfer Station and the Weber County Compost Facility; Chair Bischoff seconded, both voting aye.

 

4. Contract for capital defense by and among Weber County, Gary Barr and Ryan Bushell- Contract C2010-160

David Wilson, Deputy County Attorney, presented this capital defense contract for the defense of Jeremy Valdes. The contract had been sent out with some changes to defense counsel but Mr. Wilson had not received response. He requested approval of the contract. It covers up to $100,000, which includes payment for both attorneys but does not include extraordinary expenses.
Commissioner Zogmaister moved to approve Contract C2010-160 for capital defense by and among Weber County, Gary Barr and Ryan Bushell; Chair Bischoff seconded, both voting aye.

F. Public hearing

1.Commissioner Zogmaister moved to adjourn the public meeting and convene the public hearing; Chair Bischoff seconded, both voting aye.

2. Public hearing regarding the vacation of lot 2 of the North Fork Acres Subdivision

Ben Hatfield, County Planning Division, stated that lot 2 of North Fork Acres also shared a well that was on lot 1 of the subdivision. Water for the JHL Subdivision will come from that same well. He noted that the county is still waiting to receive letters from public utility companies regarding their easements to be vacated with this ordinance. The subdivision plat and the vacation will not be recorded until the appropriate letters are received. Chair Bischoff invited public comments and Chris from Reed and Associates stated that he was representing Jack Lyons and would address any questions.

4.Commissioner Zogmaister moved to adjourn the public hearing and reconvene the public meeting; Chair Bischoff seconded, both voting aye.

5. Action on a public hearing regarding the vacation of lot 2 North Fork Acres Subdivision and all public utility easements on lot 2 North Fork Acres Subdivision - Ordinance 2010-13
Commissioner Zogmaister moved to adopt Ordinance 2010-13 vacating lot 2 of North Fork Acres Subdivision and all utility easements; Chair Bischoff seconded.
