In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance "in brief" of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Craig L. Dearden, Vice Chair, and Camille T. Cain. Kenneth A. Bischoff, Chair, was excused. Commissioner Dearden conducted the meeting.

Commissioner Cain moved to approve the consent items, holding the minutes; Commissioner Dearden seconded, both voting aye.
E. Presentation of the Seal of Service Award to Jan Wilson
Commissioner Dearden read the nomination for this seal of service submitted by Leann Kilts for Ms. Wilson, the Weber County Fair Manager. The commissioners thanked Ms. Wilson for her hard work and dedication. She was presented with $50, a seal of service pin, an obelisk and a plaque.
F. Action Items:
1. Resolution authorizing the execution and delivery by Weber County, Utah (the ‘County') of an Escrow Agreement among the County, Zions First National Bank, as escrow agent and IHC Health Services, Inc., to provide for the payment of the principal of and interest on the County's Hospital Revenue Bonds, Series 1999 (IHC Health Services Inc.) as the same shall become due - Resolution 27-2005
James Matsumori stated that in 1999 the IHC Health Services issued some bonds through Weber County. Mr. Matsumori explained that even though the county's name was on the documents as the official issuer of the debt, the debt was secured by the revenues of IHC, which financed health care facilities throughout the State of Utah, including Weber County.
IHC was now requesting to pay off those bonds because they can obtain a better financing package. IHC will set up an escrow account and will completely defease the bonds.
Commissioner Cain moved to adopt Resolution 27-2005 authorizing the execution and delivery by Weber County, Utah (the ‘County') of an Escrow Agreement among the County, Zions First National Bank, as escrow agent and trustee, and IHC Health Services, Inc., to provide for the establishment of a Trust Fund for the payment of the County's Hospital Revenue Bonds, Series 1999 (IHC Health Services Inc.); repealing all ordinances, resolutions or portions thereof in conflict with the provisions hereof; and related matters; Commissioner Dearden seconded.

2. Contract by and between Weber County and Utah State Snowmobile Racing Association for the 2005 Racing Season Event to be held on August 20, 2005 at the Golden Spike Event Center - Contract C2005-109
Jim Harvey, GSEC, presented items F.2 through F. 5. together because they are the same contract but with different dates for the event. This is the second year for this contract.
3. Contract by and between Weber County and Utah State Snowmobile Racing Association for the 2005 Racing Season Event to be held on September 17, 2005 at the Golden Spike Event Center - Contract C2005-110

Commissioner Cain moved to approve Contracts C2005-109 through C2005-112 by/between Weber County and Utah State Snowmobile Racing Association for the 2005 racing season event to be held August 20, September 17, October 15 and November 5, 2005, respectively; Commissioner Dearden seconded, both voting aye.
6. Contract by and between Weber County and the State of Utah for the Help America Vote Act of 2002 Voting System - Contract C2005-113
Scott Hogensen, County Elections Administrator, presented this agreement with the State of Utah for the new voting equipment to implement the federal Help America Vote Act (HAVA). Mr. Hogensen gave an overview of HAVA which requires updating procedures and practices and equipment used in elections in all counties in the United States and addressed the commissioners' questions. Congress allocated funds to the States for this mandate, and Utah received approximately $25 million. This contract is for Weber County's portion, which is about $2.2 million. He reported on his visit to Georgia to observe an election using new electronic voting equipment. He stated it had been very informative. The Utah County Clerks Legislative Policy Committee will be meeting to digest all the materials collected and draft the practices and procedures for Utah. The company that manufactures this new equipment is one of the largest in that field and has a long history of making secure financial systems. Mr. Hogensen said that the machines that the county will receive from the State will be about 117 voters per machine, which he felt was a very good ratio. The State is still working on extending the maintenance agreement beyond 2009 to 2015. The commissioners thanked Mr. Hogensen for all his hard work and for assisting the Stated in this matter.
Commissioner Cain moved to approve Contract C2005-113 by and between Weber County and the State of Utah for the Help America Vote Act of 2002 Voting System; Commissioner Dearden seconded, both voting aye.
7. Contract by and between the Weber County Sheriff's Office and the Second District Court to provide Bailiff Service to each of the District Court Sessions - Contract C2005-114
Lt. Art Haney, Weber County Sheriff's Office, stated that the term of this annual contract was July 1, 2005 through June 30, 2006. The compensation to the Sheriff's Office is not to exceed $145,000 and is the same amount allocated to Weber County for several years. Lt. Haney noted that this amount did not cover the county's total cost and that by legislature the administrator of the courts was granted a certain amount of money which was allocated to all the courts throughout the State.
Commissioner Cain moved to approve Contract C2005-114 by and between the Weber County Sheriff's Office and the Second District Court to provide Bailiff Service to each of the District Court Sessions; Commissioner Dearden seconded, both voting aye.
8. Financial guarantee in the amount of $70,444.55 for improvements for manufacturing site plan 05-2004, in Hot Water Barn
Kevin Hamilton, County Planning Department, stated that this site plan had been approved about one year ago. The developer were completing their building now and would like to move in and this financial guarantee was required to complete the outside improvements (landscaping, sidewalk and parking area).
Commissioner Cain moved to approve the financial guarantee in the amount of $70,444.55 for improvements for manufacturing site plan 05-2004, in Hot Water Barn; Commissioner Dearden seconded, both voting aye.
9. Final approval of The Eagle Ridge Cluster Subdivision, Phase 3, consisting of 14 lots, including a financial guarantee in the amount of $251,586.17 for improvements
Kevin Hamilton, County Planning Department, showed the plat map and stated that this subdivision was located just west of Patio Springs in the Ogden Valley. The Planning Commission unanimously recommended approval of this item. Commissioner Cain asked if there had been any concerns by staff and Mr. Hamilton replied there had not been.
Commissioner Cain moved to grant final approval of The Eagle Ridge Cluster Subdivision, Phase 3, consisting of 14 lots, including a financial guarantee in the amount of $251,586.17 for improvements; Commissioner Dearden seconded, both voting aye.

Connie Chandler asked who was the manufacturer for the voting machines and Commissioner Cain replied it was Diebold.
