MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, February 10, 2009 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.Commissioners Present: Kenneth A. Bischoff and Jan M. Zogmaister. Craig L. Dearden participated via telephone conference.

Others Present: Alan D. McEwan, Clerk/Auditor’s Office; David C. Wilson, Deputy County Attorney; Fátima Fernelius, Clerk/Auditor’s Office, took minutes.

D. Consent Items:
1. Purchase orders in the amount of $243,287.85
2. Warrants #246840-247004 in the amount of $929,275.28
3. Minutes for the meetings held on January 27 and February 3, 2009
4. New business license
Commissioner Zogmaister moved to approve the consent items; Commissioner Dearden seconded, all voting aye.


F. Action Items:

1. Request to waive penalties of $34.12 on LSN 24-012-0025; $40.48 on LSN 22-030-0036, & $28.20 on LSN 22-026-0002 for delinquent 2008 property taxes

John Bond, County Treasurer’s Office, presented this request by Charles Retallick. Mr. Retallick has two homes and one building lot in the Huntsville area. He had told Mr. Bond that he lives alone and suffered with pneumonia from the last week in November through the second week of December 2008, and it had not been possible to pay his taxes timely. He had said that he pays his taxes as late as possible. It was noted that this is common practice by a large number of taxpayers. Commissioner Bischoff said that there is a deadline to pay and that people take a risk when they wait until the last day to pay. The Tax Review Committee unanimously recommended denying the request because they felt there had been ample time prior to the last week in November to pay the taxes. Mr. Retallick paid the taxes and penalties in full on 1/15/2009.
Commissioner Zogmaister moved to uphold the Tax Review Committee’s recommendation and deny waiving the penalties; Commissioner Dearden seconded. Commissioner Zogmaister voted aye, Commissioners Bischoff voted no and Commissioner Dearden voted no stating that things happen even though people have the intention to pay and Mr. Retallick had not anticipated an illness.

 

The penalties will be refunded to Mr. Retallick. Commissioner Zogmaister stated that the Tax Review Committee, which was comprised of citizens, had reviewed this, and she expressed concern that the Commission did not have any additional evidence to go against their vote.

2. Final approval of the Crandall Subdivision

Iris Hennon, County Planning Department, stated that the petitioner was requesting final approval of this 1-lot subdivision. It will front on Snow Basin Road, but a portion of the frontage will have no access as recommended by County Engineering. This lot meets site development and frontage requirements for the FV-3 Zone. A 10-foot wide pathway easement next to the road has been provided. Culinary water will be provided by a private well and a 100 foot protection zone will be maintained. Waste water will be handled by an approved septic system. The subdivision complies with the county’s Subdivision Ordinance and applicable Zoning Ordinance. The Planning Commission unanimously recommended final approval on 6/24/2008.
Commissioner Dearden moved to grant final approval of the Crandall Subdivision; Commissioner Zogmaister seconded, all voting aye.

3. Resolution appointing a Weber County Representative to the governing board of the Utah Counties Insurance Pool - Resolution 8-2009

David Wilson, Deputy County Attorney, stated that Commissioner Bischoff has been serving on this board for some time. This appointment is in effect until such time as another is appointed in Commissioner Bischoff’s stead or for a period of approximately four years ending December 31, 2012. The term can change as a result of elections or if the Commission decides to change assignments.
Commissioner Zogmaister moved to adopt Resolution 8-2009 appointing Commissioner Bischoff to the Utah Counties Insurance Pool Governing Board; Commissioner Dearden seconded.

G. Assign Pledge of Allegiance & Thought of the Day for Tuesday, February 17, 2009, 10 a.m.

H. Public Comments:

Joan Penrod, of Ogden City, asked if she could comment on any issue at this time of the meeting and when it was necessary to have approval for an agenda item. Commissioner Bischoff explained the process. She asked who was on the landfill committee. Commissioner Bischoff noted that there is no landfill committee, however, there is the Northern Utah Region Landfill Authority, which involves four entities that conducted a study to find a location to develop a regional landfill. She asked if the county intended to have a landfill committee regarding the proposed landfill at Little Mountain. Commissioner Bischoff was not aware there would be a committee. Ms. Penrod also asked if the agreement to buy land for that landfill had been approved by the County Commission and Commissioner Bischoff responded that it was approved in a public meeting. David Wilson, Deputy County Attorney, met with Ms. Penrod after the Commission meeting and addressed her questions.
