OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, July 31, 2007 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. D. Consent Items:
1. Purchase orders in the amount of $399,488.79

Commissioner Zogmaister moved to approve the consent items as presented; Commissioner Dearden seconded, all voting aye.
E. Presentation of the Seal of Service Award to Deputy Larry Buck
Commissioner Dearden read the seal of service nomination submitted by Deputy Buck’s co-worker which spoke to his tireless efforts in his assignment of serving civil bench warrants. The commissioners thanked Deputy Buck for all his hard work and Deputy Buck simply stated he was doing his job. He received a plaque, $100 and a seal of service pin.
F. Action Items:
1. Ratify Interlocal Agreement by/among Weber County, Ogden City and Roy City for the purpose of distributing JAG Funds - Contract C2007-192
Weber County Sheriff Brad Slater stated that this was a joint Justice Assistance Grant. Without claiming disparate treatment, Weber County and Roy City had lost those funds. A couple of years ago, the county claimed disparate treatment as a prosecuting authority and a detention authority in Ogden. Ogden City administers the program and makes allocations for specific purposes.
Commissioner Dearden moved to approve Contract C2007-192 ratifying an Interlocal Agreement by and among Weber County, Ogden City and Roy City for the purpose of distributing JAG Funds; Commissioner Zogmaister seconded, all voting aye.
2. Contract with Ogden City for Justice Court Security Services - Contract C2007-193
Weber County Sheriff Brad Slater stated that Weber County started providing court security services to the Ogden City Justice Court last year. Their security needs had increased, thus the hourly cost had increased.
Commissioner Dearden moved to approve Contract C2007-193 by/between Weber County and Ogden City for Justice Court security services; Commissioner Zogmaister seconded, all voting aye.
3. Resolution of Weber County Commission approving execution/delivery of a fourth amendment to master lease agreement between County & Municipal Building Authority of Weber County; authorizing issuance/sale by Authority of its Lease Revenue Refunding Bonds, Series 2007 in the aggregate principal amount of approximately $26,523,000; & related matters - Resolution 43-2007
Alan Westenskow, of Zions Bank Public Finance, county financial advisor, stated that they had been looking for the opportunity to refinance the bonds originally issued in 1994 and refinanced in 1997 and used to construct the Ogden Eccles Conference Center and the Weber Center.
About $26.5 million of those bonds were still outstanding and could be refinanced in 12/15/2007 The market has been favorable and seven bids were received. In May 2007 a bid from Banc of America had an excellent interest rate and they had also agreed to hold that rate until the bonds could be refinanced. This action today authorizes the MBA to enter into a bond Purchase Agreement finalizing the terms and officially locking in those rates. The bonds mature in 2019. The net present value savings is about $2.1 million. The county has received an upgrade of its General Obligation rating from A1 to AA3 and on the Municipal Building Authority bonds a rating upgrade from A2 to A1.
Commissioner Dearden moved to adopt Resolution 43-2007 authorizing and approving the execution and delivery of a fourth amendment to the Master Lease Agreement, by/between Weber County and the Municipal Building Authority of Weber County (the “Authority”); authorizing the issuance and sale by the Authority of its Lease Revenue Refunding Bonds, series 2007 in the aggregate principal amount of approximately $26,523,000; and related matters; Commissioner Zogmaister seconded.

4. Resolution appointing Marcia Harris to the Weber County Library Board of Trustees - Resolution 44-2007
Commissioner Zogmaister stated that Ms. Harris had been very active on this board, which had recommended that she be appointed to serve a second term.
Commissioner Zogmaister moved to adopt Resolution 44-2007 appointing Marcia Harris to the Weber County Library Board of Trustees; Commissioner Dearden seconded.

5. Contract with Siemens Building Technologies, Inc. - Contract C2007-194
Doug Dickens, Operations Department, stated that this was another step in the county’s efforts related to energy savings on county-owned buildings. A few months ago Utility Cost Management Consultants conducted an audit of the county’s utility bills and their recommendations had substantially saved the county money. Siemens will perform a technical audit of county-owned buildings to determine energy savings potential in mechanical operations and they guarantee a certain amount of savings every year from implementation of its recommendations.
If the county takes no action on Siemens’ report or implements their recommendations on a piece-by-piece basis, the county will pay them $85,000 but if the necessary upgrades are performed, the county can pay the $85,000 out of energy savings over the next 3-5 years (time period yet to be determined). Mr. Dickens and Dan Olsen, County Comptroller addressed the commissioners’ general questions.
Commissioner Dearden moved to approve Contract C2007-194, Project Development Agreement by and between Weber County and Siemens Building Technologies, Inc; Commissioner Zogmaister seconded, all voting aye.
6. Amendment to CDBG contract for Fairgrounds door hardware - Contract C2007-195
Dennis Richardson, Engineering Department, noted that last year the county had entered into a multi-year contract with the Department of Community Development for CDBG funds and this was an amendment for the second year of this project to provide an additional $52,580.
Commissioner Zogmaister moved to approve Contract C2007-195, amendment to the CDBG contract for Fairgrounds door hardware; Commissioner Dearden seconded, all voting aye.
7. Amendment to CDBG contracts for Housing Authority housing rehabilitation projects - Contract C2007-196
Dennis Richardson, Engineering Department, stated that this contract added another year to the project and $20,577 to the Housing Authority for housing repairs.
Commissioner Dearden moved to approve Contract C2007-196, amendment to the CDBG contract for the Housing Authority housing rehabilitation projects; Commissioner Zogmaister seconded, all voting aye.
8. Contracts with Wheeler Machinery for lubrication & maintenance - Contracts C2007-197 - C2007-200
Gary Laird, County Solid Waste Management Manager, presented these equipment lubrication and maintenance contracts.
Commissioner Dearden moved to approve these 2-year or 8 services lubrication and maintenance Contracts by/between Weber County and Wheeler Machinery: C2007-197 (CAT 950F front end loader, $7,245.00), C2007-198 (CAT 950H, $7,245.00), C2007-199 (Duratech HD12 grinder, $7,380.20), and C2007-200 (CAT 966F, $7,455.00); Commissioner Zogmaister seconded, all voting aye.
9. Discussion/action on the Municipal Wastewater Planning Program Annual Report - Resolution 45-2007
Chad Meyerhoffer, County Engineering Department, stated that this program with the State allowed the county to identify and solve potential wastewater problems before they became serious or costly. Completing the State’s forms gave additional points on the Utah Wastewater Project Priority List/System, the results were used to focus the State’s technical assistance programs, and the operator completing the forms would be given operational continuing educational units for each form returned.
Commissioner Dearden moved to adopt Resolution 45-2007, Municipal Wastewater Planning Program; Commissioner Zogmaister seconded.

10. Contract with Rich and Stacie Layton for cage fighting at the 2007 Weber County Fair - Contract C2007-201
Jan Wilson, Weber County Fair, presented this contract, in the amount was $25,000.00, stating it was for a new event at the Weber County Fair to be held in the outdoor stadium. Commissioner Zogmaister commented that this was not a family-friendly event. Ms. Wilson said that annually after each Fair an evaluation was conducted and it was noted that young adult attendance was lacking and this event seemed to be popular among college students/young adults. She added that the event was more martial arts than ultimate fighting, it would be ticketed in order to be more secure for children, and there would be referees and medical staff on hand.
Commissioner Dearden moved to approve Contract C2007-201 contract by/between Weber County and Rich and Stacie Layton for cage fighting at the 2007 Weber County Fair; Commissioner Zogmaister seconded, all voting aye.
11. agreement with the Weber Cultural Legacy Foundation relating to development, promotion & operation of significant athletic events in Weber County including but not limited to the Ogden Marathon, Xterra Mountain Championships, Mountain to Metro Games and the Xterra Winter World Championships - Contract C2007-202
Commissioner Dearden stated that this agreement with the GOAL foundation was to promote different events in the county. He noted that Xterra was a world-wide event and their representatives had been impressed with our area and wanted to hold it here. The events bring in about 11,000 people to the community. GOAL will facilitate these events and the county is contracting with them for $30,000 to come from Tourism funds.
Commissioner Zogmaister moved to approve Contract C2007-202, agreement by/between Weber County and the Weber Cultural Legacy Foundation relating to the development, promotion and operation of significant athletic events in Weber County including but not limited to the Ogden Marathon, Xterra Mountain Championships, Mountain to Metro Games and the Xterra Winter World Championships; Commissioner Dearden seconded, all voting aye.
