OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, October 13, 2009 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. D. Presentation to Chief Terry Thompson and Captain Kevin Burton for their recent graduation from Utah Sheriff’s Jail Commander Certification Academy
Weber County Sheriff Brad Slater noted that Captain Burton could not be present. He recognized Chief Thompson and Captain Burton for completing the 120-hour jail commander certification; they are the first of deputies and sheriffs in the State to complete it. Chief Thompson stated that the training was excellent, that Utah is very proactive in the corrections field and sets the standard across the nation.

Commissioner Bischoff moved to approve the consent items, removing Alan W. Reyns; Commissioner Zogmaister seconded, all voting aye.
F. Action Items:
1. Consideration on resolution authorizing issuance & sale of not more than $12,500,000 aggregate principal amount of Sales Tax Revenue Bonds, Series 2009, of Weber County, Utah for the purpose of (I) financing all or a portion of the costs of acquiring, constructing, equipping and furnishing an animal shelter and (ii) refunding certain of the county’s outstanding sales tax bonds; and related manners
This item was held until next week.
2. Final approval of Bowden Storage Subdivision 1 (lot)
Sean Wilkinson, County Planning Division, stated that as part of the expansion of the Wolf Creek R.V. storage facility (recently rezoned), approximately 1.34 acres of additional property is being added to the existing “R.V. Storage at Wolf Creek Subdivision” and the subdivision plat must be amended and the existing subdivision vacated. The vacation will be handled later in this meeting. The Bowden Subdivision consists of 3.28 acres and meets the Subdivision Ordinance. The Ogden Valley Planning Commission unanimously recommended approval and staff also recommends approval.
Commissioner Zogmaister moved to grant final approval of Bowden Storage Subdivision 1 (lot); Commissioner Bischoff seconded, all voting aye.
3. Contract with Pictometry to provide updated aerial photos and LIDAR for parts of Weber County, Ogden City and Mt. Ogden - Contract C2009-167
Lance Peterson, Weber County Emergency Management, stated that the county used Homeland Security funds for a contract (approved 7/25/2006) with Pictometry for oblique aerial photographs. Pictometry has a licensed program that provides all government users and other partners access to aerial photographic imagery. The county will use its $20,000 Homeland Security grant for this contract and there is no match portion required. LIDAR has been added in this flight and the county plans to get more accurate elevation data for flood modeling and landslide projections. The county is partnering with Ogden City and Chris Peterson for this contract. Ogden City plans to get higher resolution for the Ogden area and Chris Peterson plans to get LIDAR of Mount Ogden. Commissioner Zogmaister asked what portion of Weber County they would focus on and Mr. Peterson referred to the map stating that it would be between Pineview Reservoir and Ogden City and following the floodplain more out west. It includes areas of Riverdale City, South Ogden City, the Uintah area, Marriott-Slaterville City, Farr West City, and Harrisville City.
Commissioner Bischoff moved to approve Contract C2009-167 with Pictometry to provide updated aerial photos and LIDAR for parts of Weber County, Ogden City and Mt. Ogden; Commissioner Zogmaister seconded, all voting aye.
4. Contract with Manatron, Inc. to extend the agreement between Weber County and Manatron, Inc. to continue services for the Sigma Software system - C2009-168
John Ulibarri, Assessor’s Office, presented this maintenance and support contract in the amount of $30,375 for a term through 6/30/2010.
Commissioner Zogmaister moved to approve Contract C2009-168 with Manatron, Inc. to extend the agreement between Weber County and Manatron, Inc. to continue services for the Sigma Software system; Commissioner Bischoff seconded, all voting aye.
5. Contract with Michael D. Bouwhuis to act as the Indigent Defense Coordinator - Contract C2009-169
Brad Dee, County Human Resources Department Director, noted that Mr. Bouwhuis was present. On 9/8/2009 the Commission approved the preparation of a contract with Mr. Bouwhuis as the Indigent Defense Coordinator.
This contract includes provisions for the coordination of indigent defense for the District, Justice and Juvenile courts, for implementation of policies and procedures regarding “Standards of Indigency,” review of case load information to ensure equal case loads, establishing statistical reports and costs that demonstrate gross trends and caseload management, and implementation of a system for the collection from contract attorneys of files that are closed and the storage of such files. The contract is for $90,000/year beginning 10/1/2009 through 12/31/2012 (with prorating for 2009) and contains an escape clause. Mr. Bouwhuis will carry his own malpractice insurance. Mr. Bouwhuis addressed the commissioners’ question regarding the deduction from compensation to an attorney who fails to appear or provide coverage at court, and the commissioners agreed with inserting $600 to paragraph 6 of the contract as the amount to deduct in such cases.
Commissioner Bischoff moved to approve Contract C2009-169 with Michael D. Bouwhuis to act as the Indigent Defense Coordinator, with the discussed change in the amount of $600.00 to paragraph 6; Commissioner Zogmaister seconded, all voting aye.
G. Public Hearing
1. Commissioner Zogmaister moved to adjourn the public meeting and convene the public hearing; Commissioner Bischoff seconded, all voting aye.
2. Public hearing regarding a request to vacate the R.V. Storage at Wolf Creek Subdivision
(See above related item, F.2.) Sean Wilkinson, County Planning Division, stated that 1.34 acres was being added to what was formerly the R.V. Storage at Wolf Creek Subdivision and will now be known as the Bowden Storage Subdivision. He explained the importance of vacating this subdivision once the new subdivision comes into place, which is to avoid potential future errors in the chain of title. The Ogden Valley Planning Commission unanimously recommended approval of the vacation and staff also recommends it. Chair Dearden invited public comments and none were offered.
3. Commissioner Bischoff moved to adjourn the public hearing and reconvene the public meeting; Commissioner Zogmaister seconded, all voting aye.
