OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, April 14, 2009 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. Kenneth A. Bischoff was excused.

Commissioner Zogmaister moved to approve the consent items; Chair Dearden seconded, both voting aye.

2. Contract with Automated Geographic Reference Center (AGRC) for the purchase of 6" Aerial Imagery as part of a joint local, state, and federal aerial project - Contract C2009-98
Ernest Rowley, County Recorder/Surveyor, stated that the State Office of AGRC is in the process of performing a 2009 aerial flight of the entire State. This is the same type of project conducted in 2006 whereby AGRC received participation and funding from numerous state, federal and local agencies.
This project will use higher resolution. The cost per square mile ($126) is lower in 2009 due to partnering with additional federal agencies and the number of square miles has decreased and basically includes the developing areas of the county to update the new developments that have occurred. Mr. Rowley showed a map of the boundaries. The county agrees to pay $13,847.40 for the unincorporated areas as its portion of the total $27,720, and the cities will pay the difference. Mr. Rowley addressed the commissioners’ questions including that the boundary did not go to the Great Salt Lake and that the AGRC anticipates that it will be 5, possibly 10 years, before being able to partner with federal agencies again. To do this same area without involvement of other agencies would probably cost the county about $500,000 and over $1 million to do the entire county.
Commissioner Zogmaister moved to approve Contract C2009-98 with Automated Geographic Reference Center for the purchase of a 6" Aerial Imagery as part of a joint local, state, and federal aerial project; Chair Dearden seconded, both voting aye.
3. Action on the Weber County Pathways Master Plan
Rob Scott, County Planning Department Director, stated that Weber Pathways had approached County Operations in 2008 requesting the placement of temporary signage for existing bike paths in the Uintah Highlands area and the request was approved. As staff researched this request and compared it to the Western Weber General Plan, it was discovered that the General Plan needs updating. This request also involved the jurisdictional lines of Ogden, South Ogden and Uintah Highlands. In communicating with the Western Weber Planning Commission, Weber Pathways, Ogden City and County Planning staff, the idea of developing a county-wide pathways master plan emerged.
Since that time, County Planning and Weber Pathways developed a proposal and presented it to the Weber Pathways Board, which endorsed it and appropriated $5,000 to hire a consultant. A Weber State University professor has been hired to conduct the project. County Planning is recommending that the County Commission endorse the proposal. This will be a collaborative effort and Weber County’s contribution will be mostly in-kind. A committee will oversee the 3-phase project (data collection, plan drafting and implementation). The item will be placed on WACOG’s agenda. Helene Liebman, Weber Pathways, stated that they plan to ask UDOT to participate. They would like to identify major UDOT crossings for the plan where an under or over pass will be needed and have these incorporated into UDOT’s long term plans. Weber Pathways hopes these can be built at no cost. Chair Dearden asked if the county-wide plan would incorporate the Valley Pathways and Ms. Liebman hoped it would. The commissioners expressed their support for this project.
Commissioner Zogmaister moved to support the concept for the county-wide pathways mater plan; Chair Dearden seconded, both voting aye.
1. Contract with Utah State University Extension Services to renew the agreement between USU Cooperative Extension & Weber County for extension education work - Contract C2009-99
No one was present from USU to present this item and David Wilson, Deputy County Attorney, stated that this was an annual contract, that Chris Allred, Deputy County Attorney, had reviewed it and had stated it was similar to past contracts. The County Comptroller had also reviewed it.
Under the advice of legal counsel, Commissioner Zogmaister moved to approve Contract C2009-99 with Utah State University Extension Services to renew the agreement for extension education work; Chair Dearden seconded, both voting aye.
F. Public hearing:
1.Commissioner Zogmaister moved to adjourn the public meeting and convene the public hearing; Chair Dearden seconded, both voting aye.
2. Public hearing regarding the vacation of Lot 2 of Elias Estates Subdivision
Sean Wilkinson, County Planning, showed an area map. He stated that this subdivision was created in 1994. Lot 1 has an existing single family dwelling and lot 2 has never been built on and is currently being used for agricultural purposes. The applicant has stated that there are no plans to develop lot 2 as a building lot or to develop the agricultural land adjacent to this lot and requested it be vacated so that the area that was located within lot 2 will be combined with the adjacent 25-acre agricultural parcel. This lot contains a 10-foot wide public utility easement around its boundary and the applicant has contacted the utility companies to request vacation of the easement on the sides and rear of this property, while the easement along the front will remain. All the utility companies provided written consent for the easement vacation. Allen Berrett, applicant, was present. Chair Dearden invited public comments and none were offered.
3.Commissioner Zogmaister moved to adjourn the public hearing and reconvene the public meeting; Chair Dearden seconded, both voting aye.
4. Action on public hearing:
F.1. - Vacation of Lot 2 of Elias Estates Subdivision - Ordinance 2009-10
Commissioner Zogmaister moved to adopt Ordinance 2009-10 vacating Lot 2 of Elias Estates Subdivision including utility easements, excepting the utility easement which runs adjacent to 4300 West; Chair Dearden seconded.
