MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, May 27, 2008 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. D. Presentations:
1. Presentation of the Proclamation for the Relay for Life
Commissioner Dearden read the Weber County Commission’s proclamation naming June 2008 as American Cancer Society’s “Relay for Life” month. The relay occurs annually at Weber State University.
2. Presentation from the Weber Robotics Team
Jill Anderson introduced three students that were part of a team of ten Weber High School Students (which were part of a larger, international organization known as FIRST -For Inspiration and Recognition of Science and Technology) that promoted the idea of fair competition, professionalism and teamwork while paving the way for science and engineering-minded students to achieve success in the field of technology. Ms. Anderson stated that these students had competed in Las Vegas and their robot had placed second. She asked for community support to raise awareness in robotics and to raise money and noted what some cities were doing to help in this process. She asked the Commission to allow the students to have a booth at the Weber County Fair and to waive the booth fee. The Commission will speak with the Fair Director.
E. Consent Items:

Commissioner Bischoff moved to approve the consent items; Commissioner Dearden seconded, all voting aye.
F. Action Items:
1. Consideration to approve an extension request for Tax Sales Properties
Roger Brunker, Clerk/Auditor’s Office, stated that no action was needed now on this item because as of this morning the taxes had been paid.
2. Discussion andor action on consideration of secondary water issues for Allen Estates Subdivision Phase 1 & 2
Brett Wyont, of Taylor, a property owner in this subdivision, expressed concerns relating to not having secondary water. Property owners had purchased their lots with secondary water but still did not have it after three years. He described how this affected their property values, the problems of living in a dust bowl and how their indoor plumbing was adversely affected by the two houses that were using culinary water to water their yards.
Despite property owners meeting with Hooper Irrigation, Taylor West-Weber Water and other organizations there had been no resolution. Property owners had asked that the developer’s bond not be released in July but the developer had put the secondary irrigation lines in the ground and this constituted his bond being met. Property owners had a timeline to put in their yards and their only alternative at this point was to pay the culinary water fee to Hooper Water to hook up their sprinkler systems. Mr. Wyont had heard they might have to wait until up to 300 homes were built in the area before Hooper would build the secondary water pump, and it might be 12-36 months before they got secondary water. Chair Zogmaister said that the Commission did not have authority in this issue. Her understanding from the information in her packet was that Hooper Irrigation had spoken with Weber Basin Water, which had agreed to service this subdivision on a temporary/permanent basis using culinary water. Mr. Wyont said that the property owners would have to pay an increased fee for the culinary water. Hooper Irrigation had been paid approximately $70,000 of connection fees from homeowners but was reluctant to release those funds to Weber Basin Water and Weber Basin would not hook into their secondary water unless they paid all new connection fees (about $2,800/house). Monette Hurtado, Deputy County Attorney, reiterated that the county does not enforce CC&Rs and homeowners would probably need to seek legal counsel.
3. Real Estate Purchase and Sale Agreement for the property adjacent to the Weber County Correctional Facility - Contract C2008-144
Nate Pierce, Operations Department Director, showed an area map and stated that the county had been negotiating with Mr. Jones of Seven J Leasing to purchase this parcel (4.1503+ acres) adjacent to the Weber County Correctional Facility. The purchase price, determined through an appraisal, was $1,070,000.00. Commissioner Dearden believed that the purchase price was to be $1 million and Mr. Pierce said that the actual cost to the county would be $1 million and, although not written in the contract, Mr. Jones had verbally said that he was willing to donate $70,000 back to the Sheriff’s Foundation. There had also been some boundary disputes that reduced the overall acreage. The property will be used primarily by the Sheriff’s Department for storage.
Commissioner Dearden moved to approve Contract C2008-144, Real Estate Purchase and Sale Agreement for property adjacent to the Weber County Correctional Facility, with Seven J Leasing, LLC., Dennis R. and Janet W. Jones/Trustees in the Jones Family Trust; Commissioner Bischoff seconded, all voting aye.
G. Assign Pledge of Allegiance & Thought of the Day for Tuesday, June 3, 2008, 10 a.m.
