OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, July 6, 2010 - 10:00 a.m.
Commission Chambers, 2380 Washington Blvd., Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. 4. Set public hearing for July 27, 2010, 10 a.m., regarding an amendment to County Zoning Ordinance, Chapter 44 (Ogden Valley Destination and Recreation Resort Zone)
Commissioner Dearden moved to approve the consent items as presented; Commissioner Zogmaister seconded, all voting aye.
E. Action Items:
1. Resolution of the Commissioners of Weber County appointing a member to the Weber County Library Board - Resolution 19-2010
Commissioner Zogmaister presented this item stating that the Library Board had forward names to the County Commission in their order of preference.
Commissioner Zogmaister moved to adopt Resolution 19-2001 appointing Kathleen Herndon to the Weber County Library Board for a 4-year term; Commissioner Dearden seconded.

2. Contract with GOAL Foundation for continued organization, support and operation of the Ogden Marathon, Xterra National Championships, Hurt in the Dirt, Winter Dew Tour and Archery World Cup Events - Contract C2010-141
Mike Caldwell, County Public Information Officer, stated that this year there were 8,000 runners in the Ogden Marathon, that the race required 950 volunteers and 6,000 volunteer hours to produce. There are three staff members who help plan and produce these events. This contract is in the amount of $60,000, which comes from tourism taxes.
Commissioner Dearden moved to approve contract C2010-141 with GOAL Foundation for continued organization, support and operation of the Ogden Marathon, Xterra National Championships, Hurt in the Dirt, Winter Dew Tour and Archery World Cup Events; Commissioner Zogmaister seconded, all voting aye.
3. Contract with Brad or Kathi Goll to have Sandpile Creations provide sand sculptures for the 2010 Weber County Fair - Contract C2010-142
Commissioner Dearden presented this contract.
Commissioner Dearden moved to approve contract C2010-142 with Brad or Kathi Goll to provide sand sculptures for the 2010 Weber County Fair, subject to the comptroller’s approval; Commissioner Zogmaister seconded, all voting aye.
4. Contract with Due West, LLC to have Due West perform at the 2010 Weber County Fair - Contract C2010-143
Jan Wilson, of the County Fair, presented this contract in the amount of $4,800.
Commissioner Zogmaister moved to approve contract C2010-143 with Due West, LLC to perform at the 2010 Weber County Fair; Commissioner Dearden seconded, all voting aye.
5. Contract with Utah State University to establish a partnership between the citizens of Utah residing in said county and Utah State University - Contract C2010-144
Jerry Goodspeed, of the U.S.U. Extension, presented the annual contract renewal stating there were no changes from the previous year.
Commissioner Dearden moved to approve contract C2010-144 with Utah State University to establish a partnership between the citizens of Utah residing in said county and Utah State University; Commissioner Zogmaister seconded, all voting aye.
6. Resolution rescinding a previous appointment and making an appointment to the Ogden Valley Township Planning Commission - Resolution 20-2010
Chair Bischoff noted that since appointing members to this Planning Commission a week ago Mr. Simpson decided not to accept the appointment at this time. Today’s appointment comes from the applicants that had been originally interviewed. Commissioner Zogmaister said that this is an opportunity to participate in the process and it is important to give an opportunity to new applicants.
Commissioner Zogmaister moved to adopt Resolution 20-2001 rescinding a previous appointment and appointing Laura Warburton to the Ogden Valley Township Planning Commission; Commissioner Dearden seconded.

F. Assign Pledge of Allegiance & Thought of the Day for Tuesday, July 13, 2010, 10 a.m.
G. Public Comments:
Doug Stephens, Director of the Ogden Pioneer Days Parade, stated that he had received a phone call indicating the County Commission was not participating in this year’s parade and that this was very discouraging to him. Chair Bischoff said that the decision had not yet been made and will be considered.
Greg Anderson, of Huntsville, expressed concerns that he has heard from other members of the Huntsville community regarding Laura Warburton–that she has polarizing political views and is not as impartial a voice as they would want in that commission. Some feel a defeatist attitude regarding unchecked development in the area and they are concerned she would add to those concerns.
Dana Gregory, of Huntsville, asked about the announcement in the newspaper for the 7/27/2010 discussion regarding a Residential Treatment Facility for children. Chair Bischoff clarified that this item is in the Planning Commission agenda and not the County Commission’s. Rob Scott, County Planning Department Director, explained that there is an application to establish a residential treatment academy as an allowed use in one of the Forest Zones. It was discussed at the last Ogden Valley Planning Commission meeting, where the item was tabled for further review. Tonight the Ogden Valley Township Planning Commission will have a work session, where that item will be discussed, and it is possible that it will be discussed at the 7/27 Planning Commission meeting. Chair Bischoff explained that it is early in the process and it is not yet known whether this item will require a public hearing before the County Commission. Ms. Gregory said that the concern for the Ogden Valley residents is that recently they saw requests for bids in the newspaper for this academy and were wondering how the applicants were moving forward when they do not even have a conditional use permit. Mr. Scott explained that the requests for bids was outside the county’s process and if someone decides to move forward, it is at their own risk. Commissioner Zogmaister noted that the application for a conditional use permit would apply not only for that particular request but for any type of development and would change that zone.
