MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, July 3, 2007 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d),
the County Clerk records in the minutes the names of all citizens who appear and
speak
at a County Commission meeting and the substance “in brief” of their comments. Such

Commissioners Present: Kenneth A. Bischoff, Jan M. Zogmaister, and Craig L. Dearden.

D. Consent Items:
1. Purchase orders in the amount of $106,422,27

Commissioner Zogmaister moved to approve the consent items, with minor changes to June 19
minutes by legal counsel; Commissioner Dearden seconded, all voting aye.
E. Action Items:
1. Approval of the 2007 Weber County Tax Rates
Roger Brunker, Clerk/Auditor’s Office, presented the 2007 tax rates, giving an explanation of this
process.
Commissioner Dearden moved to approve the 2007 Weber County tax rates; Commissioner
Zogmaister seconded, all voting aye.
2. Final approval of the Fall Widow Subdivision, 4 lots, located at 350 South 7900
West with a financial guarantee of $32,581.00
Scott Mendoza, County Planning Department, showed an area map, stating that the subdivision
would cover 18.63 acres and about 600 ft. of public road improvements. The Planning
Commission had unanimously recommended final approval of this subdivision, which included
approval of the request for deferral of curb, gutter and sidewalk.
Commissioner Zogmaister moved to accept the recommendation to grant final approval of the Fall
Widow Subdivision, 4 lots, located at approximately 350 South 7900 West, with a $32,581.00
financial guarantee and deferral of curb, gutter and sidewalk; Commissioner Dearden seconded,
all voting aye.
3. Request to approve an ordinance changing a street number designation within the
Lugar De Paz Subdivision from 1300 South Street to 1400 South Street
This item was held.
4. Contract with Mike Van Alfen for a demolition derby at the 2007 Weber County
Fair - Contract C2007-186
Jan Wilson, Weber County Fair, outlined this contract, which was in the amount of $7,500.
Commissioner Dearden moved to approve Contract C2007-186 by/between Weber County and
Mike Van Alfen to have the demolition derby at the 2007 Weber County Fair; Commissioner
Zogmaister seconded, all voting aye.
5. Contract with Broken Heart Rodeo Company, LLC, for the rodeo at the 2007
Weber County Fair - Contract C2007-187
Jan Wilson, Weber County Fair, presented this contract totaling $5,600 plus $9/run.
Commissioner Zogmaister moved to approve Contract C2007-187 by/between Weber County and
Broken Heart Rodeo for the rodeo at the 2007 Weber County Fair; Commissioner Dearden
seconded, all voting aye.
6. Contract with Ryan Shupe and the Rubberband for a performance at the 2007
Weber County Fair - Contract C2007-188
Jan Wilson, Weber County Fair, outlined this contract, which was in the amount of $5,000.
Commissioner Dearden moved to approve Contract C2007-188 by/between Weber County and
Ryan Shupe and the Rubberband for a performance at the 2007 Weber County Fair; Commissioner
Zogmaister seconded, all voting aye.
7. Contract with Creative Artists Agency to have Phil Vassar perform at the 2007
Weber County Fair - Contract C2007-189
Jan Wilson, Weber County Fair, outlined this contract, which was in the amount of $35,000.
Commissioner Dearden moved to approve Contract C2007-189 by/between Weber County and
Creative Artists Agency to have Phil Vassar perform at the 2007 Weber County Fair;
Commissioner Zogmaister seconded, all voting aye.
8. Discussion regarding concerns on Traffic Safety in Ogden Canyon
Jason Rusch, Ogden resident, expressed safety concerns regarding large (construction) truck traffic
in the Ogden Canyon (SR39). Mr. Rusch commutes everyday through the Ogden Canyon and
stated that over the last few years development in Ogden Valley continued to increase dramatically
and as a result the needed construction materials and equipment posed serious safety risks. The
Ogden Canyon was not built for the large amounts of construction truck traffic and a lot of the
trucks traveling the canyon were too large and the transported materials were being spilled out
causing property damage and posing serious risk to life. The narrowness of the canyon did not
allow getting out of the way in case of problems since the river was on one side and the mountain
on the other. Mr. Rusch recognized that this was a State Highway but had found out that the Utah
Highway Patrol (UHP) did not patrol the canyon and that the Sheriff’s Office did. He suggested
implementing speed traps in the narrow canyon areas and hoped that it would not take a serious
accident before action was taken.
Chair Bischoff noted that the Commission understood the concerns but solutions were difficult.
Weber County Sheriff Brad Slater said that calls expressing concerns had been received from
people who travel the canyon. He stated that it was a State road, that UHP’s focus was on
enforcement on I-15 due to the current construction project, that UHP was short on manpower, and
the Sheriff’s Office generally had better response time. He noted that truck traffic, particularly from mile
post 9 to 11, made it a difficult and unsafe
situation, and this was not a good area to respond to in
emergencies regardless of vehicle size.
Sheriff Slater addressed the commissioners’ questions stating that the Sheriff’s Office utilized
UHP’s truck inspectors and that there were truck size restrictions on the canyon.
Mr. Rusch said that UDOT appeared to be aware of the suggestion to prohibit truck traffic in the
canyon and that they had implied it was being reviewed. Chair Bischoff thanked Mr. Rusch noting
that it had been good discussion.
