MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, August 26, 2008 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Craig L. Dearden, Vice Chair; and Kenneth A. Bischoff. Jan M. Zogmaister, Chair, was excused.

Others Present: David C. Wilson, Deputy County Attorney; Roger Brunker, Clerk/Auditor’s Office; Fátima Fernelius, Clerk/Auditor’s Office, took minutes.

D. Consent Items:
1. Purchase orders in the amount of $450,404.05
2. Warrants #240832-241050 in the amount of $1,984,774.21
3. Minutes for the meeting held on August 19, 2008
4. New business license
5. Surplus a 2004 F-250 truck from the Weber/Morgan Health Department
Commissioner Bischoff moved to approve the consent items, holding the minutes; Commissioner Dearden seconded, both voting aye.


E. Action Items:

1. Real Estate Sales Agreement for Parcel #12-019-0015 - Contract C2008-180

Nate Pierce, County Operations Department Director, stated that this property had been declared surplus on 7/22/2008. Weber County received this non-buildable parcel through a tax sale in 1990. It is adjacent to property owned by George and Tiffany Bray, who desire to purchase it.
Commissioner Bischoff moved to approve Contract C2008-180, Real Estate Sales Agreement for LSN 12-019-0015; Commissioner Dearden seconded, both voting aye.

F. Public Hearing:
1.Commissioner Bischoff moved to adjourn the public meeting and convene the public hearing; Commissioner Dearden seconded, all voting aye.

2. Public hearing regarding a request to vacate the Ward Acres Subdivision, Phase 3

Ben Hatfield, County Planning Department, stated that Tony Ward wanted to vacate Ward Acres Subdivision, Phase 3. An amendment to this subdivision was approved on 3/18/2008 (to shorten the cul de sac) and today’s action was to vacate the original subdivision. Commissioner Dearden invited public comments and none were offered. A portion of the road will be vacated on September 23, 2008.

3.Commissioner Bischoff moved to adjourn the public hearing and reconvene the public meeting; Commissioner Dearden seconded, both voting aye.

4. Action on public hearing:

F.2. - Vacate the Ward Acres Subdivision, Phase 3 - Ordinance 2008-30
Commissioner Bischoff moved to adopt Ordinance 2008-30 vacating the Ward Acres Subdivision, Phase 3; Commissioner Dearden seconded.
