MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, November 18, 2008 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. D. Presentation of the Commissioner’s Cup Charity Golf Tournament proceeds to the designated charities - YCC Domestic Violence Program, Upward Bound Pre-College Program & the Catholic Community Service (CCS) Joyce Hansen Hall Food Bank
Commissioner Dearden noted that over the last six years the County Commission had been able to donate over $100,000 through golf tournaments. Each organization received $4,200. The County has a partnership with United Way, and Bob Hunter, of United Way, said that the match was smaller this year because funds went into the safety net fund.

Commissioner Dearden moved to approve the consent items as presented; Commissioner Bischoff seconded, all voting aye.
F. Action Items:
1. Ratify contract with Acorn Productions for an Antique Show held at the Golden Spike Event Center (GSEC) October 31 - November 2, 2008 - Contract C2008-208
Jim Harvey, GSEC, was not available to present this and the following two items, and the Commission approved them because they were either ratifications or repeat contracts.
2. Ratify contract with Ogden Publishing Corporation for Fall Home & Garden Show held at the Golden Spike Event Show October 23-27, 2008 - Contract C2008-209

Commissioner Bischoff moved to ratify Contract C2008-208 with Acorn Productions for an antique show at the Golden Spike Event Center 10/31-11/2/2008; Commissioner Dearden seconded, all voting aye.
Commissioner Dearden moved to ratify Contract C2008-209 with the Ogden Publishing Corporation for the Fall Home and Garden Show held at the Golden Spike Event Center 10/23-27/2008; Commissioner Bischoff seconded, all voting aye.
3. Contracts with Five Chute Productions for the IMPRA Rodeo Series on the listed dates at the Golden Spike Event Center:

Commissioner Dearden noted that Five Chute was a repeat customer and had a good track record.
Commissioner Bischoff moved to approve the following contracts with Five Chute Productions for the IMPRA Rodeo Series at the Golden Spike Event Center: Contract C2008-210 (11/21-22/2008); Contract C2008-211 (1/23-24/2009); Contract C2008-212 (2/27-28/2009); Contract C2008-213 (3/20-21/2009); Commissioner Dearden seconded, all voting aye.
4. Contract with IHC Health Services (McKay Dee Hospital) for institutional support - Contract C2008-214
Reed Richards, Deputy County Attorney, noted that in 2004 the method of providing medical insurance to the correctional facility had changed. The county contracts with IHC to provide the medical care, which in turn contracts with Dr. John R. Wood and includes Physician Assistant Richard Russell.
Commissioner Dearden moved to approve Contract C2008-214 with IHC Health Services (McKay Dee Hospital) extending institutional support through 9/30/2010; Commissioner Bischoff seconded, all voting aye.
5. Contract with Central Weber Sewer to treat wastewater - Contract C2008-215
Curtis Christensen, County Engineer, stated that a few years ago the county started installing a sewer collection system in the western part of the county. At that time there was no contract with Central Weber Sewer and this formalizes the process whereby Central Weber will treat the wastewater generated from those being served in the unincorporated county. Currently the county pays $7.50/resident/month for that service.
Commissioner Bischoff moved to approve Contract C2008-215 with Central Weber Sewer Improvement District to treat wastewater; Commissioner Dearden seconded, all voting aye.
6. Approval of action taken by WACOG on November 3, 2008 regarding the commitment of Corridor Preservation funds
Douglas Larsen, Transportation Liaison, stated that on 11/3/2008 the Weber Area Council of Governments had unanimously voted to commit $1.5 million in corridor preservation funds to acquire the right-of-ways necessary for the expansion of Riverdale Road between 550 West and Chimes Avenue Drive. This includes a match of an additional $1.5 million from State funds. WACOG is required to obtain approval for this action from the county’s legislative body.
Commissioner Dearden moved to approve the action taken by WACOG on November 3, 2008 regarding the commitment of corridor preservation funds in the amount of $1.5 million; Commissioner Bischoff seconded, all voting aye.
7. Adoption of Safety Policies
Chris Ward, stated that UCIP required adoption of certain safety policies. These include Weber County Slip, Trip, and Fall Prevention Program and will be entered into the Human Resources policy manual. He said that new county employees would receive copies of the policies and eventually there would be a safety manual given to every employee.
Commissioner Bischoff moved to adopt the safety policies; Commissioner Dearden seconded, all voting aye.
G. Public Hearing:
1.Commissioner Dearden moved to adjourn the public meeting and convene the public hearing; Commissioner Bischoff seconded, all voting aye.
2. Public hearing regarding creating an Agriculture Protection Area by Robert D. & C. Bret Roberts, LSNs 21-026-0100, 21-033-0003 & 21-034-0005
Fátima Fernelius, Clerk/Auditor’s Office, stated that the Recorder/Surveyor’s Office and the County Planning Department had reviewed this application. The notice and public hearing were published in the newspaper and notices were also mailed to owners within 1,000 feet of the proposal. The information was then forwarded to the Ogden Valley Planning Commission and the Advisory Board and they had recommended approval. One of the applicants was present.
Commissioner Dearden asked about the Planning Commission’s request that the County Commission and Planning staff consider whether a zoning change from the FV-3 to an AV-3 zone would be appropriate. Sean Wilkinson, County Planning Department, stated that Monette Hurtado, Deputy County Attorney, had wanted the County Commission to discuss it because one of the statutory criteria asked whether property proposed for an APA was in an agricultural zone. Mr. Wilkinson stated that the zoning did not have to be changed, that this was presented simply for discussion since this property was in the FV-3 Zone, although it had been used for agriculture for a long time. Chair Zogmaister invited public comments and none were offered.
Commissioner Dearden moved to adjourn the public hearing and reconvene the public meeting; Commissioner Bischoff seconded, all voting aye.

Commissioner Bischoff moved to grant the Agriculture Protection Area requested by Robert D. & C. Bret Roberts, Land Serial Numbers 21-026-0100, 21-033-0003 and 21-034-0005; Commissioner Dearden seconded, all voting aye.
H. Assign Pledge of Allegiance & Thought of the Day for Tuesday, November 25, 2008, 5:30 p.m. (Public Hearing will begin at 6:00 p.m.)
I. Public Comments:
Representative Neil Hansen said that today was the 14th day after the election and he had not seen notice on the agenda for the Board of Canvassers. Chair Zogmaister stated that the Board of Canvassers was convening after today’s closed executive session.
Closed Executive Session to discuss strategy related to the purchase of real estate
Commissioner Dearden moved to convene a closed executive session to discuss strategy relating to the sale of real estate; Commissioner Bischoff seconded.

Board of County Canvassers for the 2008 General Election
Alan McEwan, County Clerk/Auditor, presented the final results of the November 4, 2008 election, noting the document before the board that listed all the races and percentages, which included all provisional ballots and absentee ballots. Mr. McEwan thanked everyone for their hard work and long hours during the election process. He addressed the board’s question stating that this election probably had the highest voter turnout.
Commissioner Dearden moved to certify the board of canvass for the 2008 General Election held on November 4, 2008; Commissioner Bischoff seconded, all voting aye.
