MINUTESOF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, January 24, 2006 - 10:00 a.m.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk
records in the minutes the names of all citizens
who appear and speak at a County Commission meeting

Commissioners Present: Craig L. Dearden, Chair; Camille T. Cain; and Kenneth A. Bischoff.

Commissioner Bischoff moved to approve the consent items; Commissioner Cain seconded, all
voting aye.
E. Action Items:
1. Contract with Loomis, Fargo & Co., for cash pick up & drop services - Contract
C2006-9
John Bond, County Treasurer’s Office, stated that this contract had been ongoing for years with
Loomis, Fargo & Co. The 2005 contract cost was $385.79 and remains the same for 2006. The
cost includes $20 for insurance as well as service for the Assessor’s Office.
Commissioner Bischoff moved to approve Contract C2006-9 by/between Weber County
&Loomis, Fargo & Co., for cash pick up and drop services; Commissioner Cain seconded, all
voting aye.

Final approval of The Summit at Ski Lake Phase 10 Subdivision and acceptance of
a financial guarantee of $57,469.23
Sean Wilkinson, County Planning Department, stated that this phase consisted of two lots located
at approximately 1400 S. 6550 E. and the Planning Commission had voted unanimously to
approve this item. Mr. Wilkinson said that some minor issues regarding the improvements had
been discussed with County Engineering and the developer and would be taken care of.
Commissioner Cain moved to grant final approval of The Summit at Ski Lake Phase 10
Subdivision and to accept a financial guarantee in the amount of $57,469.23; Commissioner
Bischoff seconded, all voting aye.
3. Agreement with Ogden City/Business Depot Ogden to allow BDO truck traffic
Fairgrounds through August 15, 2006 - Contract C2006-10
Jennifer Graham, Recreation Facilities Director, stated that this agreement allowed Ogden City
(City) to use Bill Bailey Blvd. and 9th West to access BDO on a temporary basis through August
2006. However, the county has an option to terminate with written notice at any time. The City had
been without good access since Marriott-Slaterville started the weight limit of 10,000
lbs. on 1200 W. The intent of this agreement is to help the City while they continue negotiations
with Marriott-Slaterville regarding road repair. The road will be periodically closed and the county
will provide reasonable notification to the City. Ms. Graham addressed the commissioners’
questions stating that there was significant truck traffic going through there, that the City’s
engineer and the County Roads Department would assess the condition of the road, and the City
will complete the work to restore the road to the condition of the Original Report.
Commissioner Cain moved to approve Contract C2006-10 by and between Weber County and
Ogden City/Business Depot Ogden to allow BDO truck traffic through August 15, 2006;
Commissioner Bischoff seconded, all voting aye.
4. Contract by and between Weber County and the Utah State University Extension
for Agricultural Extension Services - Contract C2006-11
Jerry Goodspeed, USU Extension, presented this annual contract renewal. The total contract
amount is $202,860.00.
Commissioner Bischoff moved to approve Contract C2006-11 by and between Weber County and
the Utah State University Extension for agricultural extension services; Commissioner Cain
seconded, all voting aye.
5. Confirming appointment of Judge Stanton M. Taylor to the Weber Human Services
Governing Board
David Wilson, Deputy County Attorney, noted that the Weber County Commission had approved
the tentative appointment of Judge Taylor on December 13, 2005. In accordance with the
Interlocal Agreement creating Weber Human Services, the proposed appointment was sent to
Morgan County for approval or rejection by the county council. Morgan County approved the
appointment on December 20th, but did not give immediate notice to Weber County. Given the
Morgan County Council’s approval, the commission may confirm the appointment by a simple
motion and forward minutes of this meeting to Weber Human Services for their records.
Commissioner Bischoff moved to confirm the appointment of Judge Stanton M. Taylor to the
Weber Human Services Governing Board; Commissioner Cain seconded, all voting aye.
6. Ordinance of Weber County consolidating the offices/functions/duties of County
Surveyor &Recorder, Creating the Position of Weber County Surveyor/Recorder
Chair Dearden stated that discussion regarding consolidation had occurred for a few years with the
intent to save money and for efficiency and after review, it appears these can be achieved. He
spoke yesterday with Doug Crofts, County Recorder, and with Martin Moore, County Surveyor,
and they had not expressed any concerns at that time.
Mr. Crofts stated that discussion had occurred regarding combining different offices over the past
few years and he believed it was a good idea anytime the leaders could make decisions to save the
taxpayers money. Out of the 29 counties in the State, there are 10 elected Surveyors, 9 have no
designated elected Surveyor, 10 have combined the Surveyor’s Office with another office in the
county, and of those combinations 8 have been with the County Recorder as Recorder/Surveyor.
He suggested that Weber County also designate it as Recorder/Surveyor not as Surveyor/Recorder
as written in the draft ordinance because the Recorder’s position seemed to remain the prime
position of that office with the Recorder becoming responsible to contract out survey work to
private contractors in the county under the direction of the executive committee. Commissioner
Bischoff asked if Mr. Crofts’ understanding was that the Surveyor would be employed within that
office and Mr. Crofts said that if there was contract work done outside the county it had to be
contracted out and there were situations in the State Code where a licensed surveyor did not have
to be hired within the county. He had spoken with the current president of the Recorders
Association, who was also the Millard County Surveyor. She did not have an employee who was
a licensed surveyor but contracted out to the local surveyors in the county. He said that the
Surveyors’ Code stated that the Recorder became the depository for all surveys done in the county
and collected the fees for surveying.
Ernest Rowley, County Surveyor’s Office, said he did not oppose combining the offices but that
State Code § 17-23 declared that if a county did not have an elected official who qualified as a
licensed surveyor, then the county had the option to contract those services. Because these two
offices were being combined not dissolved, he believed the individual holding that office would
have to be a licensed land surveyor.
This item will be placed on next week’s agenda.
Commissioner Bischoff moved to approve the first reading of this ordinance to consolidate the
offices of Weber County Surveyor and Weber County Recorder; Commissioner Cain seconded.

F. Assign Pledge of Allegiance & Thought of the Day for Tues., January 31, 2006, 10 a.m.
G. Public Comments:
Connie Chandler asked if consolidating the two offices (item E.6.) should go to a public hearing, if the
recorder/surveyor position would have to be licensed, and noted she had not seen a cost analysis and
that there had been many problems with property owners’ boundary lines, though she did not know
if this resulted from private or county surveying. David Wilson, Deputy County Attorney, stated that
no public hearing was required, that if this change was effected, it would give notice to those who
wished to file for the office, and in November one person would be elected to the office. Mr. Wilson
also stated that the County Attorney’s Office had issued an opinion that a licensed surveyor was not
required for the combined position. There are some survey requirements that necessitate a licensed
surveyor but that surveyor can either be employed in the office or be an outside contract. This
ordinance version stated that the person would be employed in the office because there was an already
an existing surveying office. Chair Dearden stated that just by eliminating one elected position created
a considerable savings, plus there may be elimination of clerical staff duplication, etc. Ms. Chandler
said that the position of surveyor was very important and she did not want to see those duties
downgraded. Mr. Rowley stated that the County Surveyor was responsible to review subdivision plats
and sometimes there were some issues regarding property lines that needed to be corrected, but, in his
opinion, the vast majority of problems with boundaries were a result of processes created in the
Recorder’s Office relating to how they dealt with remaining parcel descriptions.
