OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, October 17, 2006 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
Each Commission meeting is recorded on CD or audio tape, which is available to the public through the
County Clerk's Office.
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens
who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or
purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Craig L. Dearden, Chair; Camille T. Cain; and Kenneth A. Bischoff.

D. Consent Items:
1. Purchase Orders in the amount of $292,040.25

3. Set public hearing date for November 21, 2006, 10 a.m., to approve a road vacation proposal for
a portion of Wolf Creek Drive (S.R. 158) as part of a road realignment project

Commissioner Bischoff moved to approve the consent items; Commissioner Cain seconded, all
voting aye.
E. Presentation on the S.R. 108 Environmental Impact Statement (EIS)
Dave Kilmurray, Project Manager, HDR Engineering, stated that his firm had been hired by UDOT
to perform environmental studies on S.R. 108. The route goes through Weber and Davis
Counties–from 1900 W. in West Haven to Antelope Drive in Syracuse. It affects a few sections
of county property on the north end of the project. Also present were Heidi Spoor, Environmental
Manager for the project, and David Adamson with UDOT.
This project, initiated by UDOT, will look at alternatives to reduce congestion and improve safety.
At first observation, it appears that if there were to be any property takings in Roy due to the road
widening, that UDOT would only be taking the fronts off the properties (and not homes) because
most residential properties seem far enough from the road. UDOT’s objective is to provide a
transportation facility that is compatible with the overall plan of the region and is using various
methods to inform the public. The EIS process will take approximately two years. Commissioner
Cain asked Mr. Kilmurray if presentations had been made to city councils in Weber County and
he responded they had. Mr. Kilmurray said that the extension of Hinckley Drive was being
considered in the study.
F. Action Items:
1. Contract with Weber State University for D-1 & D-2 Hockey Games played at the
Weber County Ice Sheet during the 2006-2007 season - Contract C2006-167
Mike Caldwell, Ice Sheet, presented this standard contract that had been used for the past few
years.
Commissioner Cain moved to approve Contract C2006-167 by and between Weber County and
Weber State University for D-1 and D-2 Hockey Games to be played at the Weber County Ice
Sheet during the 2006-2007 season; Commissioner Bischoff seconded, all voting aye.
2. Contract with Utah High School Hockey for High School Hockey games played
at the Weber County Ice Sheet during the 2006-2007 season - Contract C2006-168
Mike Caldwell, Ice Sheet, Mike Caldwell, Ice Sheet, stated that pricing had been standardized this
year in the contract.
Commissioner Bischoff moved to approve Contract C2006-168 by and between Weber County and
Utah High School Hockey for High School Hockey games to be played at the Weber County Ice
Sheet during the 2006-2007 season; Commissioner Cain seconded, all voting aye.
3. agreement with Jacobsen Construction for Construction Manager/General
Contractor Service for the South Branch Library - Contract C2006-169
Lynnda Wangsgard, Library Director, stated that the Library Board had selected Jacobsen
Construction for this project. Jacobsen was the low bidder and their time frame for completion of
the library was also the shortest. Three bids had been received. Ms. Wangsgard gave statistics that
indicated the county’s library services were increasing and she stated that this new branch would
offer new services, including a consumer health information center. She noted that the ground for
the building site had been donated, Washington Terrace City was providing easements and
perpetual maintenance for some of the grounds on the parking facilities, bonds would be sold for
the actual construction, and the Library Development Board would be providing funding for
equipment and furniture. The building is expected to be completed by December 2007.
Monette Hurtado, Deputy County Attorney, stated that one of the reasons for selecting Jacobsen
was the time frame. The county had discussed with Jacobsen that instead of waiting for breach of
contract and pursuing actual damages, that actual damages be calculated and to add a liquidated
damages provision in this contract. She indicated that Jacobsen was agreeable to this.
Commissioner Cain noted the contract designated Ms. Wangsgard as the county’s representative
but normally for these types of contracts the Director of Operations was the designee and the
commissioners discussed continuing with current procedure. Nate Pierce, County Operations
Director, and Ms. Wangsgard will work closely on the project.
Commissioner Cain moved to approve Contract C2006-169 between Weber County & Jacobsen
Construction for Construction Manager/General Contractor service for the South Branch Library
with additional language for liquidated damages to be added by legal counsel and a change to
Section 4.2 to designate Nate Pierce, Operations Director, as the county’s representative;
Commissioner Bischoff seconded, all voting aye.
4. Agreement with Rocky Mountain Power for an Energy Analysis at the Kiesel
Facility - Contract C2006-170
Chief Deputy Gerald Cook, County Corrections, stated that Rocky Mountain would do an energy
analysis without charge to determine the potential for energy savings at the Kiesel Jail Facility.
The savings to the county are estimated at $13,000. Rocky Mountain would also provide an
incentive for the county to make the change and this is estimated at $7,500.
Commissioner Bischoff moved to approve Contract C2006-170, Letter of Intent by and between
Weber County and Rocky Mountain Power for an energy analysis at the Kiesel Facility;
Commissioner Cain seconded, all voting aye.
5. Agreement with Ogden City/Business Depot Ogden to allow BDO trucks access to
the BDO via the Fairgrounds Bill Bailey Boulevard - Contract C2006-171
Jennifer Graham, Recreational Facilities Director, stated that this was an extension of the contract
with Ogden City for them to continue using Bill Bailey Blvd. as access to the Business Depot for
many of their trucks. A study was conducted on the road by Bingham Engineering and Kelly
Hipwell, County Roads, also surveyed it. The road had held up well. The City widened some
corners for their large trucks, and this has helped the county as well for horse trailers. The county
is agreeable to try this agreement for another year while the city comes up with another solution
since the weight limit on 12th West restricts them from using that access.
Commissioner Bischoff moved to approve Contract C2006-171 by and between Weber County and
Ogden City/Business Depot Ogden to allow BDO trucks access to the BDO via the Fairgrounds
Bill Bailey Boulevard; Commissioner Cain seconded, all voting aye.
6. Contract with UDOT to allow UDOT to use our conduit to run fiber for Traffic
Link Cameras to 911 Dispatch - Contract C2006-172
Leonard Call, Information Technology Director, stated that this contract allowed UDOT to use a
small section of the county’s telecommunications conduit (currently vacant) to complete their
project.
Commissioner Cain moved to approve Contract C2006-172 by and between Weber County and
UDOT to allow UDOT to use county’s conduit to run fiber for Traffic Link Cameras to 911
Dispatch; Commissioner Bischoff seconded, all voting aye.
G. Public Hearings:
1. Commissioner Cain moved to adjourn the public meeting and convene the public hearings;
Commissioner Bischoff seconded, all voting aye.
2. Public hearing to discuss the U.S. Holdings Inducement Resolution
This item is scheduled for a public hearing on October 24, 2006.
3. Public hearing on ZP #16-2006 by Wolf Creek Properties to amend County Zoning
Ordinance to allow Yurts as an accessory to a ski resort & tubing hills in the
CVR-1 zone and adding a definition for Yurts to Chapter 18C making them an
exception to architectural standards requirements
Kevin Hamilton, County Planning Department, showed pictures of Yurts and addressed the
commissioners’ questions. He stated that a ski resort developer requested adding Yurts as an
accessory use to ski hills and tubing hills. The ordinance had exempted them because of building
materials and this amendment allows canvas or vinyl materials rather than wood or rock. The
Planning Commission recommended allowing Yurts with the caveat that they retain the power to
determine the number of Yurts to be allowed in a resort. This language will be added. Yurts will
only be allowed in a CVR-1 zone as an accessory. Currently, there is CVR-1 zoning at Powder
Mountain and at Wolf Mountain ski resorts. Chair Dearden invited public comments and none
were offered.

Commissioner Cain moved to adopt Ordinance 2006-20 amending Weber County Zoning
Ordinance to allow Yurts as an accessory to a ski resort and tubing hills in the CVR-1 zone and
adding a definition for Yurts to Chapter 18C making them an exception to architectural standards
adding language stating that the Planning Commission shall determine the number of Yurts in any
given resort; Commissioner Bischoff seconded.
