MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, July 29, 2008 - 5:30 p.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.Commissioners Present: Jan M. Zogmaister, Chair, and Craig L. Dearden. Kenneth A. Bischoff was excused.

D. Presentation on a three-day clean-up in Western Weber County
Iris Hennon, County Planning Department and County Code Enforcement Officer, presented a case that she had worked on under the junk ordinance. She had received an anonymous call in 2003 to check out a property in unincorporated Weber County in the Roy area. In discussing the issue with the property owners she found them hesitant to remove the debris and they even suggested moving the junk to their other properties–they have three in unincorporated Weber County, belonging to multiple owners–and Ms. Hennon discouraged this. She pointed out major concerns relating to health and safety issues with the huge amount of junk (including over 13,000 tires) and wild animals living there. She outlined the entire laborious process that had taken until now to finalize. There had been countless efforts made to try to get the property owners to cleaned up, including several Justice and District Court hearings and always there had been non-compliance. Finally, the judge ordered the county to clean up the property at will, which took three full days and two half days at a cost of $15,222 but with a grant allowing salvaging some scrap metal the total was $11,588.32. The property is for sale and when it sells the county can recoup the $11,588.32. Chair Zogmaister expressed thanks to all who worked on this item.

Commissioner Dearden moved to approve the consent items; Chair Zogmaister seconded, both voting aye.
F. Action Items:
1. Final approval of the Knight’s Farm 1st Amendment Subdivision (1 lot)
Ben Hatfield, County Planning Department, noted that this subdivision was located at 5351 W. 1600 S. Next week the vacation of the original Knight’s Farm Subdivision will be handled. The petitioners needed to increase the rear of the lot to meet setbacks required by an addition to their home which required an amended subdivision plat.
Mr. Hatfield stated that the owners agreed to run a covenant with the land on 4/7/2008. This subdivision was administratively approved by the Planning Division Director on 4/25/2008 after no response had been received to notices sent to area property owners. No new improvements were required for this item. Commissioner Dearden asked for some clarification and Mr. Hatfield showed on the new subdivision plat where the petitioner was adding approximately 150 ft.
Commissioner Dearden moved to grant final approval of the Knight’s Farm 1st Amendment Subdivision (1 lot); Chair Zogmaister seconded, both voting aye.
2. Vacation of the Knight’s Farm Subdivision
This item was not handled today.
3. Resolution of the Board of Commissioners of Weber County appointing two members to the Ogden Valley Planning Commission - Resolution 16-2008
Rob Scott, County Planning Department Director, stated that vacancies had been advertised for the Ogden Valley Planning Commission and seven applications had been received–two from existing members. These are for 4-year terms through May 4, 2012. Chair Zogmaister expressed thanks to those who had served and to the applicants as well.
Commissioner Dearden moved to adopt resolution 16-2008 reappointing Jim Banks and appointing Kevin Parson to the Ogden Valley Planning Commission for 4-year terms through 5/4/2012; Chair Zogmaister seconded.

G. Public Hearings (will begin at 6:00 p.m.):

2. Public hearing to consider changing the name of a street in The Highlands at Wolf Creek Phase 1 from 3850 North Street to Powder Ridge Circle
Scott Mendoza, County Planning Department, showed area maps and stated that in April 2008 Wolf Creek residents had asked the street name change, and subsequently County Planning and the Recorder/Surveyor had received that request. A Wolf Creek representative was present tonight. The Recorder/Surveyor’s office had sent individual notices to each land owner and no response had been received. Chair Zogmaister wanted to ensure the Post Office was notified because in the past they had not recognized an address. Mr. Mendoza explained the address change process and noted that the County GIS Department would be notified as well as Tammy Weiss, who was in charge of the Emergency 911 Services. Chair Zogmaister invited public comments and none were offered.
3. Public Hearing to consider Zoning Petition #08-2007 by Weber County Planning Division to amend the Zoning Ordinance, Agricultural Chapters 5, 5B, 6 & 7 (A-1, AV-3, A-2 & A-3 respectively) by clarifying language, changing an existing permitted use to a conditional use & completely eliminating an existing conditional use
This item needed to be re-noticed.
4.Commissioner Dearden moved to adjourn the public hearings and reconvene the public meeting; Chair Zogmaister seconded, both voting aye.

G.2. - Changing a the street name in The Highlands at Wolf Creek Phase 1 - Ordinance 2008-27
Commissioner Dearden moved to adopt Ordinance 2008-27 changing the street name in The Highlands at Wolf Creek Phase 1 from 3850 North Street to Powder Ridge Circle; Chair Zogmaister seconded.
