OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, September 11, 2007 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear

Commissioner Dearden moved to approve the consent items as presented; Commissioner
Zogmaister seconded, all voting aye.
E. Action Items:
1. Approval of the new Evacuation Plan for the Weber Center
Chris Ward, County Training, noted that the various tenants from the Weber Center had been
represented on the Evacuation Plan committee and that annual Plan reviews would be conducted.
The commissioners noted that some telephone numbers and other corrections needed to be made.
Commissioner Zogmaister moved to approve the Evacuation Plan for the Weber Center with the
discussed changes; Commissioner Dearden seconded, all voting aye.
2. Ordinance granting a grace period in the implementation of impact fees for
qualifying subdivisions - Ordinance 2007-26
Jim Gentry, County Planning Department, noted that the Commission had directed him last week
to prepare an ordinance delaying the imposition of impact fees for qualifying subdivisions for
which an application had been filed with County Planning prior to September 1, 2007 but had
not received final approval by September 1. Collection of impact fees for lots within qualifying
subdivisions would be implemented on December 1, 2007. Lots within subdivisions recorded
prior to implementation of impact fees on September 1 or subdivision applications submitted
after that date would be subject to impact fees as of September 1.
Commissioner Dearden moved to adopt Ordinance 2007-26 amending implementation date of
Title 38, Impact Fees for trails, storm drains, wastewater and roadways necessitated by new
development for qualifying subdivisions; Commissioner Zogmaister seconded.

Alan McEwan, County Clerk/Auditor, stated that the county had contracted with the above cities
to provide their 20070municipal election services. The contracts were based upon amounts
committed by the cities to the Lieutenant Governor’s Office for these services. The contract with
Ogden City had been previously approved.
Commissioner Zogmaister moved to approve the Interlocal Agreements, C2007-219 through
C2007-232, by/between Weber County and the above listed cities regarding the 2007 municipal
election services; Commissioner Dearden seconded, all voting aye.
4. Discussion and/or action on the Ogden Valley Sewer Recommendation
Steve Clarke, GEM Committee member, introduced the present committee members and named
those from the Advisory Team, indicating a great pool of related knowledge and experience.
There were 8 operating and 9 planned/approved sewer systems, and many new subdivisions were
coming. He noted that fewer sewer districts were more cost effective and high water quality in
Pineview Reservoir was vital. He said that the issue was management of public health and noted
problems with the county not being able to be responsive when current wastewater system issues
occurred in the Ogden Valley (Valley) because of the county’s position as a body politic and not
being funded, trained, etc.
The commissioners wanted to implement a better solution and met with committee members in
January 2007. The committee had evaluated four alternatives and recommended the combined
alternative which included all new residences in the district and that existing onsite users may get
services from or become part of the new district. The committee recommended that the county
contract for a feasibility study, to form a new county sewer improvement district to serve all
township properties not in current districts, to form a new interlocal board with representatives
from all Valley sewer districts and a county advisor, and to invite Huntsville and all other districts
to join the new district. The committee further recommended that this alternative be financed by
a cost-based fee structure, rather than a tax structure, because there was a lot of territory not part
of an existing district and a lot of parcels that would receive no services from this new district
could petition for exclusion from the district. The disadvantage to this alternative was that at the
onset there would be zero connections and zero revenue.
Chair Bischoff noted that Pineview Reservoir pollution had been traced to boating and people
illegally discharging into the reservoir and Mr. Clarke said that the Forest Service, which had
primary responsibility, was aware of it, however, the State DEQ and Weber Basin did not agree
on Pineview’s cause of current impairment. He said that one of the recommendations was to
reduce the amount of wastewater inflow into the reservoir. The committee had asked that the
Commission not wait until all the agencies agreed on this wastewater pollution issue but rather to
take an aggressive posture and be proactive in taking preventative measures. The commissioners
thanked the committee forgoing above and beyond their duty in creating this valuable study.
Ron Gleason, GEM Committee member and Greenhills Water & Sewer board member, stated that
it could be useful to Greenhills to be able to address a common sewer district with questions
regarding maintenance, failure, etc. Commissioner Zogmaister asked if Greenhills was willing to
join the larger district or contract with said district to use the services. Mr. Gleason did not know
whether they would join but felt certain they would want to use the services. Jim Ormsbee, of
Elkridge Engineering, stated that he and others in the committee had significant experience in
sewer which had been valuable in preparing this proposal and expressed his confidence in it. The
Commission will review the study. They felt that moving forward as soon as possible was
important.
F. Pubic Hearing:
1. Commissioner Dearden moved to adjourn the public meeting and convene the public hearing;
Commissioner Zogmaister seconded, all voting aye.
2. Public hearing on petitions by Dora Anselmi to remove the following from
Agriculture Protection Areas: Land Serial Numbers: 15-054-0012, 15-057-0013 and
15-057-0014 located at approximately 4100 W. To 4600 W. 1400 S.
Fátima Fernelius, Clerk/Auditor’s Office, outlined the related statutory process, which had been
followed. Chair Bischoff invited public comments and none were offered.
4. Commissioner Zogmaister moved to adjourn the public hearing and reconvene public meeting;
Commissioner Dearden seconded, all voting aye.
