OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, August 21, 2007 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear

Commissioners Present: Kenneth A. Bischoff, Chair; Jan M. Zogmaister, Vice Chair, and Craig L.
Dearden.

D. Consent Items:
1. Purchase orders in the amount of $46,345.61

4. Approval of ACH payment to US Bank in the amount of $34,763.82 for purchasing card
transactions through the billing cycle ending August 15, 2007
Commissioner Zogmaister moved to approve the consent items as presented; Commissioner
Dearden seconded, all voting aye.
E. Action Items:
1. Contract with Kirk A. Cairns to dispose of a surplus property LSN05-118-0057,
located at approximately 375 34th Street, Ogden, UT, and a Quit Claim Deed -
Contract C2007-204
Nate Pierce, County Operations Director, stated that last week the Commission had declared this
parcel surplus. Mr. Cairns was willing to pay the market value of $675.00.
Commissioner Dearden moved to approve Contract 2007-204, Real Estate Purchase and Sale
Agreement, by/between Weber County and Kirk A. Cairns for LSN 05-118-0057, located at
approximately 375 34th Street, Ogden, UT, and a Quit Claim Deed; Commissioner Zogmaister
seconded, all voting aye.
2. Contract with Sean C. Wilkinson and Justin A. Morris to sell surplus property
LSN 01-051-002, and a Quit Claim Deed - Contract C2007-205
Nate Pierce, County Operations Director, stated that this parcel had been declared surplus and
an advertising process had been followed. Because Mr. Wilkinson and Mr. Morris were Weber
County employees, Mr. Pierce had also made sure that individuals in the community had an
opportunity to bid on the parcel and a public disclosure process was followed to accept bids. Mr.
Wilkinson and Mr. Morris were the only ones who submitted a bid. Their bid was for $1,529.36.
Commissioner Zogmaister moved to approve Contract 2007-205, Real Estate Purchase and Sale
Agreement, by/between Weber County, Sean C. Wilkinson and Justin A. Morris for LSN 01-051-
002; Commissioner Dearden seconded, all voting aye.
3. Final reading of certain amendments to the “Local Sales and Use Tax (RAMP Tax)
Ordinance - Ordinance 2007-21
Commissioner Zogmaister noted the two proposed changes to the ordinance, which had been
discussed at the first reading last week.
Commissioner Dearden moved to adopt Ordinance 2007-21, final reading of certain amendments
to the “Local Sales and Use Tax (RAMP Tax) Ordinance; Commissioner Zogmaister seconded.

4. Resolution appointing the Chairs of the RAMP Tax Arts and Museums Committee
and the RAMP Tax Recreation and Parks Committee - Resolution 47-2007
Commissioner Zogmaister stated that this resolution allowed the appointments of Samuel Steven
Lower as the Chair of the Arts and Museums Committee and Stephanie Christiansen as the Chair
of the Recreation and Parks Committee.
Commissioner Dearden moved to adopt Resolution 47-2007 of the Board of Commissioners of
Weber County appointing Samuel Steven Lower as the Chair of the RAMP Tax Arts and
Museums Committee and Stephanie Christiansen as the Chair of the RAMP Tax Recreation and
Parks Committee; Commissioner Zogmaister seconded.

5. agreement for installation of a paved pathway located on 3600 West, between
approximately 2100 N. and 2300 N. in an unincorporated island within Plain City
Contract C2007-206
David Wilson, Deputy County Attorney, stated that there was a student walkway issue at Plain
City Elementary School where there was a small piece of unincorporated Weber County property
next to the new elementary school on 3600 W. The parties to this agreement agreed that 3600
W. between approximately 2100 N. and 2300 N. is a prescriptive road consisting of about 26 ft.
with 2 ft. of shoulder on either side, and that by right of use it has become a public road to that
extent.
Mr. Wilson commended the commissioners for their safety concerns of the school children. A
meeting had been held with the property owners and their attorney to resolve the roadway
ownership issues. Mr. Wilson indicated that the meeting was productive and the property owners
and the county representatives came to agreement on the property needed for the walkway and
the cost per square foot of that property. This property will eventually be annexed into Plain City
and developed, and probably have curb, gutter and sidewalk but not until at least next year. In
the interim, the county will purchase a 6 ft. strip from the north end of the Skeen’s property to
the north edge of 2200 N. and will construct an 8 ft. wide paved pathway along the east side of
3600 W. beginning at the north end of the Skeen’s property and extending to the north edge of
2200 N. Plain City will be responsible for snow removal. The county will pay the Skeens $1.90
per square foot after the actual length is determined by the County Surveyor’s Office as described
in the agreement. The commissioners expressed appreciation to the Skeens for their cooperation
and anticipated moving forward as soon as possible.
Commissioner Zogmaister moved to approve Contract 2007-206 by/between Weber County and
the Anna Jean Skeen Trust for installation of a paved pathway located on 3600 West, between
approximately 2100 North and 2300 North in an unincorporated island within Plain City;
Commissioner Dearden seconded, all voting aye.

Final approval of Stephensen Subdivision located at 585 S. 3600 W, a 1-lot
subdivision consisting of one acre
Justin Morris, County Planning Department, showed an area map of this subdivision in the A-1
zone requiring a minimum lot area of one acre. Culinary water will be provided by Taylor West
Weber Water Improvement District and wastewater services by a Health Department approved
at-ground septic system. The Weber Fire District required one fire hydrant (already installed).
Access to the lot is along 3600 W., a substandard county road, and a substandard road agreement
was required. The applicant was requesting deferral for curb, gutter and sidewalk on 3600 W.
for the 150 ft. of frontage.
Commissioner Dearden moved to grant final approval of the Stephensen Subdivision located at
approximately 585 South 3600 West, a 1-lot subdivision consisting of one acre, with deferral for
curb, gutter and sidewalk on 3600 West for 150 ft. of frontage; Commissioner Zogmaister
seconded, all voting aye.
7. Final approval of North Fork Acres Subdivision, located at 2000 E. & 5950 N. in
the North Fork area, 2-lot subdivision, with a $6,050.00 financial guarantee
Scott Mendoza, County Planning Department, stated that this subdivision consisted of about 7.46
acres and had been required to have one fire hydrant. The Ogden Valley Planning Commission
had unanimously recommended approval of this subdivision. Commissioner Dearden asked
about future homes requiring residential sprinklers and Mr. Mendoza responded that the lots
would eventually be built on and the Liberty Pipe Line Water Company had denied the
residential connections. The applicant was now in discussions with them for the fire hydrant.
If they denied that also, then the Fire District would give a new letter requiring that future homes
have residential sprinklers. At this time the Fire District was comfortable with the requirement
for a fire hydrant.
Commissioner Zogmaister moved to grant final approval of North Fork Acres Subdivision,
located at approximately 2000 East & 5950 North in the North Fork area, a 2-lot subdivision,
with a financial guarantee of $6,050.00; Commissioner Dearden seconded, all voting aye.
8. Request for approval of Contract with Motorola Wireless Data
Communications System
9. Request for approval of Contract with Ogden City School District for remote
internet cooperative service
10. Request for approval of Contract with the Weber County School District for
remote internet cooperative service
