OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, April 24, 2007 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records
in the minutes the names of all citizens

Commissioners Present: Kenneth A. Bischoff, Chair; Jan M. Zogmaister; and Craig L. Dearden.

D. Consent Items:
1. Purchase Orders in the amount of $236,052.94

4. Approval of ACH payment to US Bank in the amount of $28,777.24 for purchasing card
transactions through billing cycle ending April 15, 2007
5. Request from the Weber County Sheriff’s Office to surplus obsolete computer equipment
Commissioner Dearden moved to approve the consent items as presented; Commissioner
Zogmaister seconded, all voting aye.
E. Action Items:
1. Resolution appointing a member to Weber Area Dispatch 911 and Emergency
Services District Administrative Control Board - Resolution 26-2007
Commissioner Dearden stated that both WACOG and Weber County recommended a certain
number of appointees to this Board. One of the appointees recommended by the County
Commission had left and there was a vacancy.
Commissioner Dearden moved to adopt Resolution 26-2007 appointing Brett Haycock to the
Weber Area Dispatch 911 and Emergency Services District Administrative Control Board;
Commissioner Zogmaister seconded.

2. Agreement with the State of Utah for an Emergency Special Needs Website -
Contract C2007-77
David Wilson, Deputy County Attorney, stated that he and Reed Richards, Deputy County
Attorney, had worked with Lance Peterson, of County Emergency Management, on the
development of this agreement. Weber County’s Information Technology department already
developed computer programs for a special needs registration website for use in Weber County.
The State desired to utilize those programs state-wide to facilitate municipal and county use of the
data for special needs emergency planning. Weber County will provide website hosting and
access. The concern by the County Attorney’s Office had been the liability associated with that
information getting into the wrong hands, however, per this agreement, the State will assume full
liability. The data is to go only to police and fire units.
This master agreement between Weber County and the State has a 5-year term. Subsequently,
there will be agreements between the State, cities and counties desiring to participate in this
process that will state the cities and counties will be responsible for the data they take from the
site.
Commissioner Zogmaister moved to approve Contract C2007-77 by and between Weber County
and the State of Utah for an Emergency Special Needs Website; Commissioner Dearden seconded,
all voting aye.
3. Amend the Agricultural Protection Areas Ordinance providing for filing fees and
other amendments - Ordinance 2007-12
Monette Hurtado, Deputy County Attorney, noted that State law pertaining to Agriculture
Protection Areas (APAs) was not very clear and she had added clarifying language to this
ordinance, including provisions for filing fees, petition for land removal and courtesy mailings to
residents within 1,000 ft. of the area to be removed from APAs. The initial ordinance fees,
adopted in 1998, had now been reviewed in cooperation with the Recorder/Surveyor’s Office.
Actual costs to remove land from an APA amounted to $100.00 per parcel for review of legal
descriptions, ownership verification, identification of adjacent property owners, courtesy mailing
and mailings to the Advisory Board. This fee will be included in the County’s Fee Schedule, Title
6, Chapter 22.
Commissioner Dearden moved to adopt Ordinance 2007-12 amending the Agriculture Protection
Areas Ordinance, Title 32, providing for filing fees and other amendments; Commissioner
Zogmaister seconded.

4. Approve extension request for the following tax sale properties:
Peggy Quillen Williams, LSN 05-179-0101; Randy and Kathleen Uribe, LSN 06-035-0010
Roger Brunker, Clerk/Auditor’s Office, stated that the Tax Review Committee had unanimously
recommended accepting these requests. However, the Uribes’ taxes had been satisfied in the
interim. Ms. Williams will sign an agreement to pay $250/month.
Commissioner Zogmaister moved to grant the tax sale extension request for Peggy Quillen
Williams, LSN 05-179-0101, with monthly payments of $250.00; Commissioner Dearden
seconded, all voting aye.
5. Remove penalty & interest for Harold & Suzanne Anderson, LSN 08-037-0133
Roger Brunker, Clerk/Auditor’s Office, outlined the unique circumstances relating to this item,
stating that there had been a county error in the mailing address. The Tax Review Committee
unanimously recommended waiving penalty and interest of about $170.00.
Commissioner Zogmaister moved to remove penalty and interest for Harold & Suzanne Anderson,
LSN 08-037-0133; Commissioner Dearden seconded, all voting aye.
6. First Reading of new animal control fees
David Wilson, Deputy County Attorney, stated that these fees could be approved today and the
ordinance would be submitted next week. Ron Willis, County Animal Control Services, noted
that it had been about four years since the animal control fees had been revised. Fees for
contracted cities, for non-contracted cities, and general animal control fees were increased.
Commissioner Dearden moved to approve the first reading of the new animal control fees;
Commissioner Zogmaister seconded, all voting aye.
7. Request for of resolution appointing members to Eden Park Services Board
This item was held until an election question was satisfied. David Wilson, Deputy County
Attorney, noted that Rod Peterson, of the Eden Park Services Board, was present. Mr. Wilson said
that this service area had been created in 1988 with appointments made at that time. The
Commission at that time had indicated that the first board would be appointed with subsequent
elections. It did not appear there had ever been a formal election and Mr. Wilson noted that these
smaller district positions were generally difficult to fill. The county was not the legal counsel to
this board and was trying to direct them to some type of legal counsel through the Special District
Association or the Attorney General’s Office. The question at this time was whether this board
should hold an election, which Mr. Wilson noted was very cumbersome and an imprudent
expenditure for small districts and that the legislature needed to review this issue.

Chair Bischoff stated that items 8.I. and M. would be held. Mike Caldwell, Public Information
Officer, noted that the request for funds exceeded the amount of grants available and solicitations
had been reviewed carefully. David Wilson, Deputy County Attorney, noted that these were the
major projects and recreation projects and that Roy City was an anomaly since it was a multi-year
contract. Chair Dearden gave an overview of some of the grant amounts.
Commissioner Zogmaister moved to approve RAMP Contracts C2007-78 through C2007-96 by
and between Weber County and the above listed entities; Commissioner Dearden seconded, all
voting aye.
F. Public Hearing:
1.Commissioner Dearden moved to adjourn the public meeting and convene the public hearing;
Commissioner Zogmaister seconded, all voting aye.
2. 2nd Public hearing on Community Development Block Grants
Dennis Richardson, County Engineering, stated that this public hearing was to allow all citizens
to provide input concerning the project awarded under the 2007 Community Development Block
Grant program. The county had decided to apply for funds on behalf of a project that would
remodel restrooms at the Weber County Southwest Branch Library located at 1950 West 4800
South in Roy and the North Branch Library located at 475 East 2600 North in North Ogden. This
project will remove barriers to the restrooms in order to more fully comply with the American
Disabilities Act. The county had amended its capital improvement plan to specifically include this
project. The capital improvement plan is available for anyone who would like a copy.
The Library restroom remodel project was successful in the Weber Area Council of Governments
rating and ranking process and the total amount of funding being applied for on this project was
$31,112. Chair Bischoff invited public comments and none were offered.
3.Commissioner Zogmaister moved to adjourn the public hearing and reconvene the public meeting;
Commissioner Dearden seconded, all voting aye.
4. Action on public hearing:
Commissioner Dearden moved to accept the CDBG grants for the Roy and the North Ogden
Library branches in the amount of $31,112.00; Commissioner Zogmaister seconded, all voting
aye.
G. Assign Pledge of Allegiance & Thought of the Day for Tues., May 1, 2007, 10 a.m.
H. Public Comments:
Connie Chandler asked what GOAL stood for under the RAMP contracts in item E.8. and the
commissioners addressed her question.
