OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, January 2, 2007 - 2:00 p.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk
records in the minutes the names of all citizens
who appear and speak at a County Commission meeting
and the substance “in brief” of their comments. Such statements may include opinion or
purported facts.

Commissioners Present: Craig L. Dearden, Chair; Jan Zogmaister; and Kenneth A. Bischoff.

Commissioner Zogmaister moved to approve the consent items; Commissioner Bischoff seconded,
all voting aye.
E. Action Items:
1. Appointment of Commission Chair and Vice Chair for 2007
Commissioner Zogmaister moved to appoint Commissioner Bischoff as the Commission chair for
2007; Commissioner Dearden seconded, all voting aye.
Commissioner Bischoff moved to appoint Commissioner Zogmaister as the Commission vice
chair for 2007; Commissioner Dearden seconded, all voting aye.
Chair Bischoff conducted the meeting from this point.
2. Resolution appointing a Weber County Representative to the Governing Board of
the Utah Counties Insurance Pool (UCIP) - Resolution 1-2007
David Wilson, Deputy County Attorney, noted that every two years Weber County makes an
appointment to the governing board of UCIP. Other counties share appointments, but Davis,
Washington, Utah and Weber counties have one appointment. Commissioner Bischoff has been
serving on this board and said that the board was involved in important issues.
Commissioner Dearden moved to adopt Resolution 1-2007 appointing Commissioner Bischoff
as the Weber County representative to the Governing Board of the Utah Counties Insurance Pool
for another two year term; Commissioner Zogmaister seconded.

4. Contracts between Weber County and the following cities for Animal Control:

Reed Richards, Deputy County Attorney, stated that these contracts were simply extensions of the
past contracts from July 2006 to June 30, 2007. They are still in negotiations. If Ogden City joins,
the shelter’s size will have to increase significantly. Mr. Reed said that if the shelter was expanded
to include all the cities, there would have to be a long term agreement requiring that the cities pay
their respective share for their number of animals. Ron Willis, Director of County Animal
Control, stated that Riverdale houses animals at the county’s shelter, but the county does not
provide animal control. Currently, the shelter portion of the operation is done on a fee schedule
approved by the Commission a couple of years ago.
Commissioner Zogmaister moved to approve these contracts by/between Weber County and the
following cities for animal control: Plain City - Contract C2007-1; Farr West - Contract C2007-2;
Harrisville - Contract C2007-3; Hooper - Contract C2007-4; Huntsville - Contract C2007-5;
Marriott-Slaterville - Contract C2007-6; West Haven - Contract C2007-7; and Riverdale - Contract
C2007-8; Commissioner Dearden seconded, all voting aye.
3. Contracts between Weber County and the following cities for Law Enforcement:
A. West Haven - Resolution 2-2007, Contract C2007-9
B. Huntsville - Resolution 3-2007, Contract C2007-10
C. Plain City - Resolution 4-2007, Contract C2007-11
D. Hooper - Resolution 5-2007, Contract C2007-12

Reed Richards, Deputy County Attorney, stated that the county had a basic obligation to provide
law enforcement services and nearly all the cities over the years had wanted a higher level of
service and had approached the county to provide those services. These contract renewals are for
five years and there is a 180-day escape clause. Mr. Reed addressed the commissioners’ questions
stating that the fees were based upon the number of officers that the cities needed to provided their
services and that the annual amount of the contracts for subsequent years after the initial year
would be adjusted to reflect the actual cost of doing business. Chair Bischoff spoke in favor of
consolidating
services
wherein
it
was
cost
beneficial
to
tax
payers.
Commissioner Dearden moved to adopt these resolutions approving contracts between Weber
County and the following cities for Law Enforcement: West Haven -Resolution 2-2007, Contract
C2007-9; Huntsville - Resolution 3-2007, Contract C2007-10; Plain City - Resolution 4-2007,
Contract C2007-11; Hooper - Resolution 5-2007, Contract C2007-12; Washington Terrace -
Resolution 6-2007, Contract C2007-13; Marriott-Slaterville - Resolution 7-2007, Contract C2007-
14; Farr West - Resolution 8-2007, Contract C2007-15; Uintah - Resolution 9-2007, Contract

5. Agreement by/between Weber County & the Ogden/Weber Convention and Visitors
Bureau (CVB) for Convention Promotion Management - Contract C2007-17
David Wilson, Deputy County Attorney, noted that this contract had been considered two weeks
ago and at that time the Commission had suggested changes which had now been included as well
as changes resulting from Commissioner Dearden’s meeting with Shelliece Stokes, Executive
Director of the CVB. Ms. Stokes highlighted those changes including that the CVB would start
doing visitor promotion campaigns and the Front Line Service training program. Ms. Stokes
addressed Commissioner Dearden’s questions relating to SMG stating that SMG fully supported
the listed marketing plan. Commissioner Dearden noted that there were still some questions
regarding kiosks and DVDs.
Commissioner Zogmaister moved to approve Contract C2007-17 by and between Weber County
and the Ogden/Weber Convention and Visitors Bureau for Convention Promotion Management;
Commissioner Dearden seconded, all voting aye.
6. agreement by/between Weber County and the Ogden/Weber Convention and
Visitors Bureau for Tourist Transportation - Contract C2007-18
Shelliece Stokes, Executive Director of the CVB, stated that the CVB wanted to have a
transportation system in place that would connect the local downtown hotels and other properties
with the Ogden Valley ski resorts that ran during the winter season. A partnership was formed
with several of the hotels and Ms. Stokes is also looking into a ski clothing company that may
want to pay for some of the bus advertisements. The plan is to get two shuttles that will leave the
intermodal hub and have drop offs at the Powder Mountain and at Snow Basin on a continuous
loop of bringing guests both ways. This agreement is for the next three years.
Ms. Stokes addressed the commissioners questions stating that she was scheduled to address the
Ogden City Council on Thursday to request $25,000, that there were partnerships in place with
the Ogden Marriott, the Hampton, and the Ben Lomond, that the Wolf Creek Resort was a strong
partner this year, and Powder Mountain would honor the CVB’s shuttle so that CVB’s guests
debarking at Wolf Creek would not have to pay an additional fee to use the Powder Mountain bus.
Ms. Stokes will continue working with Snow Basin to get them to partner as well. She stated that
the county was providing the base funding. Ms. Stokes also stated that the transportation
committee was meeting on Friday and if the partners determined that this project should be put
off for a year, she would inform the Commission. The CVB is the only entity providing this type
of transportation.
Commissioner Dearden felt strongly about having an escape clause in the contract as was common
practice. Ms. Stokes said that the transportation company was requiring $88,000 for the first year
and $20,000 each for the second and third year if the contract was terminated because they would
be incurring the expense and did not want to obtain the equipment without a full 3-year
commitment. David Wilson, Deputy County Attorney, had not seen the contract between the CVB
and the transportation company. Commissioner Dearden noted that it would take at least one year
to determine if this venture would be successful. Mr. Wilson and the commissioners felt
comfortable with the 60-day termination clause and requested adding language to the contract
stating that the county would pay a penalty of $20,000 per year for two years if the contract was
terminated after the first year. Ms. Stokes said that the equipment would be ordered Friday
afternoon and would arrive in two days.
Commissioner Dearden moved to approve Contract C2007-18 by and between Weber County and
the Ogden/Weber Convention and Visitors Bureau for tourist transportation with the incorporation
of the liquidated damages clause that the county will pay up to $20,000/year for the next two years
if the contract is terminated after the first year, and this contract term is for the 2007, 2008, and
2009 ski seasons; Commissioner Zogmaister seconded, all voting aye.
7. Retirement Incentive Agreement by/between Weber County and Ronnie Bain -
Contract C2006-19
David Wilson, Deputy County Attorney, noted that Mr. Bain had retired and referred to the
contract before the Commission.
Commissioner Zogmaister moved to approve Contract C2007-19, Retirement Incentive
Agreement by and between Weber County and Ronnie; Commissioner Dearden seconded, all
voting aye.
8.
Approval of an Elected Service Health Insurance Benefit Agreement by and between
Weber County and the following former elected officials:
A. Camille T. Cain - Contract C2007-20
B. Douglas W. Crofts - Contract C2007-21
C. Linda G. Lunceford - Contract C2007-22
David Wilson, Deputy County Attorney, stated that these contracts fell under county policy
adopted several years ago for elected officials, and he outlined that policy.
Commissioner Dearden moved to approve these Elected Service Health Insurance Benefit
contracts by and between Weber County and the following former elected officials: Camille T.
Cain - Contract C2007-20; Douglas W. Crofts - Contract C2007-21; and Linda G. Lunceford -
Contract C2007-22; Commissioner Zogmaister seconded, all voting aye.
9. Request for approval of an agreement by and between Weber County for a new
copy machine for the Attorney’s Office
