MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, June 30, 2009 - 10:00 a.m.
Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.Commissioners Present: Craig L. Dearden, Chair; Jan M. Zogmaister; Kenneth A. Bischoff

Others Present: David C. Wilson, Deputy County Attorney; Roger Brunker, Clerk/Auditor’s Office; Fátima Fernelius, Clerk/Auditor’s Office, took minutes.

D. Presentation - Seal of Service Award Presented to Shelly Bustos

Chair Dearden read the submitted nomination that outlined Ms. Bustos accomplishments and her dedicated service. He noted that these nominations come from co-workers, which was a compliment to the recipients. He presented Ms. Bustos with a Seal of Service pin, a plaque, and $100.00. Ms. Bustos expressed thanks and said that the county was very supportive of its employees.

E. Consent Items:
1. Purchase Orders in the amount of $88,351.77
2. Warrants 251455-251758 in the amount of $2,077,068.54
3. Minutes for the meeting held on June 23, 2009
4. Business License
5. Set public hearing for July 21, 2009, l0 a.m. regarding amendments to the Weber County Zoning Ordinance Chapter 23 (Supplementary and Qualifying Regulations)
Commissioner Zogmaister moved to approve the consent items; Commissioner Bischoff seconded, all voting aye.

F. Action Items:

1. Resolution of the Board of County Commissioners of Weber County appointing members to the Golden Spike Event Center Advisory Board - Resolution 19-2009

Jennifer Graham, Weber County Fair, stated that the Board had three vacancies but only had two names to submit today. Commissioner Bischoff noted that the individuals were well qualified.
Commissioner Bischoff moved to adopt Resolution 19-2009 appointing Susan Cross (through 12/31/2009) and Rod Southwick (through 12/31/2012) to the Golden Spike Event Center Advisory Board; Commissioner Zogmaister seconded.

2. Final approval of Pineview Summer Home Area Re-Survey Subdivision Lot 46, 1st Amendment

Ben Hatfield, County Planning Division, stated that the applicant was requesting final approval of a 1-lot subdivision in the Forest-40 Zone located at 5250 E. Highway 39. This 1-lot subdivision is an amendment to the Pineview Summer Home Area Re-Survey Subdivision lot 46. The amendment will allow lot 46 to increase in area from 15,932 sq. ft. to 20,064 sq. ft., to allow development of the lot with a conventional septic system approved by the Weber Morgan Health Department. The additional area will be obtained from the private-right-of-way not being utilized within the switchback adjacent to the lot.

The Pineview Summer Home Area Re-Survey Subdivision was recorded 12/29/2006. The area had previously been owned by the Forest Service and commenced development in 1958. The Federal Government then leased cabin sites to the public under an agreement. Because the subdivision was done under federal jurisdiction, in 2006 the Forest Service subdivided and then sold the land to the lot lessees. Thus, the lots were created as legal nonconforming parcels since they do not comply with area and width requirements. Mr. Hatfield stated that the subdivision met the requirements of the applicable Weber County ordinances and conformed to the General Plan. The Ogden Valley Planning Commission unanimously recommended final approval on 3/17/2009 subject to staff and other agency recommendations. Based upon its compliance, staff recommends final approval. Chair Dearden asked how many more of these types of subdivisions would be coming before the Commission and Mr. Hatfield responded that was unknown.
Commissioner Zogmaister moved to grant final approval of Pineview Summer Home Area Re-Survey Subdivision Lot 46, 1st Amendment; Commissioner Bischoff seconded, all voting aye.

G. Public Hearings:

1.Commissioner Bischoff moved to adjourn the public meeting and convene the public hearings; Commissioner Zogmaister seconded, all voting aye.

2. Public hearing regarding the vacation of lots 5, 6 and 7 of Block 7 of the Hermitage of Ogden Canyon located at approximately 402 Ogden Canyon

Ben Hatfield, County Planning Division, stated that the vacation of these lots has been replaced by the Meu Sonho Subdivision recorded on 6/2/2009. The County Commission approved the subdivision on 6/2/2009. Staff recommends approval of this vacation. Chair Dearden invited public comments and none were offered.

3. Public hearing regarding the vacation of lot 46 of the Pineview Summer Home Area Re-Survey Subdivision (consisting of 1 lot) located at approximately 5250 E. HWY 39

See item F.2. above. Ben Hatfield, County Planning Division, stated that the amendment will allow lot 46 to increase in area for development of the lot with a conventional septic system. Once the lot is vacated it will be replaced by the Pineview Summer Home Area Re-Survey Subdivision lot 46, 1st Amendment. This vacation coincides with the final approval of the amended lot. Chair Dearden invited public comments and none were offered.

4.Commissioner Zogmaister moved to adjourn the public hearings and reconvene the public meeting; Commissioner Bischoff seconded, all voting aye.

5. Action on public hearings:

G.2. - Vacation of lots 5, 6 and 7 of Block 7 of the Hermitage of Ogden Canyon - Ordinance 2009-11

Commissioner Bischoff noted that he had abstained from discussion and voting in a previous meeting because the petitioner is a close relative. He asked legal counsel if it was appropriate to abstain today and David Wilson, Deputy County Attorney, responded that it was.
Commissioner Zogmaister moved to adopt Ordinance 2009-11 vacating lots 5, 6 and 7 of Block 7 of the Hermitage of Ogden Canyon located at 402 Ogden Canyon; Chair Dearden seconded.

G.3. - Vacation of lot 46 of the Pineview Summer Home Area Re-Survey Subdivision - Ordinance 2009-12
