OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, August 18, 2009 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. Commissioner Bischoff moved to approve the consent items; Commissioner Zogmaister seconded, all voting aye.
E. Action Items:
1. Request for Equipment Lease financing with Wells Fargo for a Caterpillar 966H front-end loader for the Transfer Station
This item was held.
2. Final approval of Green Acres Subdivision (2 lots) and deferral of curb, gutter and sidewalk
The applicant was present. Justin Morris, County Planning Division, stated that accesses to the lots were along 4300 W. and the applicant was requesting deferral of curb, gutter and sidewalk along his frontage. This subdivision is within the 1.5 mile radius of Kanesville Elementary School, albeit on the edge of the buffer. Culinary water will be provided by Taylor West Weber Water Improvement and wastewater services by a Weber-Morgan Health Department-approved septic system. The Planning Commission unanimously recommended final approval with the requested deferrals.
Chair Dearden stated that the commissioners’ packets did not contain a letter from the School District but Mr. Morris had received one and read from it that all students are eligible for bussing and that current stops are on 4300 W. Commissioner Zogmaister noted that generally bussing occurs within two miles and Mr. Morris thought perhaps it was due to the fact that 4300 W. is a very busy road.
Commissioner Zogmaister moved to grant final approval of Green Acres Subdivision, 2 lots, with deferral of curb, gutter and sidewalk; Commissioner Bischoff seconded, all voting aye.
3. Action on public hearing held 8/4/2009 to amend the Zoning Ordinance by adding Chapter 44, Ogden Valley Destination and Recreation Resort Zone; amending Chapter 1, General Provisions, to include new definitions; amending Chapter 18C, Ogden Valley Architectural, Landscape and Screening Standards, to include a new section with enhanced landscaping requirements for Resort development sites proposing building heights that exceed 35 feet; amending Chapter 32B, Ogden Valley Signs, to include a new section addressing resort signs; and amending Chapter 35, Petitioner Requirements-Rezoning Procedure and Development Agreement, to include a new section that addresses supplementary requirements for Ogden Valley Destination and Recreation Resort Zone petitions - Ordinance 2009-16
Scott Mendoza, County Planning Division, stated that this item was to adopt the Destination and Recreation Resort Zone and its related amendments. On 8/4/2009 the Commission held a public hearing, valuable comments were received, and the first reading was approved with three discussed changes, which have since been incorporated into this ordinance. Mr. Mendoza had spoken with Commissioner Dearden yesterday which prompted a consultation with David Wilson, Deputy County Attorney, and additional clarification was presented that density related to additional acreage brought into the resort, which is subject to a previously approved agreement with Weber County relating to or calculating density, shall be calculated consistent with terms and conditions set forth in the previously approved Master Plan or agreement.
Commissioner Bischoff had not received any public comments since the first reading and asked if any suggested changes had been received. Mr. Mendoza had been copied on a couple of emails and one sent to a group representing some of those who spoke at the hearing simply asked them to review the changes and one reply that he read expressed support of the amendments.
