1. Contract with Five Chute Productions for the IMPRA Rodeo to be held November 18-19, 2005 at the Golden Spike Event Center - Contract C2005-136
Jim Harvey, GSEC, gave a brief overview of this standard contract.
Commissioner Cain moved to approve contract C2005-136 by and between Weber County and Five Chute Productions for the IMPRA Rodeo to be held on November 18-19, 2005 at the Golden Spike Event Center; Commissioner Dearden seconded, all voting aye.
2. Ratify contract with Layton High School for the Harvest Ball held on October 14, 2005 at the Golden Spike Event Center - Contract C2005-137
Jim Harvey, GSEC, gave a brief overview of this standard contract.
Commissioner Dearden moved to ratify Contract C2005-137 by and between Weber County and Layton High School for the Harvest Ball held on October 14, 2005 at the Golden Spike Event Center; Commissioner Cain seconded, all voting aye.
3. Resolution approving an Interlocal Agreement by & among Box Elder County, Logan City, Wasatch Integrated Waste Management District & Weber County to explore the feasability of a jointly run landfill - Resolution 36-2005, Contract C2005-138
Gary Laird, Transfer Station Manager, stated that this contract was between five counties–that Wasatch Integrated Waste Management District was a special service district that represented parts of Morgan and Davis Counties. The purpose of this contract is to look at the possibility of a site in Box Elder County for a jointly run landfill in an effort to find cost effective options.
Box Elder County, Logan City, Weber County and the Wasatch Integrated Waste Management District will each contribute $20,000 to cover the cost of the study.
Commissioner Cain moved to adopt Resolution 36-2005 approving Interlocal Agreement C2005-138 by and among Box Elder County, Logan City, Wasatch Integrated Waste Management District and Weber County for the purpose of exploring the feasability of a jointly run landfill; Commissioner Dearden seconded.

8. Resolution approving Interlocal Agreement by/among Weber County, Weber County Housing Authority & the Housing Authority of Ogden City, Utah, relating to the Provision of Homeless Housing Development - Resolution 37-2005, Contract C2005-139
This item was handled at this time to accommodate the presenter's schedule. Susan Manning, Director of the Housing Authority of Ogden City, stated that Ogden City had an agreement with Weber County since about 1982 to administer the county's voucher program for 123 units of assisted housing. There are agreements with all of the incorporated cities in the county to be able to use the vouchers in those areas. The Weber County Homeless Coordinating Committee has been formed to implement locally the State's 10-year plan to end chronic homelessness and a task force was formed for the Weber County Chronically Homeless Pilot Program. Commissioner Cain explained that in connection with this pilot program, under this contract the County Housing Authority authorizes the Ogden Housing Authority to receive and use funds to implement the pilot program within Weber County.
Commissioner Dearden moved to adopt Resolution 37-2005 approving Interlocal Agreement C2005-139 by and among Weber County, the Weber County Housing Authority and the Housing Authority of Ogden City relating to the provision of the Homeless Housing Development; Commissioner Cain seconded.

4. Contract by/between the Weber County Attorney's Office & the Utah Attorney General's Office to purchase Children's Justice Center Service
Because this item is the same as item 5 below, it was struck off the agenda.
5. Agreement by/between Utah Attorney General's Office & Weber County through Weber County's Office for funding of the Weber/Morgan Children's Justice Center - Contract C2005-140
Mark DeCaria, County Attorney, stated that the County Attorney's Office oversees the Children's Justice Center (CJC). The CJC is essentially funded by the State and this year's allotted amount is $248,724, which includes some rollover from last year. Mr. DeCaria said that the contract was the same as in past years. Commissioner Dearden expressed appreciation for what the AG's Office did for the CJC, however, he felt that the AG's Office was exercising too much control over the CJC and dictating what the county could do, when the AG's Office simply passed the funds on to the CJC. He would prefer the CJC to be placed under the CCJJ, Criminal Justice, etc., and believed that a legislative or county audit would be more appropriate. Mr. DeCaria said that the AG's Office lobbied the legislature for continuing funding for the CJCs across the State and developed a mission for CJCs to make sure they were managing their case loads in a uniform fashion and spending the funds appropriately. Mr. DeCaria said that he would have no objection in placing the CJC under a different agency for some of the reasons referred to by Commissioner Dearden as well as other CJCs across the State.
Commissioner Dearden moved to approve Contract C2005-140 by and between the Utah Attorney General's Office and Weber County through the Weber County's Office for funding of the Weber/Morgan Children's Justice Center; Commissioner Cain seconded, all voting aye.
6. Request to approve Agreement by/among the Advance PCS Health L.P., the National Association of Counties, & Weber County for provision of certain pharmaceutical services to the residents of Weber County

7. Agreement by/between Weber County & Taylor-West Weber Water District for sewer service assistance - Resolution 38-2005, Contract C2005-141
Curtis Christensen, County Engineer, stated that a few years ago the county had gotten into the waste water collection business. One concern that had been initially raised was the ability to bill users of the service. A billing system was set up, however, enforcement can sometimes become difficult. Mr. Christensen had contacted the Taylor-West Weber Water District to help with this concern and they have agreed to enter into an agreement with the county to shut off water service if the user does not pay the bill. The county will go through a process to notify the user in this case.
Commissioner Cain moved to adopt Resolution 38-2005 approving Contract C2005-141 by and between Weber County and Taylor-West Weber Water District for sewer service assistance; Commissioner Dearden seconded.

9. Extension of a Warranty Agreement by/ between Weber County (Health Department) & Schindler Elevator Corporation for elevator maintenance - Contract C2005-142
Nate Pierce, County Operations Director, presented this extension agreement for elevator maintenance in the Weber-Morgan Health Department. The contract amount is $278/month.
Commissioner Dearden moved to approve Contract C2005-142, extension of a Warranty Agreement by and between the Weber County (Health Department) and Schindler Elevator Corporation for elevator maintenance; Commissioner Cain seconded, all voting aye.
10. Final subdivision approval of Lakeside Village, Phase 11, Condominium Plat, 8 units, including a financial guarantee in the amount of $14,928.00 for improvements
Kevin Hamilton, County Planning Department, stated that this condominium project was located on the south shore of Pineview Reservoir. The Planning Commission unanimously recommended approval of this item. The financial guarantee is mostly for landscaping.
Commissioner Cain moved to grant final subdivision approval of Lakeside Village, Phase 11, Condominium Plat, consisting of 8 units, including a financial guarantee in the amount of $14,928.00 for improvements; Commissioner Dearden seconded, all voting aye.
11. Request for approval of Amendments to the Claims Processing Procedures

12. Approval of appointments to the Planning Commissions
Kevin Hamilton, County Planning Department, stated that there was one vacancy each in the two Township Planning Commissions. After advertising in the newspaper, one application was received for each Planning Commission and Mr. Hamilton requested appointment of these individuals.
Commissioner Dearden moved to appoint Greg Graves to the Ogden Valley Township Planning Commission and Jeffery Davis to the Western Weber County Township Planning Commission with terms expiring 05/04/2009; Commissioner Cain seconded, all voting aye.
13. Adoption of the 2006 Tentative Budget
Dan Olsen, County Comptroller, outlined the statute and the process for budget adoption and asked for formal adoption of the county's tentative budget. Mr. Olsen stated that the budget had no general property tax increase proposed. The budget will be available on the county's website as of today. The budget for the public hearing will be set next week for November 29 at 6 p.m. The commissioners noted that internal changes may be made to the tentative budget before final adoption, but that any changes will be internal and will not result in an increase in taxes.
Commissioner Cain moved to adopt the 2006 tentative budget as presented; Commissioner Dearden seconded, all voting aye.
