OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, November 7, 2006 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
Each Commission meeting is recorded on CD or audio tape, which is available to the public through the County Clerk's Office.
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens
who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or
purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Craig L. Dearden, Chair and Kenneth A. Bischoff. Camille T. Cain was
excused.

Commissioner Bischoff moved to approve the consent items; Chair Dearden seconded, both
voting aye.
E. Action Items:
1. Contract with State of Utah for Court Security Services - Contract C2006-178
Weber County Sheriff Brad Slater stated that this contract was only for security services provided
to the District Court. There had been discussions for some time that the Courts should receive
services for only what they pay and this contract reflects an actual per hour charge rendered for all
District Court and Juvenile Court security services rendered by the Sheriff’s Office. There is a cap
of $243, 360 and it is anticipated that this amount will cover the services.
Commissioner Bischoff moved to approve Contract C2006-178 by and between Weber County
and the State of Utah Administrative Office of the Courts for court security services; Chair
Dearden seconded, both voting aye.
2. Agreement with Davis County for Driving Simulators - Contract C2006-179
Weber County Sheriff Brad Slater stated that this interlocal agreement was for the joint purchase
of technology, through Davis County, to provide training to both counties for law enforcement in
an effort to help reduce liability and driving accidents. Davis will develop the RFP and send out
the bid. Commissioner Bischoff asked if there were grant monies available and Sheriff Slater responded
that they had found nothing that would apply. Chair Dearden expressed concern that there was no
set limit for the county’s portion and the contract will be amended to state that the two counties
will share equally in all costs incurred not to exceed $325,000 for initial purchase. The Sheriff
addressed legal counsel’s question stating that there would be an initial purchase in the
approximate amount of $300,000 and ongoing maintenance of about $5,000-$6,000 annually. The
service life, with software upgrades over time, is estimated to be 10-15 years. The contract term
shall not exceed 50 years. Dan Olsen, County Comptroller, asked if the plan was still to use jail
cap grant funds and the Sheriff responded that was correct. Chair Dearden asked about other
driving simulations that could be used with the system and Sheriff Slater’s understanding was that
heavy equipment operation could also be simulated on this system.
Commissioner Bischoff moved to approve Contract C2006-179 by and between Weber County
and Davis County for driving simulators, with an amendment that the initial acquisition cost is not
to exceed $325,000; Chair Dearden seconded, both voting aye.
3. Agreement with Siemens Building Technology to perform a preliminary energy
conservation study of county facilities - Contract C2006-180
Doug Dickens, County Operations, stated that this allowed Siemens to perform a preliminary
energy conservation study of all the county facilities at no cost to the county. This is only a letter
of engagement and Siemens may make suggestions for change and the county can accept or take
no action.
Commissioner Bischoff moved to approve Contract C2006-180 by and between Weber County
and Siemens Building Technology to perform a preliminary energy conservation study of county
facilities; Chair Dearden seconded, both voting aye.
4. RAMP Agreement with the Utah Nordic Alliance/Ogden Nordic to provide funds
for the purchase of a snow cat and tiller - Contract C2006-181
David Wilson, Deputy County Attorney, stated that this had been part of the contract series for
issuance of RAMP funds. There had been questions relating to insurance and it was now believed
they had been settled the best way possible for both parties. This contract is different from the
other RAMP contracts because the county will own the snow cat and tiller. It will be used solely
to groom the cross country ski trails as specified in the contract and operated by the Alliance
volunteers, which the county will register as its volunteers so they can be insured by the county.
Commissioner Bischoff moved to approve Contract C2006-181, RAMP Agreement by and
between Weber County and the Utah Nordic Alliance/Ogden Nordic to provide funds for the
purchase of a snowcat and tiller; Chair Dearden seconded, both voting aye.
5. Contract with Five Chute Productions for the IMPRA Rodeo to be held on
November 17-18, 2006 at the Golden Spike Event Center
6. Contract with Five Chute Productions for the IMPRA Rodeo to be held on
January 26-27, 2007 at the Golden Spike Event Center
7. Contract with Five Chute Productions for the IMPRA Rodeo to be held on
February 16-17, 2007 at the Golden Spike Event Center
8. Contract with Five Chute Productions for the IMPRA Rodeo to be held on March
23-24, 2007 at the Golden Spike Event Center - Contracts C2006-182-C2006-185
Jim Harvey, GSEC, presented items F.5, 6, 7 & 8 together stating that Five Chute was the
promoter on all these items. It is the same contract except for different dates. This is the fifth year
contracting with this organization.
Commissioner Bischoff moved to approve Contracts C2006-182 through C2006-185 by and
between Weber County and Five Chute Productions for the IMPRA Rodeo to be held on
November 17-18, 2006; and January 26-27, 2007; February 16-17; and March 23-24 at the Golden
Spike Event Center; Chair Dearden seconded, both voting aye.
9. Ordinance to vacate the Kent Nichols Subdivision (1 lot) located at
approximately 5824 Snowbasin Road - Ordinance 2006-21
10. Final approval of the Berg/Weiss Subdivision (2 lots covering 9.0 acres that was
previously dedicated as a 1 lot Kent Nichols subdivision) located at 5824 (Old)
Snow Basin Road
Scott Mendoza, County Planning Department, presented items E.9 and 10 together. The Planning
Commission unanimously recommended approval. The Ken Nichols Subdivision contains 9 acres.
The petitioner will vacate it and further divide it into two lots of 4.5 acres and amend the buildable
area that was originally dedicated in this subdivision. The petitioner is able to amend that
buildable area because the engineers acquired more accurate information, which will allow two
homes to be built on the original 9 acre parcel.
The Berg/Weiss Subdivision will contain the 9 acres and the two lots. All utility, drainage, and
well protection easements will remain exactly as they were originally dedicated with the recording
of the Kent Nichols Subdivision. The only changes that will be made are the amendment to the
buildable area and there will be two lots rather than one.
Commissioner Bischoff moved to adopt Ordinance 2006-21 to vacate the Kent Nichols
Subdivision (1 lot) located at approximately 5824 Snowbasin Road; Chair Dearden seconded.

Commissioner Bischoff moved to grant final approval of the Berg/Weiss Subdivision (2 lots
consisting of 9 acres that was previously dedicated as a 1-lot Kent Nichols subdivision) located at
5824 (Old) Snow Basin Road; Chair Dearden seconded, both voting aye.
11. Resolution re-certifying the Weber County Justice Court - Resolution 29-2006
David Wilson, Deputy County Attorney, stated that this court was a single justice court. There are
interlocal agreements to serve Hooper, Marriott-Slaterville, and West Haven. The County
Attorney had reviewed the Court criteria, and will send a letter to the Judicial Council stating that
it meets the criteria. Judge Storey thanked the Commission for its support stating that this would
be the beginning of a sixth term for the Weber Justice Court.
Commissioner Bischoff moved to adopt Resolution 29-2006 re-certifying the Weber County
Justice Court; Chair Dearden seconded.

F. Public Hearing:
1. Commissioner Bischoff moved to adjourn the public meeting and convene the public hearing;
Chair Dearden seconded, both voting aye.
2. Public hearing on Community Development Block Grants
Dennis Richardson, County Engineering, stated that this public hearing was being held to supply
information regarding the 2007 Community Development Block Grant (CDBG) program, to solicit
possible projects that may be eligible for the funds, and to field suggestions and questions about
the projects from citizens.
The use of funds must meet one of the following National Objectives to be eligible: 1) project
needs to primarily benefit low to moderate income persons; 2) project needs to aid in the
prevention or elimination of slums or blight; 3) project needs to meet urgent needs because existing
conditions pose a serious and immediate threat to health and welfare. Eligible activities are
identified in the CDBG application guide and is available for review by interested parties.
Mr. Richardson explained that the Weber County area can expect approximately $570,000 in
CDBG funds for 2007 and that the Weber Area Council of Governments will rate and rank all
county-wide preliminary applications to determine what projects can proceed with final
application. All pre-applications must be submitted to the Wasatch Front Regional Council by
December 1, 2006.
The county currently has the following 5 active grant projects: 1) ADA improvements for
campsites located at North Fork Park, Memorial Park and Fort Buenaventura Park that has brought
campsites into ADA compliance; 2) replacement of door hardware at the Weber County
Fairgrounds with ADA compliant hardware; 3) Weber County Housing Authority is providing
funds to low income household for home repairs; 4) sponsoring Your Community Connection, a
non profit organization, and their project provides assistance to low income and disabled elderly
homeowners with critical yet minor home repairs to insure safety and livability in their own homes;
and 5) sponsoring the Ogden/Weber Community Partnership for construction assistance for
housing for the disabled. These are also examples of potential CDBG eligible activities.
Other examples for possible CDBG projects activities include: ADA improvements; public works
infrastructure projects in areas that would qualify; property acquisition; public services such as
food banks and homeless shelters; and loan programs for private businesses that hire low income
persons or for persons who own rental housing and rent to low income persons. Mr. Richardson
stated that all possible projects in which funding may be applied for are indicated in the regional
Consolidated Plan available for review in the Weber County Planning Office.
Possible county projects that were mentioned for the 2007 funding year could include ADA
improvements to trails around Fort Buenaventura and the old landfill site, other public works
infrastructure projects that might qualify such as storm water projects, and ADA restroom upgrades
for the north and south branch libraries.
Two non-profit agencies that were at the CDBG How to Apply Workshop were not in attendance
and were not expected to submit a pre-application for a grant.
Chairman Dearden invited public comments. Lynnda Wangsgard, Weber County Library Director,
provided more detail on their proposed ADA restroom project, such as remodel of restrooms to
comply with ADA standards, installing automatic door openers, and the installation of more vandal
resistant fixtures. No other comments or suggestions were given.

Chair Dearden seconded, both voting aye.

F.2. - Public hearing on Community Development Block Grants
No action was taken on this public hearing other than to proceed with pre-applications.
G. Assign Pledge of Allegiance & Thought of the Day for Tues., November 21, 2006, 10 a.m.
H. Public Comments:
Connie Chandler asked for an explanation of item D.7. David Wilson, Deputy County Attorney,
stated that there had been a problem with an employee and a vendor related to the sale of county
vehicles. The county tried to recoup as much money as possible and the County Attorney’s Office
pursued the dealer bond on this. After about one year of litigation, the parties agreed to settle at
$30,000.00 of the $50,000.00 bond.
