OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, June 8, 2010 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. Commissioner Dearden moved to approve the consent items as presented; Commissioner Zogmaister seconded, all voting aye.
E. Action Items:
1. Final reading of an ordinance making certain changes to Title 24, Chapter 7 of the Weber County Ordinances relating to the RAMP Tax - Ordinance 2010-10
David Wilson, Deputy County Attorney, noted that this minor amendment was discussed last week. It states that projects for the “population” RAMP grants shall be completed within a year of the date of the notice of approval letter sent by the County Commission giving notice of the award. Commissioner Dearden asked if there was an extension if something happened beyond their control, and Mr. Wilson replied that if necessary, an extension can be granted.
Commissioner Zogmaister moved to adopt Ordinance 2010-10 amending Title 24, Chapter 7 of the County Ordinances relating to the RAMP Tax; Commissioner Dearden seconded.

2. Contract with MCAT for funding a computer assisted mass appraisal system - Contract C2010-123
Dan Olsen, County Comptroller, handled this item. The State increased the property tax levy for the its portion of the Assessment & Collecting Tax last year to use the increase to pay Multicounty Appraisal Trust for the State-wide assessment computer system. It is desired to have one contract with one company to handle all the counties in the State. Because Weber County had moved ahead with the company in getting its own portion of that system up and running for this year, it is a bit ahead of the other counties, however, the county had understood that MCAT would be paying for our county’s portion but MCAT believed the county would be paying upfront, being reimbursed at the end. The county has now agreed to hold aside in its fund balance an amount equal to what it would send to MCAT, (which will go ahead and pay the bills for the county’s portion of the computer system) until the system is running and MCAT no longer needs the money. Commissioner Zogmaister noted that the county will be reimbursed, but not until after all the counties are onboard.
Commissioner Dearden moved to approve Contract C2010-123 with MCAT for funding a computer assisted mass appraisal system; Commissioner Zogmaister seconded, all voting aye.
3. Contract with Bond Logistix LLC (BLX) for arbitrage rebate compliance services - Contract C2010-124
Dan Olsen, County Comptroller, stated that this contract (for approximately $4,000) allows BLX to calculate whether the county owes the IRS arbitrage liability on the MBA Lease Revenue Refunding Bonds, Series 2005.
Commissioner Zogmaister moved to approve Contract C2010-124 with Bond Logistix LLC for arbitrage rebate compliance services; Commissioner Dearden seconded, all voting aye.
4. Contract with Zions Bank Public Finance to provide financing to purchase 27 fleet vehicles and Kabota Tractor for Fleet Management - Resolution 16-2010, Contract C2010-125
Dan Olsen, County Comptroller, noted that this item went out to bid and Zions. The amount is $894,332, the fixed interest rate is 3.2% for 3 years with no penalty for early debt retirement.
Commissioner Dearden moved to adopt Resolution 16-2010 approving Contract C2010-125 with Zions Bank Public Finance to provide financing to purchase 27 fleet vehicles and Kabota Tractor for Fleet Management; Commissioner Zogmaister seconded.

5. Contract with Mike Van Alfen to produce the demolition derby at the 2010 County Fair - Contract C2010-126
Jan Wilson, County Fair, presented this contract for $2,800. Commissioner Zogmaister noted that the contractor had not checked a Worker’s Compensation option in the contract. Ms. Wilson stated that Mr. Van Alfen did not have employees and she would handle that.
Commissioner Zogmaister moved to approve Contract C2010-126 with Mike Van Alfen to produce the demolition derby at the 2010 County Fair; Commissioner Dearden seconded, all voting aye.
6. Contract with Wasatch Sod Slingers for lawn mower races at the 2010 County Fair - Contract C2010-127
Jan Wilson, County Fair, presented this contract for $1,500.
Commissioner Dearden moved to approve Contract C2010-127 with Wasatch Sod Slingers for lawn mower races at the 2010 County Fair; Commissioner Zogmaister seconded, all voting aye.
7. Contract with Hooper City to provide road maintenance services to Hooper City - Resolution 17-2010, Contract C2010-128
Kelly Hipwell, County Roads Department, presented this contract renewal. Rates adjustments had been made to compensate for cost increases. The 3-year contract term goes through 6/30/2013.
Commissioner Zogmaister moved to adopt Resolution 17-2010 approving Contract C2010-128 with Hooper City to provide road maintenance services to Hooper City; Commissioner Dearden seconded.

8. Contract with TNT Auction, Inc. to sell Weber County vehicles and equipment declared surplus by the Weber County Commission - Contract C2010-129
Doug Dickens, County Operations Department, presented this second renewal of the contract with TNT. The contract is for three years. TNT receives 5% of the sale price.
Commissioner Dearden moved to approve Contract C2010-129 with Contract with TNT Auction, Inc. to sell Weber County vehicles and equipment declared surplus by the Weber County Commission; Commissioner Zogmaister seconded, all voting aye.
9. Contract with Municipal Code Corporation to provide codification and publishing of the County’s Ordinances to keep our information current and available to county departments and the public - Contract C2010-130
David Wilson, Deputy County Attorney, stated that a Request for Proposals had been issued for this service and two bids were received. Municipal Code will review the county’s ordinances to ensure they are internally consistent as well as with State law. Municipal Code will assign a legal team to work with a team that the county establishes and then prepare a proof for the county to review. Once approved, they will publish the code books and the code will be available on the internet and intranet. The initial estimated price is $13,875 and depends on how many illustrations, etc., are needed. Mr. Wilson said that the county was pleased with this price.
Commissioner Zogmaister moved to approve Contract C2010-130 with Municipal Code Corporation to provide codification and publishing of the County’s Ordinances and keep that information current and available to county departments and the public; Commissioner Dearden seconded, all voting aye.
