OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, October 23, 2007 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. Commissioner Dearden moved to approve the consent items as presented; Commissioner Zogmaister seconded, all voting aye.
E. Presentation of the Seal of Service Award to Shelly Halacy
Chair Bischoff read the nomination submitted by Shelly Halacy’s co-workers. The commissioners also expressed thanks to Ms. Halacy for her work in the Commission Office. She was presented with $100, a seal of service pin and a plaque.
F. Action Items:
1. Contract with Utah State University Extension to fund Administrative Assistant position for Utah State University Extension Office in Weber County - Contract C2007-252
Jerry Goodspeed, USU Extension, stated that their lead office specialist had retired resulting in a vacancy.
Commissioner Zogmaister moved to approve Contract C2007- 252 by/between Weber County and Utah State University Extension to fund an Administrative Assistant position for the Utah State University Extension Office in Weber County; Commissioner Dearden seconded, all voting aye.
2. Resolution recognizing the Weber Morgan Coordinated Human Services Transportation Planning Committee as the planning entity for coordinating Human Services Transportation Needs - Resolution 50-2007
Kelly Van Noy, Weber Human Services, requested the Commission’s support for Weber Human Services in its role as a management entity for a planning committee to determine transportation needs, to set priorities and make recommendations to funding sources through grants, Wasatch Front Regional Council, etc. This would help coordinate efforts within Weber and Morgan counties to better serve the areas of Ogden Valley, Morgan County and the Wasatch Front for Human Services purposes.
Commissioner Dearden moved to adopt Resolution 50-2007 designating responsibility to Weber Human Services for management of the coordinated Human Services Transportation Planning Committee; Commissioner Zogmaister seconded.

3. Resolution of the Board of County Commissioners of Weber County consenting to the annexation of certain properties into Plain City, Utah - Resolution 51-2007
David Wilson, Deputy County Attorney, stated that the county had been working extensively with Plain City on this item. Brandon Richards, Plain City Attorney, outlined the statutory process whereby cities can move forward on annexation of islands or peninsulas without a petition for annexation. There had been sufficient objections filed on a large island in the city that resulted in its removal from annexation. The remaining of the smaller islands did not receive written objections at the time of the hearing and the city desired to move forward and annex those properties into the city. There is a requirement, until January 2008, whereby the cities must come before the County Commission and ask for approval of the annexation process. Commissioner Zogmaister asked how much land this involved and Plain City Mayor Jenkins responded that it totaled about 10 acres, representing approximately 12 different parcels, and Mr. Richards showed a map of that area.
Commissioner Dearden moved to adopt Resolution 51-2007 consenting to the annexation of certain properties into Plain City as described in the attached Exhibit A; Commissioner Zogmaister seconded.

4. Contract with Jordan World Productions, Inc. for a Circus on February 1- 2, 2008 at the Golden Spike Event Center - Contract C2007-253

Commissioner Zogmaister moved to approve Contract C2007- 253 by/between Weber County and Jordan World Productions, Inc. for a circus on February 1-2, 2008 at the Golden Spike Event Center; Commissioner Dearden seconded, all voting aye.
5. Contract with Wasatch Slopes/Beehive/Skyline/Bear River Chariot Racing Associations for weekly Chariot Races for the 2007-2008 Season to be held at the Golden Spike Event Center - Contract C2007-254

Commissioner Dearden moved to approve Contract C2007-254 by/between Weber County and Wasatch Slopes/Beehive/Skyline/Bear River Chariot Racing Associations for weekly chariot races for the 2007-2008 season to be held at the Golden Spike Event Center; Commissioner Zogmaister seconded, all voting aye.
6. Contract with Utah State Cutter and Chariot Championships on February 23-24, 2008 at the Golden Spike Event Center - Contract C2007-255

7. Contract with World Championship Cutter and Chariot Racing Association for the World Chariot Racing Finals to be held in March 2008, 2009 and 2010 at the Golden Spike Event Center - Contract C2007-256

16. Declaring Parcel #04-042-0070, located at 2881 Lincoln Avenue, Ogden, UT as Surplus Property
Nate Pierce, County Operations Director, stated that this parcel consisted of about 0.11 acres and had come to the county through a tax sale in 2001. An adjoining property owner had expressed interest in purchasing this parcel and the Assessor’s Office had valued it at $17,000.00.
Commissioner Zogmaister moved to declare LSN 04-042-0070, located at 2881 Lincoln Avenue, Ogden, UT as surplus property; Commissioner Dearden seconded, all voting aye.
17. Request for agreement by/between Weber County and Titan Development, etal, for a nonexclusive utility easement for the construction of an underground sanitary sewer line and an underground storm sewer line within a portion of the Rail Trail Corridor
Nate Pierce, County Operations Director, asked that this item be held for one week.
18. Retire Parcel 05-156-0019 owned by Anna J. Record
Ernest Rowley, County Recorder/Surveyor, stated that Ms. Record believed this parcel did not exist and Mr. Rowley concurred and asked that it be retired.
Commissioner Dearden moved to retire LSN 05-156-0019 owned by Anna J. Record; Commissioner Zogmaister seconded, all voting aye.
