MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, February 12, 2008 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.Commissioners Present: Jan M. Zogmaister, Chair; Craig L. Dearden; and Kenneth A. Bischoff.

Others Present: Alan D. McEwan, Clerk/Auditor; David C. Wilson, Deputy County Attorney; Fátima Fernelius, Clerk/Auditor’s Office, took minutes.

D. Consent Items:
1. Purchase orders in the amount of $309,090.34
2. Warrants #234073 - #234521 in the amount of $438,004.87
3. Minutes for the meeting held on February 5, 2008
4. Set public hearing for March 4, 2008, 10 a.m., to consider Zoning Petition #02-2007 by Weber County to amend Weber County Zoning Ordinance, Chapter 1, General Provisions (Definitions)
5. Surplus a 2000 washing machine from the Weber County Animal Services
Commissioner Dearden moved to approve the consent items; Commissioner Bischoff seconded, all voting aye.

E. Action Items:

1. Contract with Schoeppner Shows to have the carnival at the 2008 Weber County Fair - Contract C2008-30

Jan Wilson, Weber County Fair, presented this contract stating that Schoeppner would pay the county 25% of the advance sales and 20% of onsite ride ticket gross sales.
Commissioner Bischoff moved to approve Contract C2008-30 by/between Weber County and Schoeppner Shows for the carnival at the 2008 Weber County Fair; Commissioner Dearden seconded, all voting aye.

F. Public Hearing:

1. Commissioner Bischoff moved to adjourn the public meeting and convene the public hearing; Commissioner Dearden seconded, all voting aye.

2. Public hearing to amend Chapter 28, Nonconforming Buildings, Uses and Parcels

Jim Gentry, County Planning Department Director, stated that these amendments were to clarify certain terms and their application to the Zoning Ordinance. Both the Ogden Valley and the Western Weber County Township Planning Commissions had unanimously recommended approval of the proposed amendments. Chair Zogmaister invited public comments and none were offered.

3. Commissioner Bischoff moved to adjourn the public meeting and reconvene the public hearing; Commissioner Dearden seconded, all voting aye.

4. Action on public hearing:

F.2.-Public hearing to amend Chapter 28, Nonconforming Buildings, Uses &Parcels - Ordinance 2008-7
Commissioner Bischoff moved to adopt Ordinance 2008-7 amending the Weber County Zoning Ordinance, Chapter 28, Non-conforming Buildings, Uses and Parcels; Commissioner Dearden seconded.

G. Canvass of Elections held on February 5, 2008

This item was recessed until noon today at which time the three Commissioners convened as the Weber County Board of Canvassers. Alan D. McEwan, Clerk/Auditor, presented the results and the board approved them.
