OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, February 26, 2008 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. Chair Zogmaister read the nomination submitted by Nila Dayton, County Treasurer. The Commission gave Mr. Slater a Seal of Service pin, a plaque and $100 for his excellent customer service.
E. Consent Items:

7. Request to sign boundary agreements effecting sales taxes from certain businesses being collected by the Utah State Tax Commission in the unincorporated areas of Weber County
Commissioner Bischoff moved to approve the consent items; Commissioner Dearden seconded, all voting aye.
F. Action Items:
1. Contract with Utah State University for extension education work - Contract C2008-31
Jerry Goodspeed, Utah State University Extension, stated that this was the standard annual contract renewal and the only change was in the amount, which decreased.
Commissioner Dearden moved to approve contract C2008-31 between Weber County and the Utah State University for extension education work; Commissioner Bischoff seconded, all voting aye.
2. Final approval of Eden Lake Meadows I Subdivision, 6 lots, located at approximately 1550 North & 5900 East (String Town Road), and a 506,103.68 financial guarantee
Scott Mendoza, County Planning Department, stated that this item and the next were related. Generally, subdivisions with a half width of a right-of-way were not approved, but had been approved in this case because the two subdivisions were right next to each other and each one had dedicated about 25 ft. out of the boundary towards a 50 ft. wide right-of-way for the private road.
This subdivision consists of 39.81 acres, with a 3.0 acre parcel of common area, and just over 1.1 miles of private road. Variations in the subdivision included that the road within the subdivision was private, the asphalt width was 24 ft. wide, and the entry on String Town Road was gated. The Ogden Valley Planning Commission had unanimously recommended approval of this item.
Commissioner Bischoff moved to grant final approval of Eden Lake Meadows I Subdivision, 6 lots, located at approximately 1550 North & 5900 East (String Town Road), with a $506,103.68 financial guarantee; Commissioner Dearden seconded, all voting aye.
3. Final approval of Hidden Haven Estates Subdivision Lot 3,1st Amendment located at approximately 1600 North & 6200 East. (The subdivision will consist of 4 lots and will not include a financial guarantee.)
(See above item.) Scott Mendoza, County Planning Department, stated that this subdivision consisted of 14.22 acres and the length of private road dedicated out of this subdivision was approximately 550 ft. Because of a private agreement between Eden Lake Meadows I and this subdivision, there would be no financial guarantee as part of this item. The Ogden Valley Planning Commission had unanimously recommended approval of this item. Commissioner Dearden noted that this property owner and the owner of the preceding item were giving half of the right-of-way and he wanted to ensure that this was in writing. Mr. Mendoza reiterated that there was a private agreement between four separate owners but the three involved with the private road agreement had a separate contract. He believed that Eden Lake Meadows I and other adjacent properties would participate in the cost as they developed and that agreement would be recorded.
Commissioner Dearden moved to grant final approval of Hidden Haven Estates Subdivision Lot 3,1st Amendment located at approximately 1600 North & 6200 East; Commissioner Bischoff seconded, all voting aye.
4. Contract with Wheeler Machinery for a 2008 Lubrication and Maintenance Agreement for the CAT 966G - Contract C2008-32
Gary Laird, Weber County Solid Waste Administrator, presented this standard maintenance agreement. The contract amount was $8,373.20.
Commissioner Bischoff moved to approve contract C2008-32 by/between Weber County and Wheeler Machinery for a 2008 Lubrication and Maintenance Agreement for the CAT 966G; Commissioner Dearden seconded, all voting aye.
5. Contract with Animal Specialties to have animal exhibits and a petting zoo for the 2008 Weber County Fair - Contract C2008-33
Stacy Skeen, County Fair, presented this contract in the amount of $4,000.
Commissioner Dearden moved to approve contract C2008-33 by/between Weber County and Animal Specialties to have animal exhibits and a petting zoo for the 2008 Weber County Fair; Commissioner Bischoff seconded, all voting aye.
6. Ratify a contract with Acorn Productions for an Antique Show held at the Golden Spike Event Center on February 16-17, 2008 - Contract C2008-34
Jim Harvey, GSEC, presented this contract.
Commissioner Bischoff moved to ratify Contract C2008-34 by/between Weber County and Acorn Productions for an antique show held at the Golden Spike Event Center on February 16-17, 2008; Commissioner Dearden seconded, all voting aye.
7. Contract with Ogden Publishing for the Spring and Garden Show to be held at the Golden Spike Event Center on February 29-March 2, 2008 - Contract C2008-35

8. Agreement with Ogden Eccles Conference Center to hold the Miss Weber County Pageant on February 29, 2008 - Contract C2008-36

G. Public Hearing:
Commissioner Dearden moved to adjourn the public meeting and convene the public hearing; Commissioner Bischoff seconded, all voting aye. 1.

Public hearing regarding amendments to Zoning Ordinance by adding “Small Wind Energy” as a conditional use in the RE-20, A-1, A-2, A-3 &AV-3 Zones (Chapter 3, 5, 5-B, 6, &7); amending Chapter 23, Supplementary and Qualifying Regulations, by adding Section 38, Wind Energy Conversion Systems (Small Wind Energy Systems), &by changing portions of Section 25,Towers; &amending Chapter 1, General Provisions, Section 6, Definitions, by adding definition for “Small Wind Energy System”& “Wind Turbine”
Sean Wilkinson, County Planning Department, stated that the current county ordinance briefly mentioned small wind energy systems and was difficult to interpret, thus Section 38 was added to deal specifically with small wind energy systems. Other amendments to the ordinance included the addition of definitions and the use of small wind energy systems as conditional uses in the RE-20, A-1, A-2, A-3 and AV-3 zones. The ordinance addresses such things as minimum lot size for these systems, tower height, setbacks, and safety regulations. The Ogden Valley Township Planning Commission had recommended the maximum height of a small wind energy system, including tower and blades, not to exceed 70 ft., and small wind energy systems over 70 ft. to seek approval from the Planning Commission as part of the conditional use permit. Mr. Wilkinson addressed the commissioners’ questions including what was considered a “small” system. Kyle Hartman, petitioner, addressed the question of having one system for several homes stating that the amount of energy produced by one system would not be sufficient because a system produced about 400-800 kilowatts/month and a typical home used about 800+ killowatts. Additionally, on an utility grid-tied home a system would supplement the power bill and the user would have to sign an agreement with Rocky Mountain Power. Chair Zogmaister invited public comments and none were offered.
Commissioner Bischoff moved to adjourn the public hearing and reconvene the public meeting; Commissioner Dearden seconded, all voting aye. 3.
