OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, May 2, 2006 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk

Commissioners Present: Craig L. Dearden, Chair, and Kenneth A. Bischoff. Camille T. Cain was

Commissioner Bischoff moved to approve the consent items; Chair Dearden seconded, both
voting aye.
E. Presentation of the Seal of Service Award to Lynette Jeppeson from the Weber
County Clerk/Auditor’s Office
Chair Dearden read the nomination submitted for Ms. Jeppeson. Linda Lunceford, Weber County
Clerk/Auditor, stated that Lynette was a great employee and had great patience and compassion
with the public. The commissioners congratulated Ms. Jeppeson for her excellence in customer
service and presented her with an obelisk, a seal of service pin, a plaque and $50. Ms. Jeppeson
stated her appreciation for those she worked with.
F. Action Items:
1. Interlocal Agreement with the Roy City Fire Department for the provision of
paramedic services - Contract C2006-47
Brad Dee, Human Resources Director, presented this item. This agreement will be in effect from
1/1/2006 to 12/31/2010 and the City of Roy agrees to provide paramedic services not only to the
City of Roy but also to the northwest and southwest portions of the county. The City agrees to
employ a minimum of eight paramedics to provide that service and to run a central unit as well as
a back-up unit. Mr. Dee addressed the commissioners’ questions. Weber County will pay the City
$304,584 for 2006 for one paramedic unit and one back-up unit and the annual compensation may
be renegotiated. Chief Ritchie stated that Roy City had been in partnership with Weber County
and Ogden City since 1988 for provision of this service, which was well recognized throughout
the State as a number one provider.
Commissioner Bischoff moved to approve Contract C2006-47, Interlocal Agreement by and
between Weber County and the Roy City Fire Department for the provision of paramedic services;
Chair Dearden seconded, both voting aye.
2. Request from Weber Pathways for assistance from the County concerning public
rights and usage of pathways along the east bench and canyons in Weber County
Mary Hall, Vice Chair of Weber Pathways, stated Weber Pathways’ mission which was to
promote, plan and preserve a network of non-motorized public pathways and related open spaces.
Ms. Hall presented Weber Pathways’ request that the County Commission ask its legal department
to assess the status of the county’s constituents public rights along trails on the east bench of
Ogden, including but not limited to the Taylor Canyon, Waterfall Canyon, Bonneville Shoreline
Trail and various connecting trails. In response to Chair Dearden’s request not to delay on this
issue, David Wilson, Deputy County Attorney, noted that the process of researching prescriptive
easements could take some time, however, the previous Surveyor had started working on this item
and the Attorney’s Office could give a better timeline after evaluating the work needed. The
Attorney’s Office will work with the Recorder and/or Surveyor’s Office to establish their opinion.
The Commission directed the County Attorney’s Office to move forward with the research and to
get in touch with Ms. Hall regarding a timetable for completion.
3. Request for approval to waive penalty and/or interest for applicable 2005 deleted
parcels and those with description changes
Roger Brunker, County Recorder’s Office, explained that each year there were property
combinations and segregations, which created new parcels. A problem occurs when the original
parcels go delinquent if taxes are not paid and the newly created parcels are encumbered by those
old delinquent taxes. Each year the County Recorder’s Office compiles a list of all those properties
that have had description changes in the previous year, and the ones that have delinquencies
attached to them. The property owners affected by this are then notified that there are
delinquencies on their properties and are given an opportunity to clear them up without being
charged penalties and interest since it is the first notification. The Tax Review Committee
reviewed this item and unanimously recommended allowing the Treasurer and Recorder’s Office
to work together to waive the charges, in appropriate situations, for those who wish to pay.
Commissioner Bischoff moved to waive penalty and/or interest for applicable 2005 deleted parcels
and those with description changes; Chair Dearden seconded, both voting aye.
4. Request to approve the first reading of an Ordinance of Weber County placing a
fee on uncovered or unsecured solid waste loads delivered to the Weber County
Transfer Station
Gary Laird, Transfer Station Manager, stated that most transfer stations and landfills had an
ordinance charging a fee for those who arrive without their loads being covered. This is to try to
keep from littering the streets in transit to the transfer station/landfill. Commissioner Bischoff
asked about differentiating between various loads and that the language in item #5 be such as to
include a variety of materials without having to list every single one. Chair Dearden noted item
#4 which exempted certain materials (i.e., dirt, rocks, concrete & asphalt) if any of these or a
combination of these constituted 100% of the load. He also pointed out a typographical error in
item #5. David Wilson, Deputy County Attorney, suggested adding bricks and blocks and other
such materials.
Commissioner Bischoff moved to approve the first reading of this ordinance with the additional
items discussed; Chair Dearden seconded, both voting aye.
5. Contract with Shawn Poulsen to perform as a hypnotist at the 2006 Weber County
Fair - Contract C2006-48
Jan Wilson, Weber County Fair, briefly presented this item. The contract amount is $1,600.
Commissioner Bischoff moved to approve Contract C2006- 48 by and between Weber County and
Shawn Poulsen to perform as a hypnotist at the 2006 Weber County Fair; Chair Dearden seconded,
both voting aye.
6. Contract with Great Basin Antique Machinery to have antique farm machinery
on display at the 2006 Weber County Fair - Contract C2006-49
Jan Wilson, Weber County Fair, briefly presented this item. The contract amount is $800.
Commissioner Bischoff moved to approve Contract C2006-49 by and between Weber County and
Great Basin Antique Machinery to display antique farm machinery at the 2006 Weber County Fair;
Chair Dearden seconded, both voting aye.
7. Contract with Northern Utah Prospectors Association for the NUPA Gold Show
to be held May 20 & 21, 2006 at the Golden Spike Event Center - Contract C2006-50
Jim Harvey, GSEC, presented this standard contract.

Northern Utah Prospectors Association for the NUPA Gold Show to be held on May 20 & 21,
2006 at the Golden Spike Event Center; Chair Dearden seconded, both voting aye.
8. Contract with Haul’n Ads for a Business to Business Expo held on April 29, 2006 at
the Golden Spike Event Center - Contract C2006-51
Jim Harvey, GSEC, presented this standard contract.

Haul’n Ads for a Business to Business Expo held on April 29, 2006 at the Golden Spike Event

9. Request for approval of a final reading on Zoning Petition #02-04 amending the
Uniform Zoning Ordinance of Unincorporated Weber County - Chapter 22B,
Cluster Subdivision - Ordinance 2006-8
This amendment makes major changes to bonus density allowances and open space requirements.
Kevin Hamilton, County Planning Department, noted that a public hearing had been held on April
18, 2006 on this item. At that time the Commission had requested one change to the proposed
ordinance, which was to remove the word insurance from the homeowners association
requirements. Both township planning commissions recommended approval of this item with the
request that there be a review of the 30% density bonus when the development of the Transfer of
Development Rights ordinance process is complete.
Commissioner Bischoff moved to adopt Ordinance 2006-8 on Zoning Petition #02-04 amending
the Uniform Zoning Ordinance of Unincorporated Weber County - Chapter 22B, Cluster
Subdivision; Chair Dearden seconded.

10. Request for approval of a final reading on Zoning Petition #11-04 amending the
Uniform Zoning Ordinance of Unincorporated Weber County, Chapter 42,
Accessory Apartments - Ordinance 2006-9
This new Chapter allows for accessory apartments as a conditional use under certain
circumstances. Kevin Hamilton, County Planning Department, noted that a public hearing had
been held on April 18, 2006 on this item and the Commission had requested changes in the floor
area requirement. At that time the proposed ordinance had 800 square feet as the maximum floor
area but the Commission felt that requests should be reviewed on a case by case basis. The new
floor area language states that the accessory apartment shall be subordinate in floor area to the
principal dwelling and not consist of more than two bedrooms. The other non substantive errors
had also been corrected. Both township planning commissions recommended approval of this
item. Commissioner Bischoff agreed with the new floor area language noting that the original
proposed language stating specific footage would put many people out of compliance and was not
appropriate in all cases.

Margarit Nersisian, Clerk/Auditor’s Office, stated that the above cases had financial hardships and
several had experienced serious medical problems causing them to be in arrears in their property
tax payments. Ms. Nersisian stated that all of these items had been before the Tax Review
Committee and were approved. All petitioners had signed extension agreements and will be
making monthly payments. She pointed out that the request by Carl/Eva Barney was for over
$118,000 with penalties and interest. This was for a retirement center and had been approved
because it was a primary residence for those residing there. The other item she noted was for
Anthony Carrera. He was the 100% disabled veteran who had missed the tax relief application
deadline three years ago. At that time she had contacted the Veterans Affairs to request assistance
for Mr. Carrera but had been unsuccessful. Mr. Carrera had missed the filing period again. Ms.
Nersisian had now been able to discuss this with a Salt Lake City VA representative who stated
he would contact someone locally to assist Mr. Carrera with this process.

090900008 for Allen & Rosa Ermer; 092450028 for Jolene Tresden; 110090002 for Robert Clyde
& Denise Sattiewhite; 130340020 for Anthony Carrera; 140270009for Peggy Clapp; and
210600004 for Lynda & David Hoffman; Chair Dearden seconded, both voting aye.
12. Request for approval of a Stakeholders Committee to work with Bio-West on the
development of the Transfer of Development Rights, Sensitive Lands, and
Recreation Resort Zone ordinances
Kevin Hamilton, County Planning Department, noted that there had been discussions with Bio-
West last week and they were ready to move forward with this process. Three more land owners
of substantial land holdings in the Ogden Valley who live on the land are being sought for this
committee to provide their perspective.
Mr. Hamilton addressed Commissioner Bischoff’s question regarding how the Stakeholders
Committee members had been selected. These individuals had participated over the years on
issues relating to the Ogden Valley and provided diverse philosophies regarding land development.
Mr. Hamilton noted that Pam Kramer, Division of Wildlife Resources, attended all the meetings
and had been very helpful in determining wildlife habitat and issues in the Valley. The list also
indicated organizations that should have representation on the committee and which would need
to assign individuals to participate.
Commissioner Bischoff expressed appreciation for everyone working together to move the process
along efficiently.
Commissioner Bischoff moved to appoint the following listed members to the Stakeholders
Committee to work with Bio-West on the development of the Transfer of Development Rights,
Sensitive Lands, and Recreation Resort Zone ordinances: Joan Blanchard, Randy Shepherd, Jeff
Burton, Kirk Langford, Kim Wheatly, Steve Roberts, Mark Arnold, Denzel Rowland, and Pam
Kramer and to include those organizations as listed to present names for the Commission to
appoint; Chair Dearden seconded, both voting aye.
Canceling Commission Meeting for May 9, 2006
Commissioner Bischoff moved to cancel the meeting for May 9, 2006 due to lack of a quorum;

G. Assign Pledge of Allegiance & Thought of the Day for Tuesday, May 16, 2006, 5:30 p.m.
H. Public Comments:
Ralph Taylor, of Ogden and representing Jack McDonald who is the head of the Union Station
Foundation, invited the commissioners and all the citizens of the County to attend Golden Spike
Week from May 8-13, 2006 which primarily deals with the re-enactment of the joining of the
railroads at Promontory Point in 1869. Mr. Taylor outlined the various organizations that belong
to the Golden Spike Forum and the activities for that week occurring in Ogden, Snow Basin,
Promontory Summit, Tremonton, and Antelope Island State Park.
