OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Thursday, December 27, 2007 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.Commissioners Present: Kenneth A. Bischoff, Chair; Craig L. Dearden. Jan M. Zogmaister was excused.

Ernest Rowley, Recorder/Surveyor, read the nomination submitted by Ms. Kilts’ peers. The Commission presented her with a Seal of Service pin, a plaque and $100 for her excellent customer service.
E. Consent Items:
1. Purchase orders in the amount of $224,169.28
2. Warrants #232699 - #232857 in the amount of $672,363.75
3. Minutes for the Special Meeting held on December 11, 2007 and regular Commission meetings held on December 11 and 18, 2007

Commissioner Dearden moved to approve the consent items; Chair Bischoff seconded, both voting aye.
F. Action Items:
1. Appointment of Commission Chair and Vice Chair for 2008
Commissioner Dearden moved to appoint Commissioner Zogmaister as Chair and Commissioner Dearden as Vice Chair for 2008, effective 1/1/2008; Chair Bischoff seconded, both voting aye.
2. Final approval of Green Hill Country Estates Phase No. 6 Lot 96 1st Amendment located at 1211 N. Maple Drive
Sean Wilkinson, County Planning Department, stated that this amendment to lot 96 changed the location of the buildable area that was shown on the original subdivision plat. The Planning Commission recommended final approval on 9/25/2007.
Commissioner Dearden moved to grant final approval of Green Hill Country Estates Phase No. 6 Lot 96 1st Amendment; Chair Bischoff seconded, both voting aye.
3. Request for Approval of amendments to the Weber County Sick Leave Policy
This item was held pending resolution of certain terms of the proposed policy raised by the commissioners.
4. Approve and forward to the Morgan County Council the nomination of Kim Dohrer for re-appointment to the Weber Human Services Board of Directors
David Wilson, Deputy County Attorney, noted that Kim Dohrer had been appointed to this board last year beginning January 1 to fill a vacancy on the Board which would be for one year only. Weber Human Services Advisory Council had recommended Ms. Dohrer’s reappointment for a new four year term. That recommendation was approved by the Weber Human Services Board and forwarded to the Commission for consideration. If the Weber County Commission approves, it would forward the proposed appointment to the Morgan County Council for approval. Upon Morgan’s approval, the Weber County Commission would finalize the appointment and give notice to the chair of the Weber Human Services Board.
Commissioner Dearden moved to approve and forward to the Morgan County Council the nomination of Kim Dohrer for re-appointment to the Weber Human Services Board of Directors; Chair Bischoff seconded, both voting aye.
5. Action to rescind a recorded parcel combination form
Ernest Rowley, County Recorder/Surveyor, said that shortly after the combination of Land Serial Number 22-010-0032 (22-010-0030), there had been a quit claim deed and a warranty deed recorded. A problem occurred when the property was deeded and the property owner had unknowingly used a legal description that went around the entire property and currently on the county’s plat the property was shown without any division. In this case there was not enough land for the property owner to subdivide these properties. The property owner, Delbert H. Bishop, had believed that at any time he combined the properties for tax purposes he could request that the county undo that action, and he was now making the request to reinstate the prior parcel configuration.
Mr. Rowley said that the county was currently drafting an ordinance to allow reinstating prior parcel configurations with certain conditions. Individuals who had consolidated properties for tax purposes, would be able to reinstate or rescind the consolidation and still maintain legal or non-conforming status. The ordinance would give staff the ability to make those decisions and the issues would not need to come before the Commission. He showed the County Recorder’s record for the year ending in 1991 showing the configuration of the subject parcels, at which time they were legal non-conforming parcels. David Wilson, Deputy County Attorney, stated that this issue had been discussed extensively by his office and that this item could be approved today and when the ordinance came through it would essentially ratify the action.
Commissioner Dearden moved to approve the request to reinstate prior parcel configuration as presented; Chair Bischoff seconded, both voting aye.
G. Public Hearing:
1. Commissioner Dearden moved to adjourn the public meeting and convene the public hearing; Chair Bischoff seconded, both voting aye.
2. Public hearing to open 2007 Budget for amendments
Dan Olsen, County Comptroller, gave the highlights to the 2007 budget adjustments including eliminating the Judicial Services Department, transferring $3.5 million from the General Fund to the Fleet Management Fund (to retire the Interfund Loan that had been outstanding), a $4 million increase to the Health Department (of which $3.4 million was related to a change implemented last year) relating to WIC voucher commodities and vaccines, and adjustments to the Transfer Station because the revenues and costs had been higher than originally budgeted. Chair Bischoff invited public comments and none were offered.
3. Commissioner Dearden moved to adjourn the public hearing and reconvene the public meeting; Chair Bischoff seconded, both voting aye.

G.2. - Public hearing on 2007 Budget amendments - Resolution 54-2007
Commissioner Dearden moved to adopt Resolution 54-2007 making adjustments to the 2007 Weber County budget; Chair Bischoff seconded.
