OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, February 27, 2007 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens
who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or

Commissioner Dearden moved to approve the consent items as presented; Commissioner
Zogmaister seconded, all voting aye.
E. Presentation on Regional Wildfire Protection Plan (RWPP)
Kelly Allen, of Division of Forestry, Fire & State Lands, and also a National Fire Plan Coordinator
in the Weber, Rich, Box elder & Cache county areas, introduced those present from the Weber
Fire District and the Ogden Ranger District. Mr. Allen addressed a regional wildfire protection
plan, which encompassed 11 counties in the Northern Utah Interagency Fire Center Dispatch area.
A draft will come out approximately in the middle of March 2007, which will include a
community risk assessment, recommendations, and implementation monitoring strategies. This
is a voluntary process and projects in the plan receive funding priority. If the county chooses to
participate, the RWPP can assist in obtaining funding, help identify high risk areas and crucial
infrastructure within the county, a county-wide wildfire protection plan could be developed as
well as plans for individual communities. Mr. Allen invited the commissioners to add any
communities that should be on the list that he presented. Weber Fire Chief Dave Austin addressed
local efforts.
F. Action Items:
1. Approving an updated version of the Weber County Non-Discrimination Policy
David Wilson, Deputy County Attorney, gave a comprehensive overview of this policy, which
contained substantial revisions. This codified the State laws within the county’s policies and
included provisions relating to civil rights, equal employment, the Americans with Disabilities
Act, age discrimination, equal pay and Fair Labor Standards Act. The Human Resources and
Operations Departments had reviewed the policy and made helpful suggestions. Chair Bischoff
recommended a clarification to item 4.0(C). Human Resources will conduct related training.
Commissioner Zogmaister moved to approve the updated version of the Weber County Non-
Discrimination Policy with the noted clarification; Commissioner Dearden seconded, all voting
aye.
2. Contract with Stirrin’ Dirt, LLC, for an indoor demolition derby to be held
March 17, 2007 at the Golden Spike Event Center - Contract C2007-45
Jim Harvey, GSEC, presented this contract with Johnny Gullo.
Commissioner Dearden moved to approve Contract C2007-45 by and between Weber County and
Stirrin’ Dirt, LLC, for and an indoor demolition derby to be held on March 17, 2007 at the Golden
Spike Event Center; Commissioner Zogmaister seconded, all voting aye.
3. Contract with Weber State University Rodeo Team for Inter-Collegiate Rodeo
Competition to be held March 2-3, 2007 at the Golden Spike Event Center -
Contract C2007-46
Jim Harvey, GSEC, presented this contract with Dennis Montgomery.
Commissioner Zogmaister moved to approve Contract C2007-46 by and between Weber County
and Weber State University Rodeo Team for an Inter-Collegiate Rodeo Competition to be held on
March 2 and 3, 2007 at the Golden Spike Event Center; Commissioner Dearden seconded, all
voting aye.
4. Repurchase Agreement with Overland West, Inc., a Utah cooperation, dba Hertz
Car Sales - Contract C2007-47
Nate Pierce, County Operations Department Director, stated that this contract was to purchase a
1-year old vehicle to be used by the Strike Force. The county would have the option to keep the
vehicle or Hertz would repurchase it after two years at a guaranteed buy-back price.
Commissioner Zogmaister referred to the County Comptroller’s comments on the contract
summary sheet stating that the Strike Force had ample funds and suggesting that this agreement
be between Hertz and the Strike Force, and that the Strike Force provide its own insurance, make
the car payments, etc. The Sheriff’s Office had asked that this vehicle be purchased, and Mr.
Pierce preferred that all county vehicles fall under one fleet, thus this vehicle would become part
of the overall fleet. However, the purchase cost, insurance, monthly payments, and the additional
base rate charged by the county for a vehicle, would come out of the Strike Force budget.
Commissioner Dearden noted that when the Strike Force was initiated, Ogden City agreed to lease
and insure the vehicles and had continued to do so, but recently one of the county deputies was in
an accident and the City did not feel they covered that. The county was now in discussions with
them to cover it. The county wanted to ensure that if one of its deputies was in an accident it
would be covered and that was the reason for this agreement. Commissioner Zogmaister asked
if Ogden City Strike Force members would be using this vehicle and Commissioner Dearden did
not believe so. Commissioner Bischoff asked about the process in obtaining this vehicle noting
that the county should make the opportunity available to the local dealers. Mr. Pierce responded
this transaction had been accomplished through negotiations after visiting other automobile dealers.
Commissioner Zogmaister reiterated that the funds were to come from the Strike Force and that
this transaction should not cost the county anything and Mr. Pierce said that he had indicated to
the Comptroller last week that they would follow his suggestions.
Commissioner Dearden moved to approve Contract C2007-47, Repurchase Agreement by and
between Weber County and Overland West, Inc., a Utah cooperation, dba Hertz Car Sales;
Commissioner Zogmaister seconded, all voting aye.
5. Contract with Stark Brothers Construction for the Coliseum Pedestrian Bridge
and the Fairgrounds Storm Drain Project - Contract C2007-48
Dennis Richardson, County Engineering, stated that this was for approval of the contract that had
been awarded at last week’s commission meeting. The contract had been reviewed by the County
Attorney’s Office. The storm drain project was in the amount of $29,880 and the pedestrian bridge
(the abutment portion) $67,690 for a contract total of $97,570.00.
Commissioner Zogmaister moved to approve Contract C2007-48 with Stark Brothers Construction
for the Coliseum pedestrian bridge and the Fairgrounds storm drain projects; Commissioner
Dearden seconded, all voting aye.
6. Resolution confirming the appointments of Joe Ritchie and Kim Dohrer to the
Governing Board of Weber Human Services - Resolution 17-2007
David Wilson, Deputy County Attorney, explained the process for these appointments and stated
that Morgan County had confirmed the appointments sent to them by Weber County.
Commissioner Dearden moved to adopt Resolution 17-2007 confirming the appointments of Joe
Ritchie and Kim Dohrer to the Governing Board of Weber Human Services; Commissioner
Zogmaister seconded.

7. Approval of the Wolf Creek Sewer Improvement District Franchise Agreement -
Contract C2007-49
David Wilson, Deputy County Attorney, noted that Lowell Peterson was present. Mr. Wilson
stated that Wolf Creek Sewer Improvement District was seeking tax exempt bonding to accomplish
major improvements that they were planning. In the process, they wanted written approval from
the county to continue to put sewer lines within public roads within their district. Utah law allows
utility companies to utilize public roads for their services, however, bond counsel wanted an
agreement showing that Wolf Creek Sewer Improvement had the ability to do that. Mr. Wilson
explained that this was not the typical franchise agreement; it was only to allow Wolf Creek to
make the improvements within the district on public roads.
Commissioner Zogmaister moved to approve Contract C2007-49, Wolf Creek Sewer Improvement
District Franchise Agreement; Commissioner Dearden seconded, all voting aye.
