MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, April 10, 2007 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens
who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or
purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Kenneth A. Bischoff, Chair; Jan M. Zogmaister; and Craig L. Dearden.
Others Present: Alan D. McEwan, Clerk/Auditor; David C. Wilson, Deputy County Attorney; Fátima
Fernelius, Clerk/Auditor’s Office, took minutes.

Jerry Goodspeed, Director of Utah State University Extension Service, introduced Donna Carter, the new
Extension Service 4-H agent. Ms. Carter said that she was excited to be working in Weber County.
D. Consent Items:
1. Purchase Orders in the amount of $47,484.69
2. Warrants #224589 - #224813 in the amount of $1,606,437.67
3. Minutes for the meeting held on April 3, 2007
4. Request from the Sheriff’s Office to surplus a Xerox 5334 Copier
5. Request for approval of new business licences
6. Set date of April 24, 2007, 10 a.m., for the second CDBG public hearing
Commissioner Dearden moved to approve the consent items as presented; Commissioner Zogmaister
seconded, all voting aye.
E. Action Items:
1. Contract with Uintah City for boarding Uintah City animals at the Weber County
Animal Shelter - Resolution 24-2007, Contract C2007-70
Weber County Sheriff Brad Slater stated that prior to this contract, Uintah City had housed its animals
through the South Ogden City animal control services, but South Ogden now contracted with Weber
County. This was a two-month contract at current rates and they would then determine whether to
continue it.
Commissioner Zogmaister moved to adopt Resolution 24-2007 approving Contract C2007-70 by and
between Weber County and Uintah City for boarding Uintah City animals at the Weber County Animal
Shelter; Commissioner Dearden seconded.

2. Request to put a street light at 4700 W. 2200 S. in Taylor, Weber County, UT
Nate Pierce, County Operations Director, referred to a petition from a few residents in the vicinity of
4700 West 2200 South requesting a street light. Mr. Pierce stated that a policy or directive needed to
be put in place regarding street light installation. Weber County currently had 107 street lights in the
unincorporated areas, leased 51 of the poles from Rocky Mountain Power, and owned 56 poles.
Weber County Sheriff Brad Slater noted that 4700 W. was State Road 134 and wondered if UDOT
would be willing to put the light in. He stated that 2200 S. was no longer a dirt lane servicing fields
but was a paved roadway servicing subdivisions. It was an entry to a highway and had increased
traffic, there was a significant number of school children in the area, and it was becoming a safety
concern. He added that lighted neighborhoods helped reduced crime. Mr. Pierce will contact
UDOT and notify neighbors for input, and he will then present the findings to the Commission who
will work toward establishing a procedure. The Sheriff’s Office will be included in these
discussions because of the safety concerns.
3. Request for approval to surplus the following properties:
LSN 23-020-0002; LSN 23-020-0003
Nate Pierce, County Operations Director, requested declaring these tax sale properties surplus.
They were located on Highway 39 and the total value of the two parcels was under $2,000. The
property owner between these two parcels desired to bid on them and Mr. Pierce said that his first
option would be to negotiate a sale.
Commissioner Dearden moved to declare surplus LSN 23-020-0002 and LSN 23-020-0003;
Commissioner Zogmaister seconded, all voting aye.
4. Contract with Yamas Controls for alterations to the Air Circulation System in
the Edward Jones and ICAC areas in the Weber Center - Contract C2007-71
Doug Dickens, County Operations Department, presented this contract. Commissioner Zogmaister
asked who would be paying for this service and Mr. Dickens stated it would be Property
Management initially but on an annual basis the various tenants would be assessed their portion at
which time the county would be reimbursed.
Commissioner Zogmaister moved to approve Contract C2007-71 by and between Weber County
and Yamas Controls for alterations to the Air Circulation System in the Edward Jones and ICAC
areas in the Weber Center; Commissioner Dearden seconded, all voting aye.
5. Request to approve Contract with Yamas Controls for replacement of the
evaporative deck pads in the Air Circulation System in the Weber Center
This item was held.
6. Contract with Wooden Creations/Mark Colp to have Wooden Creations chainsaw
carvings at the 2007 Weber County Fair - Contract C2007-72
Jan Wilson, Weber County Fair, presented this repeat contract, which was in the amount of
$3,800.00.
Commissioner Dearden moved to approve Contract C2007-72 by and between Wooden
Creations/Mark Colp to have Wooden Creations chainsaw carvings at the 2007 Weber County Fair;
Commissioner Zogmaister seconded, all voting aye.
7. Contract with Great Basin Antique Machinery to have Great Basin Antique
Machinery at the 2007 Weber County Fair - Contract C2007-73
Jan Wilson, Weber County Fair, gave an overview of this repeat contract, which was in the amount
of $800.00.
Commissioner Zogmaister moved to approve Contract C2007-73 by and between Weber County
and Great Basin Antique Machinery to have Great Basin Antique Machinery at the 2007 Weber
County Fair; Commissioner Dearden seconded, all voting aye.
8. Contract with Shaun Poulsen/Master Hypnotist to have the Master Hypnotist
perform at the 2007 Weber County Fair - Contract C2007-74
Jan Wilson, Weber County Fair, outlined this repeat contract, which was in the amount of $1,800.00
Commissioner Dearden moved to approve Contract C2007-74 by and between Weber County and
Shaun Poulsen/Master Hypnotist to have the Master Hypnotist perform at the 2007 Weber County
Fair; Commissioner Zogmaister seconded, all voting aye.
9. Agreement with the Swanson Foundation for a Tactical Training Facility -
Contract C2007-75
Commissioner Dearden stated that Swanson had approached the county to purchase some property
in the Industrial Park for a facility for law enforcement/public safety training. David Wilson,
Deputy County Attorney, stated that this was a $75,000/acre contract with the provision that the
public safety employees will receive some free training for a period of time within the facility. This
was to ensure the county received fair market value for the facility.
Mr. Wilson noted that Cindy Purcell, Chair of the Swanson Foundation, was present and had signed
the agreement. The County Attorney’s Office had reviewed this as well as the legal counsel for
Swanson. Mr. Wilson added that total compensation would not be calculated until the survey was
complete to determine the exact number of acres.
Commissioner Dearden moved to approve Contract C2007-75 by and between Weber County and
the Swanson Foundation for a Tactical Training Facility; Commissioner Zogmaister seconded, all
voting aye.
F. Assign Pledge of Allegiance & Thought of the Day for Tuesday, April 17, 2007, 10 a.m.

H. Closed Executive Session
Commissioner Zogmaister moved to close the public meeting and convene a closed executive
session to discuss the character and/or the professional competence of an individual in accordance
with the provisions of Section 52-4-205 of the “Open and Public Meetings Act”; Commissioner
Dearden seconded.
