MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, November 27, 2007 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.Commissioners Present: Jan M. Zogmaister, Vice Chair; and Craig L. Dearden. Kenneth A. Bischoff, Chair, was excused and Commissioner Zogmaister conducted the meeting.

D. Consent Items:
1. Purchase orders in the amount of $47,639.71

Commissioner Dearden moved to approve the consent items as presented; Commissioner Zogmaister seconded, both voting aye.
E. Action Items:
1. Approval of the Weber County Volunteer Policy
Brad Dee, Human Resources Director, presented this policy which resulted from a training meeting he had attended where there had been discussion about recent court cases relating to the administration of policies concerning volunteers and whether they were considered employees of the entity or not. This policy outlines the responsibilities for the county and volunteers.
Commissioner Dearden moved to approve the Weber County Volunteer Policy; Commissioner Zogmaister seconded, both voting aye.
2. Final approval of Cedar Cove Estates 2nd Amendment Lots 19-R and 20-R
Justin Morris, County Planning Department, stated that initially Cedar Cove subdivision received approval and subsequently lots 17, 18 and 19 were amended. Today’s amendment originally came in as part of Cedar Cove Estates Subdivision 1st Amendment which sought to narrow the road width from 60 ft. to 50 ft. along Bybee Drive in May 2007, because some of the houses were built beyond the setback. Today’s amendment was only to have the existing fault line and drainage easement reflect their actual geographical location as determined by a geotechnical study.
Commissioner Dearden asked for clarification noting that the Planning Commission minutes stated that they approved the subdivision 1st Amendment, but nothing showed they had approved this 2nd Amendment. Ernest Rowley, County Recorder/Surveyor, explained that Cedar Cove Estates had two plats already on record–the first was Cedar Cove Estates, the second was Cedar Cove Estates with an amendment. The amendment affected lots 17, 18 and 19 and a problem occurred when the petitioners submitted for the amendment on today’s agenda by calling it “first amendment” when a first amendment already existed on record. The Planning Commission had merely used the name of the subdivision as submitted, but the Recorder/Surveyor’s Office, that reviews plats, was requiring the petitioners to change the name to Second Amendment to avoid duplication on the record. Mr. Rowley stated that the problem originated when homes in the subdivision were built within the setbacks. The petitioners were in the process of narrowing the roads, however, because of the amount of time to complete that amendment for the entire subdivision, the petitioners desired to start their building process and were only dealing with lots 19 and 20 at this time. The only thing changing on these two lots was the easement and fault line definitions, which was the second amendment for the entire subdivision and when the road narrowing came in it would be the third amendment.
Commissioner Dearden moved to grant final approval of Cedar Cove Estates 2nd Amendment Lots 19-R and 20-R; Commissioner Zogmaister seconded, both voting aye.
F. Public Hearing:
1. Commissioner Dearden moved to adjourn the public meeting and convene the public hearing; Commissioner Zogmaister seconded, both voting aye.
2. Public hearing on an Ordinance to vacate Lots 19-R and 20-R from Cedar Cove Estates and Lot 19-R from Cedar Cove Estates Amended Lots 17-19-R located at approximately 2872 E. Bybee Drive
See item E.2. above. Justin Morris, County Planning Department, stated that this ordinance was to vacate lots 19 and 20 from the two plats. Mr. Morris clarified that the complete subdivision name had been “Cedar Cove Estates Amended Lots 17-19-R, which made it somewhat confusing, and Mr. Rowley reiterated that this item was to amend lots 19 and 20 only. The petitioner of lot 20 was present.
3. Commissioner Dearden moved to adjourn the public hearing and reconvene the public meeting; Commissioner Zogmaister seconded, both voting aye.
4. Action on public hearing:
F.2. - Public hearing to vacate Lots 19-R and 20-R from Cedar Cove Estates and Lot 19-R from Cedar Cove Estates Amended Lots 17-19 - Ordinance 2007-33
Commissioner Dearden moved to adopt Ordinance 2007-33 vacating ; Commissioner Zogmaister seconded.
