OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, July 1, 2008 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. 4. Set public hearing for July 22, 2008, 10 a.m., regarding the vacation of a public utility easement on lot 26 of Allen Estates Subdivision Phase 2
5. Set public hearing for July 29, 2008, 6 p.m., to consider Zoning Petition #08-2007 by the Weber County Planning Division to amend Agricultural Chapters 5, 5B, 6 and 7 (A-1, AV-3, A-2 and A-3 respectively)

Commissioner Dearden moved to approve the consent items; Commissioner Bischoff seconded, all voting aye.
F. Action Items:
1. Resolution appointing a representative to serve on the Development Review Committee which acts as an advisory committee to the Military Installation Development Authority (MIDA) - Resolution 12-2008
Chair Zogmaister presented this item. Weber and Davis counties share a common interest in the economic development of Falcon Hill and the counties have the ability and resources to provide certain support to Falcon Hill. MIDA has authority to provide for the development of military land and the U.S. Air Force and Sunset Ridge Development Partners, LLC (the prospective developer of Falcon Hill) are both requesting MIDA to exercise its authority to provide for the development of Falcon Hill at Hill Air Force Base. MIDA has authorized the formation of the Development Review Committee to advise MIDA on local issues and coordinate plans with local governments and private businesses. Mr. Kusina has been working closely with MIDA.
Commissioner Bischoff moved to adopt Resolution 12-2008 appointing Ron Kusina, Weber County Economic Development Director, to serve on the Development Review Committee, which acts as an advisory committee to the Military Installation Development Authority; Commissioner Dearden seconded.

2. Agreement with Sinclair Services Company for use of the Sinclair Internet Connections at Snow Basin for GPS Broadcast Station - Contract C2008-163
Ernest Rowley, County Recorder/Surveyor, noted that the county had a GPS broadcasting station on the mountain top near the Strawberry lift for Snow Basin Ski Resort. Recently Snow Basin installed an internet connection to that lift site and the advance in technology in GPS communications will help in maintaining continuous communication between the county’s computer station in the Weber Center and this GPS station. Sinclair Oil requested that the county sign confidentiality and security agreements with them that essentially state that any access to their systems is protected. In regards to this station, Mr. Rowley noted that Snow Basin Ski Resort had done a lot of work at no charge to the county. Leonard Call, County Information Technology Director, had signed this agreement.
Commissioner Dearden moved to approve Contract C2008-163 with Weber County and Sinclair Services Company for use of the Sinclair internet connections at Snow Basin for a GPS Broadcast Station; Commissioner Bischoff seconded, all voting aye.
3. First reading of an Ordinance Creating a Finance Committee
Dan Olsen, County Comptroller, stated that this ordinance established the parameters for the Finance Committee. He believed this committee had always existed, however, not formally. The committee will analyze proposed debt issuance for financial viability for debt over $1 million and review requests for issuance of conduit debt. It will be comprised of the County Commission Chair, Clerk/Auditor, Treasurer, Chief Civil attorney, and the County Comptroller. Commissioner Bischoff and Commissioner Dearden noted minor inconsistencies in the membership section of the ordinance.
Commissioner Bischoff moved to approve the first reading of an ordinance creating a Finance Committee; Commissioner Dearden seconded, all voting aye.
4. Agreement with Dr. Joan Balcombe, MD, for a Physician Advisor for paramedic programs - Contract C2008-164
David Wilson, County Deputy Attorney, presented this contract with a 3-year term in the amount of $30,000/year. Commissioner Bischoff asked if the contract amount was set per year at $30,000 and Mr. Wilson responded that was correct.
Commissioner Dearden moved to approve Contract C2008-164 with Dr. Joan Balcombe, MD, for a Physician Advisor for paramedic programs; Commissioner Bischoff seconded, all voting aye.
G. Public Hearing:
1.Commissioner Bischoff moved to adjourn the public meeting and convene the public hearing; Commissioner Dearden seconded, all voting aye.
2. Public Hearing to consider rezoning 4.65 acres from Forest FV-3 to Forest Residential FR-3
Jim Gentry, Weber County Planning Department, showed an area map and a concept plan of this property located at 3850 N. 3200 E. for a 16 unit P.R.U.D. The petitioner is willing to place an open space easement on a 113-acre parcel adjacent to the property in exchange for the rezoning. The Planning Commission unanimously recommended approval of this item. Mr. Gentry addressed the commissioners’ questions relating to road width and the amount of developable land in the open space easement. Legal counsel and the Surveyor’s office had reviewed the ordinance. Chair Zogmaister invited public comments and none were offered.
3.Commissioner Dearden moved to adjourn the public hearing and reconvene the public meeting; Commissioner Bischoff seconded, all voting aye.
4. Action on public hearing:
G.2.-Hearing to consider rezoning 4.65 acres from FV-3 to FR-3 - Ordinance 2008-21
Because this rezoning conformed to the Ogden Valley General Plan and did not increase the density, Commissioner Bischoff moved to adopt Ordinance 2008-21 rezoning property at approximately 3850 N. 3200 East from Forest Valley FV-3 to Forest Residential FR-3; Commissioner Dearden seconded.
