MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, January 30, 2007 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens

Commissioners Present: Jan M. Zogmaister and Craig L. Dearden. Kenneth A. Bischoff was excused.

1. Purchase Orders in the amount of $134,621.30

Commissioner Dearden moved to approve the consent items; Commissioner Zogmaister seconded,
both voting aye.
E. Action Items:
1. Interlocal Cooperation Agreement with Weber Human Services (WHS) for
provision of grounds maintenance services - Contract C2007-41
Nate Pierce, County Operations Department Director, stated that WHS had requested that the
county continue to provide these services. Mr. Pierce outlined the contract stating that it included
snow removal and various maintenance services.
Commissioner Dearden moved to approve Contract C2007-41, Interlocal Cooperation Agreement
by and between Weber County and Weber Human Services for the provision of grounds
maintenance services; Commissioner Zogmaister seconded, both voting aye.
2. Creation of Agriculture Protection Area #2 by The Flint Place, LLC (Marian F.
Martin), LSNs 21-038-0001 and 21-039-0001
3. Creation of Agriculture Protection Area #1 by Paul H. Knight Trust, LSNs 10-045-
0009, 0018, 0016 and 0014
Fátima Fernelius, Clerk/Auditor’s Office, presented items E.2 and E.3 together. The
Clerk/Auditor’s Office had received two proposals to create Agriculture Protection Areas (APAs)
and she outlined the statutory process, which had been followed. The Commission had all of the
documents in their packets. Vice Chair Zogmaister invited comments. Doug Taggart,
representing The Flint Place, and Paul H. Knight were present to address any questions by the
Commission. Mr. Taggart said that this was a family-owned LLC in the Ogden Valley that had
been part of Marian Martin’s family for generations and they were requesting that the property be
placed in an agriculture protection area.
Commissioner Dearden moved to approve Agriculture Protection Area #2 by The Flint Place, LLC
(Marian F. Martin), LSNs 21-038-0001 and 21-039-0001 and the Agriculture Protection Area #1
by Paul H. Knight Trust, LSNs 10-045-0009, 0018, 0016 and 0014; Commissioner Zogmaister
seconded, both voting aye.
4. Contract with the U.S. Forest Service for RAMP Grant - Contract C2007-42
Mike Caldwell, Ice Sheet Director, stated that the Forest Service had been granted two awards
totaling $59,650 to improve trail heads that were heavily used by the public.
Commissioner Dearden moved to approve Contract C2007-42 by/between Weber County and the
U.S. Forest Service for their RAMP Grant; Commissioner Zogmaister seconded, both voting aye.
5. Final approval of the Eagles Landing at Wolf Creek Subdivision Phase 1 located
at 3075 N. 5100 E., 10 lots, and a financial guarantee of $323,074.83
Scott Mendoza, County Planning Department, showed an area map. The subdivision is located
on 5100 E. (sometimes called Wolf Creek Dr. or Powder Mountain Road). This phase will cover
17.39 acres (of a larger project totaling 162 acres) and will have 6.62 acres of open space and
about 900 ft. of public road improvements. The Ogden Valley Planning Commission unanimously
recommended approval of this item. Mr. Mendoza addressed the commissioners’ questions
stating that all agreements for secondary water, sewer and culinary water were in place as well as
the letter of approval for access to the highway.
Commissioner Dearden moved to grant final approval of the Eagles Landing at Wolf Creek
Subdivision Phase 1, 10 lots, located at approximately 3075 North 5100 East, with a financial
guarantee in the amount of $323,074.83; Commissioner Zogmaister seconded, both voting aye.
6. Final approval of Nordic Meadows Subdivision Phase 2, 3 lots, located at 3175 N.
& 3500 E. in the Nordic Valley area with a $254,483.18 financial guarantee
Scott Mendoza, County Planning Department, showed an area map and stated that this subdivision
was about 1/4 mile north of the existing base area of the Wolf Mountain ski resort. This is the
final of two phases and covers about 15.5 acres with about 1,100 ft. of public road improvements,
which will stub to an adjacent property and provide access when that property develops in the
future. The Ogden Valley Planning Commission unanimously recommended approval of this
item. Mr. Mendoza addressed the commissioners’ questions stating that the pathway would be
on the north side of their road and that before any land use permits were issued the County
engineers would confirm that fire hydrants were in place.
Commissioner Dearden moved to grant final approval of Nordic Meadows Subdivision Phase 2,
3 lots, located at approximately 3175 North & 3500 East in the Nordic Valley area with a financial
guarantee in the amount of $254,483.18; Commissioner Zogmaister seconded, both voting aye.
