OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, May 23, 2006 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
Each Commission meeting is recorded on CD or audio tape, which is available to the public through the
County Clerk's Office.
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk
records in the minutes the names of all citizens
who appear and speak at a County Commission meeting
and the substance “in brief” of their comments. Such statements may include opinion or
purported facts.

pursuant to state law.
Commissioners Present: Craig L. Dearden, Chair, Camille T. Cain, and Kenneth A. Bischoff.

D. Consent Items:
1. Purchase Orders in the amount of $57,088.14

Commissioner Cain moved to approve the consent items as presented; Commissioner Bischoff
seconded, all voting aye.
E. Presentations:
1. Statement of Support of the National Guard and Reserve
Weber County Sheriff Brad Slater introduced William Wrappley with Employer Support of the
Guard and Reserve (ESGR). Mr. Wrappley recognized and introduced many that were present.
Scott Baker, ESGR’s Employer Outreach Representative, outlined some of the rights we have as
Americans noting that our country has some men and women putting their lives on the line to
protect those rights. Approximately 40% of those protecting us are members of the National
Guard or of a Reserve Unit and when they get called up one of the entities affected is the
employer. Mr. Baker noted that when a reservist from the Sheriff’s Office gets called up it takes
an officer away that was protecting the community. ESGR tries to identify those companies that
hire Guardsmen and Reservists to ensure they understand regulations that pertain to these men and
women and honors them. In this case, the ESGR identified the Sheriff’s Office and the way they
take care of their family in the Reserves, going above and beyond the requirements.
Mr. Wrappley stated that today we were witnessing the pledge of that support with the signing of
a “5-Star” Statement of Support as well as receiving the Above and Beyond Award by the Weber
County Sheriff’s Office. Retired Brigadier General James G. Martin congratulated Sheriff Slater,
invited him to sign the “5-Star” Statement, and presented him with the Above and Beyond Award.
Less than 1% of employers of Guardsmen and Reservists in the U.S. have achieved this level of
recognition by the Department of Defense. Sheriff Slater stated that these men and women come
back with additional training, knowledge, and discipline and excelled in their regular jobs. He
thanked the Commission for supporting the men and women of the Sheriff’s Office who also wear
the uniform for the military. Chair Dearden commended the Sheriff for helping these men and
women in the military.
2. Presentation of Kevin Burton, new Captain at County’s Correction Facility
Weber County Sheriff Brad Slater recognized Kevin Burton in his advancement to Captain.
Sheriff Slater thanked Captain Burton’s wife, Patty, for her support. Captain Burton expressed
appreciation for the support he has received from his office.
3. Presentation on 2006 Governor’s Quality Growth Award of Merit for Planning
Design
Jim Gentry, County Planning Department, stated that this year the Recreation Element project of
the Ogden Valley General Plan had won an award at the Utah Governor’s Quality Growth
Commission where they recognized exemplary projects and communities that keep Utah beautiful,
prosperous and neighborly for future generations. Commissioner Cain said it was wonderful that
the award had been noted by the Governor, Quality Growth, and Envision Utah because something
great had been done for the citizens of Weber County and it was something to be proud of. The
three commissioners thanked Mr. Gentry and Kevin Hamilton for their efforts.
F. Action Items:
1. Appointments to the Hooper Cemetery Maintenance District
Chair Dearden said that some issues had arisen with appointments to the Hooper Cemetery
Maintenance District and the county advertised and accepted applications to bring the District into
compliance. Eight applications were received and the commissioners discussed the qualifications.
The Attorney’s Office will help notify the District of today’s action and of term expirations.
Commissioner Bischoff moved to appoint LaGrande Belnap for a 2-year term, Mark Wayment and
Sheri Leak for 4-year terms on the Hooper Cemetery Maintenance District; Commissioner Cain
seconded, all voting aye.
2. Approval of the final reading of proposed amendments to the Local Sales and Use
Tax (“RAMP Tax”), Title 24-7, to fund Recreational Facilities and Cultural
Organizations including Arts, Museums and Parks - Ordinance 2006-11
David Wilson, Deputy County Attorney, noted that this ordinance had been reviewed last week.
He recapped that the Advisory Board had recommended changing the names of the Committees,
the expiration of the term, and adding a provision allowing excess funds for projects to be
reallocated to other projects.
Commissioner Cain moved to adopt the final reading of Ordinance 2006-11, proposed amendments
to the Local Sales and Use Tax (“RAMP Tax”), Title 24-7, to fund Recreational Facilities and
Cultural Organizations including Arts, Museums and Parks; Commissioner Bischoff seconded.

Jim Gentry, County Planning Department, noted that the public hearing on this item had been held
last week. Both the ordinance and Zoning Development Agreement had been reviewed by legal
counsel.
Commissioner Bischoff moved to adopt Ordinance 2006-12, Ordinance of the Board of County
Commissioners of Weber County rezoning property at 2640 North Highway 162, from AV-3 to
Commercial CV-2and Zoning Development Agreement C2006-57; Commissioner Cain seconded.

Sean Wilkinson, County Planning Department, stated that the public hearing on this item had been
held last week. This ordinance had been reviewed by legal counsel.

Commissioners of Weber County rezoning property at 2640 North Highway 162, from AV-3 to
Commercial CV-2; Commissioner Cain seconded.

5. Approval of an Ordinance of the Board of Commissioners of Weber County
rezoning property at 3600 N. Wolf Creek Drive from Forest Residential FR-3 to
Commercial Valley CV-2 - Ordinance 2006-14, Contract C2006-58
Kevin Hamilton, County Planning Department, stated that this rezoning would allow Wolf Creek
Properties to build a Welcome Center/Sales Office in the area of Moose Hollow of the Wolf Creek
Resort. A public hearing on this item was held May 16, 2006 and the County Commission found
that it conformed to the goals and objectives of the Ogden Valley General Plan. The Planning
Commission had recommended approval on March 28, 2006.
Commissioner Cain moved to adopt Ordinance 2006-14, Ordinance of the Board of
Commissioners of Weber County rezoning property at approximately 3600 N. Wolf Creek Drive
from Forest Residential FR-3 to Commercial Valley CV-2; Commissioner Bischoff seconded.

6. Request for approval of additional members for a Stakeholders Committee to
work with Bio-West on the development of the Transfer of Development Rights,
Sensitive Lands, and Recreation Resort Zone Ordinances
Kevin Hamilton, County Planning Department, presented additional members to the Stakeholders
Committee as discussed at the 5/2/2006 Commission meeting. They are as follows: Jamie
Lythgoe (representing the Cobabe family); Abbot Casimir Bernas (Monastery); Jim Ormsbee
(Ogden Valley Business Assn.); Ron Gault (Town of Huntsville); Marion Horna (Ogden Valley
Pathways); Sharon Holmstrom (Ogden Valley Township Planning Commission); Shanna Francis
(Ogden Valley Land Trust); and as backups Jack Cox (Town of Huntsville) and Paul Delong
(Weber Pathways). The Eden Planning Committee had asked that Kirk Langford represent them.
Mr. Langford also represents land owners/ski industry.
Commissioner Cain moved to appoint the additional members to the Stakeholders Committee to
work with Bio-West on the development of the Transfer of Development Rights, Sensitive Lands,
and Recreation Resort Zone Ordinances; Commissioner Bischoff seconded, all voting aye.
