In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance "in brief" of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Kenneth A. Bischoff, Chair; Craig L. Dearden. Camille T. Cain was excused.

Commissioner Dearden moved to approve the consent items; Chair Bischoff seconded, both voting aye.
E. Proclamation declaring June as "Relay for Life Month"
Commissioner Dearden read the proclamation by which the Weber County Commission joined with the American Cancer Society in declaring June 2005 as "Relay for Life" regarding breast cancer. Paula Axelrod, American Cancer Society, thanked the Commission on behalf of the American Cancer Society on the signature events planned for Weber County in the fight against breast cancer. Ms. Axelrod introduced the present committee members and other participants. The commissioners thanked them for their dedication. The commissioners were presented with pins and T-shirts and invited to attend the events.
F. First Quarter Report of the Ogden/Weber Convention and Visitor's Bureau
Shelleice Stokes, President of the Ogden/Weber Convention and Visitor's Bureau, introduced the new Director of Sales, Dave Maughn. They presented the CVB's first trimester report as per the contract. They reported on the CVB's meetings/conventions attended with potential customers, sales activity, etc. Ms. Stokes and Mr. Maughn addressed the commissioners' questions regarding how the CVB's goals were set, etc. Ms. Stokes stated that the CVB used formulas by the International Association of Convention Visitor Bureau, the Utah Sports Commission, or the State of Utah's to estimate the economic impact of different markets that come to our community through tourism. Efforts are being made to establish baseline figures for Weber County.
G. Action Items:
1. Request to Approve a Petition for Appropriation of Funds to the weber Morgan Narcotics Strike Force
Reed Richards, legal advisor to the Sheriff's Office and a Deputy County Attorney, explained that the Strike Force was organized in the latter part of the 1980's and has been the primary drug enforcement entity in the two county area for the last twenty years. The Strike Force is supported by funding from all jurisdictions within the two county area. The Strike Force was organized and has functioned for the purpose of coordinating drug enforcement efforts within Weber and Morgan Counties and to conduct investigations in cooperation with State and Federal authorities. Weber County has acted as the supervising governmental agency for the administration of the Strike Force.
Over the years, Strike Force officers have taken into their possession during drug raids money that was seized for use as evidence. In some cases the cash had actual traces of drugs that could be analyzed and used as evidence. In other cases money was taken as evidence that the individuals involved were drug dealers. The money was placed into an account at First Security Bank, now Wells Fargo Bank. When the cases were concluded, no claims were made for the money and the money has remained in the First Security/Wells Fargo account and has accumulated over the last fifteen years. All money currently in the account was placed into the account prior to the year 2001. The current balance in the account is $37,638.62, and of that amount $18,696.55 is accumulated interest earned on the account.
Utah Code Annotated 77-24-04, Disposition of Property (as amended in 2005), provides that when property is seized as evidence but is no longer needed as evidence, the agency having possession of the property, if there is no known owner of the property, may use the property in a manner to be determined by the legislative body of the agency.
Mr. Richards and Mike Ashment, Strike Force Commander, asked that this money be used for Strike Force operations in Weber and Morgan Counties. Chris Zimmerman, former Strike Force Commander and Chief Deputy at the Sheriffs' Office, reviewed various Strike Force procedures and supported the request for the money to be used by the Strike Force.
Commissioner Dearden asked a staff member from Representative Bishop's office, who was present at this meeting, to speak with Representative Bishop about assisting in the effort to continue federal funding for local drug crime enforcement and investigation.
Commissioner Dearden moved to approve the petition for appropriation of funds to the Weber Morgan Narcotics Strike Force for use in drug enforcement efforts in Weber and Morgan Counties; Chair Bischoff seconded, both voting aye.
7. contract with WSI Personnel Services to provide qualified personnel for Medical Unit of Weber County Correctional Facility - Contract C2005-65
Steffani Ebert, Weber County Correctional Facility, stated that the Weber County Jail had a vacancy for a registered nurse since September 2004 and Weber County Human Resources had kept an open register since that time. Ms. Ebert indicated there had been a handful of applicants and subsequent job offers made but these were turned down mainly due to the low wages offered. The fact that the position was at the Jail may also contribute to the lack of interest. WSI, a medical staffing agency, will send temporary registered nurses to the Jail and the county will pay WSI at the rate of $30/hour for the nurses. Ms. Ebert indicated that WSI currently has a possible hire for the county. She noted that it was a cost savings to the county to initially go through the agency because the county would not be paying benefits. She outlined the contractual options to hire a nurse from the agency.
Commissioner Dearden asked if IHC had been approached about available nurses and Ms. Ebert had not contacted them about that issue but had about their salaries. Reed Richards, Deputy County Attorney, stated that the term was for one year following acceptance of any candidate from WSI, however, the county was not committed to only hire candidates from WSI. David Wilson, Deputy County Attorney, noted the insurance indemnification paragraph that was to become part of this contract.
Commissioner Dearden moved to approve Contract C2005-65 by and between Weber County and WSI Personnel Services to provide qualified personnel for the medical unit of Weber County Correctional Facility, including the insurance indemnification paragraph; Chair Bischoff seconded, both voting aye.
8. contract by and between Weber County and Inmate Telephone, Inc (ITI) for an Inmate Telephone System - Contract C2005-66
Julie Richesson, Weber County Correctional Facility, stated that the county had sent Requests for Proposals last Fall for inmate telephone service. ITI was selected. The term is for three years and may be extended for two additional one-year terms. ITI will pay the county 51% of the gross revenue generated from calls made at the Facility and 40% from revenue generated at the Kiesel facility. Regular inmate telephones will replace coin-operated ones at the Kiesel facility which allows the monitoring and recording of usage. This contract had been reviewed by the County Attorney's Office.
Commissioner Dearden moved to approve Contract C2005-66 by and between Weber County and Inmate Telephone, Inc (ITI) for an inmate telephone system; Chair Bischoff seconded, both voting aye.
2. Contract by/between Weber County & Reis Ranch Production, Inc., for the No Dust Tour held at the Golden Spike Event Center on May 21, 2005 - Contract C2005-67
Jennifer Graham, Recreation Facilities Director, stated that this contract had been received from the customer after the deadline to put this item on the Commission agenda. She reported that the event had been successful. It is a standard contract.
Commissioner Dearden moved to approve Contract C2005-67 by and between Weber County and Reis Ranch Production, Inc. for the No Dust Tour held at the Golden Spike Event Center on May 21, 2005; Chair Bischoff seconded, both voting aye.
3. Final subdivision approval for Lakeside Village Phase 9, 8 units, including a financial guarantee for improvements in the approximate amount of $19,652.50
Kevin Hamilton, County Planning Department, indicated that this project was located on the south side of Pineview Reservoir. He noted that approval of this item needed to be subject to final review and approval of the financial guarantee by the County Attorney's Office.
Commissioner Dearden moved to grant final subdivision approval for Lakeside Village Phase 9, consisting of 8 units, including a financial guarantee for improvements in the approximate amount of $19,652.50, with approval of this item being subject to final review/approval by the County Attorney's Office; Chair Bischoff seconded, both voting aye.
4. Approval of a Wasatch View Drive Road Dedication Plat and the acceptance of a $5,441.00 financial guarantee
Jim Gentry, County Planning Department, stated that this was a road dedication in the Weber Industrial Park coming off of 2700 North. Mr. Gentry addressed the commissioners' questions stating that no lots were being put in at this time but that this road was being put in to meet UDOT's requirements.
Commissioner Dearden moved to approve a Wasatch View Drive Road dedication plat and the acceptance of a $5,441.00 financial guarantee; Chair Bischoff seconded, both voting aye.
5. Final approval of Howard Subdivision, 9 Lots at 200 North 6700 West, and the acceptance of a financial guarantee of $220,000
Jim Gentry, County Planning Department, stated that the Planning Commission had unanimously recommended approval of this item. The developer will be putting in curb, gutter and sidewalk on the interior cul de sac, as well as putting in pipe and filling in the ditch along 6700 W.
Commissioner Dearden moved to grant final approval of the Howard Subdivision, consisting of 9 Lots located at 200 North 6700 West, and to accept the $220,000 financial guarantee; Chair Bischoff seconded, both voting aye.
6. Interlocal Agreement by and between Weber County and Davis County for Cooperative Library Borrowing - Resolution 21-2005, Contract C2005-68
Lynnda Wangsgard, Weber County Library Director, stated that both counties operated county-wide library systems but the missions were rather different, with Davis County focusing on provision of popular reading materials and Weber County focusing on core reference and research materials.
The contract authorizes each library system to provide cooperative borrowing or loaning of materials to residents in the two library districts with a provision for an annual review of the usage on the part of the citizens to make sure that one county is not unduly burdened. This is a five-year renewal of a 10-year contract. Ms. Wangsgard said that usage had been found to be about equal between the two counties. There are no administrative costs associated with this agreement and Ms. Wangsgard noted that there were some cost savings because the work was done by the citizens in borrowing and returning the materials which would ordinarily be done through an inter-library loan that would be handled through the U.S. postal mail. The Library Board had recommended approval of the contract and the County Attorney's Office had reviewed it as well. Chair Bischoff asked if there were any changes to the contract. Ms. Wangsgard stated that a provision was added to review this contract in the event either county built a new branch library.
Commissioner Dearden moved to adopt Resolution 21-2005 approving Contract C2005-68, Interlocal Agreement by and between Weber County and Davis County for Cooperative Library Borrowing; Chair Bischoff seconded.
