MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, February 17, 2009 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.Commissioners Present: Kenneth A. Bischoff and Jan M. Zogmaister. Craig L. Dearden participated via telephone conference.

D. Presentation of the Annual Weber County Landfill Closure Report
Gary Laird, County Solid Waste Administrator, noted that the county submits annual reports to the State related to the Compost Facility, the Landfill Post-closure Care, and the Transfer Station, and he briefly reported on the three areas. The county also submits to the State a Financial Assurance to address possible problems at the former landfill and currently there is a $1,469,000 balance. Mr. Laird stated that the landfill gas project at the landfill was producing a lot of electricity and carbon credits; in 2008 5,908,220 kilowatts of electricity were generated. Commissioner Bischoff asked if the 229,000+ tons of material coming into the Transfer Station was typical and Mr. Laird said that it increased yearly and that figure was about 30% higher than the previous year. Commissioner Zogmaister asked if there was an increase in municipal waste and Mr. Laird responded that it was about 5%.

Commissioner Dearden moved to approve the consent items with the adjustment to the warrants; Commissioner Zogmaister seconded, all voting aye.
F. Action Items:
1. Request to waive $28.84 penalty on LSN 07-483-0008 for delinquent 2008 property taxes
John Bond, County Treasurer’s Office, stated that Larry Sunderland was 90 years old and had lived in Weber County for three years. He had paid his 2006 and 2007 taxes timely but did not remember receiving a tax notice in 2008 and forgot to pay the taxes in 2008. Mr. Sunderland had now paid the taxes and penalties and asked waiver of the penalties. Commissioner Bischoff asked what prompted Mr. Sunderland to pay the taxes and Mr. Bond responded that it was when he received the delinquent letter. Commissioner Zogmaister expressed thanks for the Tax Review Committee’s work and was glad for the Commission’s support of their decision on this item.
Commissioner Dearden moved to uphold the Tax Review Committee’s recommendation and deny the request to waive penalty of $28.84 on land serial number 07-483-0008 for delinquent 2008 property taxes; Commissioner Zogmaister seconded, all voting aye.
2. Resolution of the Board of Commissioners of Weber County reappointing a member to the Ogden Valley Planning Commission - Resolution 9-2009
Commissioner Bischoff stated that Gregory Graves had been serving on the Planning Commission and desired to serve another term. Commissioner Dearden noted that it was unusual to have the term expire on May 4th and Jim Gentry, County Planning Department, believed that when some of the townships were eliminated and the two current ones were formed it may have been around May.
Commissioner Zogmaister moved to adopt Resolution 9-2009 reappointing Gregory H. Graves to the Ogden Valley Planning Commission through May 4, 2013; Commissioner Dearden seconded.

3. Contract with Utah State Cutter and Chariot Racing Association for the Utah State Chariot Racing Championships at Golden Spike Event Center (GSEC) on 2/28 - 3/1/2009 - Contract C2009-9

Commissioner Zogmaister moved to approve Contract C2009-9 with the Utah State Cutter and Chariot Racing Association for the Utah State Chariot Racing Championships at the Golden Spike Event Center 2/28-3/1/2009; Commissioner Dearden seconded, all voting aye.
4. Contract with Utah Hispanic Match Racing for the Summer Season of Horse Racing at the Golden Spike Event Center (GSEC) - Contract C2009-10

5. Ratify Contract with Aroma Senses for a Super Liquidation Sale at the Golden Spike Event (GSEC) January 9 - 11, 2009 - Contract C2009-11

6.Contract with Ogden Publishing for the Spring Home and Garden Show at the Golden Spike Event Center March 13 - 16, 2009 - Contract C2009-12

7. Contract with Acorn Productions for an Antique Show at the Golden Spike Event Center February 21- 22, 2009 - Contract C2009-13

8. Contract with Junction City Roller Dolls for a Roller Derby at the Golden Spike Event Center on June 6, 2009 - Contract C2009-14

9. Ratify contract with Kerry Christensen for entertainment at the Sneddon Hof Winterfest at the Golden Spike Event Center January 16-17, 20 - Contract C2009-15

10. Contract with Weber/Morgan Strike Force to formalize long-standing agreement wherein the county provides accounting/purchasing services to Strike Force at no cost and county maintains separate accounts for Strike Force - Contract C2009-16
Dan Olsen, County Comptroller, stated that the county had been performing these services for many years. The county reports the Strike Force as a Trust Fund in its financial statements. The external county auditors suggested having a formal written agreement defining the terms and clarifying that those funds were separate and not county funds. There are no changes to the contractual services being provided. The Strike Force does not have payroll and the county does not provide legal services.
Commissioner Zogmaister moved to approve Contract C2009-16 with the Weber/Morgan Strike Force to formalize the long-standing agreement wherein the County provides accounting and purchasing services to the Strike Force at no cost and the County maintains separate accounts for the Strike Force; Commissioner Dearden seconded, all voting aye.
11. Contract with Brad Patton for a Severance Benefit Agreement and Release of All Claims - Contract C2009-17
John Ulibarri, County Assessor’s Office, stated that this contract would run through 4/30/2009 and in order to fund the contract the vacant position would not be filled until the end of the contract. Commissioner Dearden noted that Section 4 stated that certain property would be delivered to the county by 2/10/09 and asked if this had been done. Mr. Ulibarri believed that Mr. Patton had returned everything, with the exception of the building access card, which the county had disabled.
Commissioner Dearden moved to approve Contract C2009-17, Severance Benefit Agreement and Release of All Claims with Brad Patton; Commissioner Zogmaister seconded, all voting aye.
G. Public hearing:
1.Commissioner Dearden moved to adjourn the public meeting and convene the public hearing; Commissioner Zogmaister seconded, all voting aye.
2. Public hearing regarding the vacation of Cobble Creek Park Subdivision Phase 1, Lots 19, 20 and 21
Ben Hatfield, County Planning Department, noted that this 3-lot amended subdivision in Liberty had received final approval on 2/3/2009 by the County Commission. Commissioner Bischoff invited public comments and none were offered.
3.Commissioner Zogmaister moved to adjourn the public hearing and reconvene the public meeting; Commissioner Dearden seconded, all voting aye.

G.2. - Vacation of Cobble Creek Park Subdivision Phase 1, Lots 19, 20 and 21 - Ordinance 2009-7
Commissioner Zogmaister moved to adopt Ordinance 2009-7 vacating lots 19, 20 and 21 of Cobble Creek Park Subdivision Phase 1; Commissioner Dearden seconded.
