Commissioner Dearden moved to approve the consent items, holding the August 30, 2005 minutes; Commissioner Cain seconded, all voting aye.

1. Contract by/between Weber County and Western States Racing Association for the Year-End Finals Demolition Derby to be held October 1, 2005 at the Golden Spike Event Center - Contract C2005-117
Jim Harvey, GSEC, presenting this item stating that the county had done business with this contractor in the past.
Commissioner Cain moved to approve Contract C2005-117 by and between Weber County and Western States Racing Association for the Year-End Finals Demolition Derby to be held October 1, 2005 at the Golden Spike Event Center; Commissioner Dearden seconded, all voting aye.
2. Contract by/between Weber County &X-treme Demolition Derby League for the Western Regional Championships to be held September 17, 2005 at the Golden Spike Event Center - Contract C2005-118
Jim Harvey, GSEC, stated that the county had done business with this contractor in the past. Mr. Harvey addressed the commissioners' questions regarding concessions and ambulance services. He stated that there would be an ambulance onsite and that now all ambulances will be contracted through the GSEC.
Commissioner Dearden moved to approve Contract C2005-118 by/between Weber County and X-treme Demolition Derby League for the Western Regional Championships to be held on September 17, 2005 at the Golden Spike Event Center; Commissioner Cain seconded, all voting aye.
3. Approval of a waiver of a requirement of the Weber County Subdivision Ordinance at 2700 South 4550 West, a one lot subdivision, requesting a waiver for cul-de-sac improvements and frontage
There was much discussion on this item. Curtis Christensen, County Engineer, addressed the commissioners' questions. He showed a plat map of this subdivision that consists of approximately 5 acres. When the petitioner, Richard Gibson, originally came to the county to discuss a building parcel, County Planning staff and the Commission looked at potential roads which may go through this area. Since this was a single residence, it was felt at the time that perhaps it might be onerous to require the full road to be built. Currently, there are no roads in the area, thus there is the issue of frontage for Mr. Gibson. He had presented to the Planning Commission a single lot with a short road extension into his property and a cul de sac. The cul de sac, which is dedicated to the public, allowed him the minimum required frontage of 150 ft., and he would have to dedicate the 50 ft. radius area for the cul de sac. The Planning Commission's approval included a road dedication for a standard cul de sac and an easement for future road extension to 4700 W. Subsequently, Mr. Gibson requested a reduction in the improvements and frontage. The Planning Commission recommended denying a variance from the Subdivision Ordinance but to defer curb and gutter. The frontage reduction request would have to go before the Board of Adjustment.
Mr. Christensen recommended the standard permanent cul de sac for rural areas which calls for an asphalt turnaround of 37 ft. in radius. Mr. Gibson's letter requested to install a strip of asphalt approximately 50 ft. in length into the property off the north end of 4550 W 2698 S with road base around the perimeter instead of paving the entire cul de sac. In other discussions prior to the request to the variance, Mr. Gibson had submitted a possible plan for discussion purposes only that called for a 50 ft. radius cul de sac which would provide the necessary frontage, but with a strip of asphalt going through the middle with a gravel turnaround. Mr. Christensen said this would be similar to a temporary cul de sac. He outlined three alternatives with estimated costs. The first alternative called for the full asphalt ($9,300). The second alternative called for a 50 ft. road extension to the property ($4,000, which includes excavation and rough grading for a full radius of road base for a turnaround). The third alternative called for the asphalt strip (about 85 ft.) going through the cul de sac ($5,500). The cost difference between alternatives 2 and 3 is the length of asphalt.
Mr. Christensen stated that this was a public right-of-way and the developer should put in the roadway, at least through the right-of-way portion. He anticipates that in the future there will be an extension of the roadway. Commissioner Bischoff asked if the ordinance was in effect when the subdivision was originally platted requiring the improvements. Mr. Christensen believed the subdivision had been platted about 30 years ago. There is a recorded temporary turnaround but Mr. Christensen had not found records whether it had been installed and it was not functioning today, and he preferred to see it brought up to standard for emergency vehicle purposes. Commissioner Cain noted that the fire department would probably require a turnaround that would accommodate its vehicles and asked what were Mr. Gibson's plans. He pointed out his current house next to the property line stating that fire trucks use his driveway regularly to turn around. He said that he would provide enough room for emergency vehicles to turn around. He drives a school bus, which is about the length of a fire truck and pointed out that large vehicles could not turn around in a 100 ft. radius without backing up.
Mr. Gibson said he would like to extend the existing road 50 ft. into his property to allow a driveway to connect with his future house. The existing road ends 21 ft. from his property line. Mr. Christensen believed that sometimes a gap is left at the end of a road for drainage purposes, etc. Mr. Gibson would extend the existing turnaround similar to what exists now. He said that none of the roads that end in the Franklin Estates subdivision (that he built to the east about four years ago) have turnarounds or cul de sacs and he would like to complete the roads in this property the same way as in the Franklin Estates. Mr. Gibson said he only had 4 acres of farm ground and expressed concern with a 100 ft. cul de sac because it would prohibit a future building lot due to the topography and it would take away too much land from a field that is being used for agriculture. The old sand hill where his house will be built has been a burial ground for old equipment, debris, etc., and cannot be farmed. He did not wish to sacrifice the small piece of ground for a turnaround of that size because it would take away farmable ground. He felt his plan better served all situations now and in the future. A road could be extended when needed, which would probably be to the north. He said that neither he nor the neighbor in the Hadley Farm Subdivision to the north planned to develop. Mr. Gibson would agree with a 50 ft. extension of the asphalt, putting in a graveled turnaround and dedicating the remaining area. Mr. Commissioner Dearden indicated that the Commission could defer curb and gutter and require Mr. Gibson to asphalt the 50 ft. extension into the property plus the 21 ft. gap and to gravel the remaining area.
Commissioner Dearden moved to approve alternative 2, deferring curb and gutter and requiring Richard Gibson to asphalt the 50 ft. extension plus the 21 ft. to the end of the road, and to put in the required gravel for the cul de sac at 2700 South 4550 West; Commissioner Cain seconded, all voting aye.
4. Resolution approving an Interlocal Agreement between Uintah City and Weber County providing for certain road maintenance services - Resolution 28-2005, Contract C2005-119
Nate Pierce, County Operations Department, presented this interlocal agreement for Weber County to assist Uintah City with its road maintenance.
Commissioner Cain moved to adopt Resolution 28-2005 approving Interlocal Agreement C2005-119 between Uintah City and Weber County providing for certain road maintenance services; Commissioner Dearden seconded.
