OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, June 22, 2010 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. D. Consent Items:

Commissioner Dearden moved to approve the consent items, holding the June 1 minutes; Chair Bischoff seconded, both voting aye.
E. Action Items:
1. Request on Resolution appointing members to the Ogden Valley Planning Commission
This item was held until all three commissioners are present.
2. Small source exemption registration with Utah Division of Air Quality for animal crematorium
Nate Pierce, County Operations Department Director, stated that the Animal Services facility expansion includes installation of an animal crematorium, which requires this registration.
3. Approval of a partial reconveyance - Lots 14 & 15, Parkland Business Center, Subdivision 1
Nate Pierce, County Operations Department Director, noted that when the Weber County former landfill was closed several years ago a clay cap was placed over it. The clay came from the vicinity of the Parkland Business Center in Pleasant View City and there were a series of agreements with Pleasant View City and Parkland Business Center. As part of those negotiations, the county fronted the cost to build the road into that Business Park. In consideration of building that road, the county could use the clay and the cost to the county for providing the road would be paid back over time with the sale of the lots in the Business Park. The county became the Trust Deed Note holder and beneficiary of the Deed of Trust. The lots have all been sold and Weber County has received its money back. There is a request for a partial reconveyance of all of lots 14 and 15 and for a Substitution of Trustee with Lincoln Title Insurance Agency as Successor Trustee.
Commissioner Dearden moved to approve the Partial Reconveyance and the Substitution of Trustee documents for lots 14 and 15 in the Parkland Business Center, Subdivision 1; Chair Bischoff seconded, both voting aye.
4. Contact with Stanley Consultants, Inc., to provide testing and perform the necessary documentation to insure the federal funds are properly spent and construction is properly performed - Contract C2010-137
Curtis Christensen, County Engineer, stated that this contract is for the provision of consulting construction engineering services for the North Ogden Devise project. The contract amount is $41,708.92 and the county’s match portion is 6.77% of that.
Commissioner Dearden moved to approve Contact C2010-137 with Stanley Consultants, Inc., to provide testing and perform the necessary documentation to insure the federal funds are properly spent and construction is properly performed; Chair Bischoff seconded, both voting aye.
5. Contract with Morrison-Maierle, Inc., for specialized engineering services to evaluate and analyze the rock slope above the roadway - Contract C2010-138
Curtis Christensen, County Engineer, stated that this is related to the above item and is for design modification. The project required some additional specialized engineering services to evaluate the rock slope. The contract amount is $1,88.91 and the county’s match portion is less than $150.
Commissioner Dearden moved to approve Contact C2010-138 with Morrison-Maierle, Inc., for specialized engineering services to evaluate and analyze the rock slope above the roadway; Chair Bischoff seconded, both voting aye.
6. Interlocal Agreement with Davis County Library to extend cooperative borrowing to residents of each service area - Contract C2010-139
Lynnda Wangsgard, County Library Director, presented this contract renewal, which had been approved by the Library Board on 5/18/2010. The term is from 7/1/2010 - 6/30/2015 and may be terminated by either party with a 60-day written notice.
Commissioner Dearden moved to approve Contact C2010-139, Interlocal Agreement with Davis County Library to extend cooperative borrowing to residents of each service area; Chair Bischoff seconded, both voting aye.
7. Contract with Brock Lenox to provide bee inspection services - Contract C2010-140
There was no presenter from the U.S.U. Extension Services. David Wilson, Deputy County Attorney, stated that State statute requires the county to have a bee inspector. The contract amount is $,2,168.
Commissioner Dearden moved to approve Contact C2010-140 with Brock Lenox to provide bee inspection services; Chair Bischoff seconded, both voting aye.
F. Public hearing:
1. Commissioner Dearden moved to adjourn the public meeting and convene the public hearing; Chair Bischoff seconded, both voting aye.
2. Public hearing to consider rezoning property located at approximately 1770 East 6200 South (Washington Heights Baptist Church) from Gravel Zone to Residential Estates RE-15
Justin Morris, County Planning Division, stated that the church is requesting to rezone their property in order to expand. The G Zone was formerly titled the S-2G Zone (suburban residential gravel) and allowed all residential uses. That zone was amended in 2002, removing all residential uses, which made the church a non-conforming use. The Zoning Ordinance does not allow for the expansion of a non-conforming use. The RE-15 zone surrounds this property.
Chair Bischoff invited public comments and none were offered.
3. Commissioner Dearden moved to adjourn the public hearing and reconvene the public meeting; Chair Bischoff seconded, both voting aye.
4. Action on public hearing:
F.2. - Rezone property at 1770 E. 6200 S. from Gravel Zone to Residential Estates RE-15 - Ordinance 2010-12
Commissioner Dearden moved to adopt Ordinance 2010-12 rezoning property located at approximately 1770 E. 6200 S. from Gravel Zone to Residential Estates RE-15 to allow an expansion of the Washington Heights Baptist Church; Chair Bischoff seconded.
