OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, March 23, 2010 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Commissioner Dearden moved to approve the consent items; Commissioner Zogmaister seconded, all voting aye.
E. Action Item:
1. Approval of the Weber County 2010 Polling Locations
Douglas Larsen, Clerk/Auditor’s Office, presented the polling locations as per statute.
Commissioner Zogmaister moved to approve the Weber County 2010 polling locations; Commissioner Dearden seconded, all voting aye.
2. Contract with Bean-a-Colada Coffee Café to rent space from the Weber County Library for a Coffee Café - Contract C2010-54
Monette Hurtado, Deputy County Attorney, presented this contract renewal. The terms are the same as in the past, except that if Bean-a-Colada has met the stipulated monthly gross sales the lease amount will increase. The county has requested financial information from Bean-a-Colada but is waiting for it. Ms. Hurtado addressed the commissioners’ questions explaining that the lease was set up as $700/month for the first three months, followed by $1,000/month thereafter and then 8% of gross sales once the monthly minimum is met or exceeded.
Commissioner Dearden moved to approve Contract C2010-54 with Bean-a-Colada Coffee Café, dba Under the Sea-N-Ski Properties, LLC, to rent space from the Weber County Library for a Coffee Café; Commissioner Zogmaister seconded, all voting aye.
3. Contract with Plain City to provide Animal Control Services - Contract C2010-55
Reed Richards, Deputy County Attorney, presented this contract extension through 6/30/2010.
Commissioner Zogmaister moved to approve Contract C2010-55, extension of agreement to provide animal control services to the city; Commissioner Dearden seconded, all voting aye.
4. Request from County Operations to declare the following Parcels as surplus property: #09-067-0038
140' X 20' parcel located at approximately 1550 Douglas Street

Nate Pierce, County Operations Department Director, asked that the above items listed with land serial numbers be removed from today’s agenda. They will be handled when legal descriptions are finalized.
In 1995 a strip of Weber County property, on the east end (south side) of Douglas Street consisting of about 140' X 20', was sold to the abutting property owner to the west. At that time, Wilford & Genine Hale had identified a similar parcel to purchase on the north side of the street, however, the Hales did not conclude the sale due to extenuating circumstances. Mr. Hale has now approached the county desiring to purchase the property. The county has no future need or intended use of this property, which is not developable. Mr. Pierce said that the one condition the county would require of this property owner is to do a lot line adjustment and incorporate this property into his existing parcel.
Commissioner Dearden moved to declare surplus the 140' X 20' parcel located at approximately 1550 Douglas Street; Commissioner Zogmaister seconded, all voting aye.
5. Resolution of the Board of Commissioners of Weber County to execute an agreement establishing the Weber County Justice court and Municipal Affiliates as part of the Roy Justice Court - Resolution 13-2010
6. Interlocal Agreement with Roy City for Justice Court Services - Contract C2010-56
Reed Richards, Deputy County Attorney, addressed the two above items. He stated that the volume of the County’s Justice Court cases has been significantly decreasing for a number of years, due in part to Ogden City setting up its own justice court a few years ago. This item affects the affiliated municipalities that use the county’s justice court (such as Hooper, West Haven and Huntsville).
This contract represents negotiations that have been taking place for about a year with Roy City, which will operate a separate division in Roy City to handle cases from the county and the affiliated municipalities. Mr. Richards noted that there has been discussion to have satellite locations. The contract is effective April 1. Roy City will keep 50% of the fines for operating the court and the county and municipalities will get 50% of the fines for doing prosecution work. Mr. Richards stated that this was the uniform system used throughout the State. His ideal solution for the county would be to have one master justice court that incurred all the expenses and divided those equitably.
Commissioner Dearden moved to adopt Resolution 13-2010 approving Contract C2010-56, Interlocal Agreement with Roy City for Justice Court Services; Commissioner Zogmaister seconded.

G. Public Comments:
Brice Penrod, of Pleasant View, President of Counterpoint Construction, asked what office he should submit two GRAMA requests for contracts and Monette Hurtado, Deputy County Attorney, responded that they should go to the Clerk/Auditor’s Office.
