OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, May 10, 2005 - 10:00 a.m.

Each Commission meeting is recorded on CD or audio tape, which is available to the public through the County Clerk's Office.
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance "in brief" of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Kenneth A. Bischoff, Chair; Camille T. Cain, and Craig L. Dearden.
Others Present: Linda G. Lunceford, Clerk/Auditor; David C. Wilson, Deputy County Attorney; and Fátima Blackford, Clerk/Auditor's Office, took minutes.

D. Consent Items:
1. Purchase Orders in the amount of $135,566.11
2. Warrants #201181 - #201341 in the amount of $2,300,835.14
3. Minutes for the meeting held on May 3, 2005
Commissioner Cain moved to approve the consent items; Commissioner Dearden seconded, all voting aye.
E. Action Items:
1. Contract by/between Weber County &Crossroads of the West Inc. for a Gun Show to be held on May 14 and 15, 2005 - Contract C2005-57
Jennifer Graham, Recreation Facilities Director, briefly presented this standard contract. Commissioner Cain asked when contracts were evaluated if revenues were projected versus overall expenses. She would like to have projections discussed as contracts are brought in by event. Ms. Graham replied that direct expenses were considered, however, other fixed expenses, particularly for new events, were more difficult to calculate. Chair Bischoff noted that reports are presented at the Arena Boards where expenses versus revenues were outlined.
Commissioner Cain moved to approve Contract C2005-57 by and between Weber County and Crossroads of the West Inc., for a gun show to be held on May 14 and 15, 2005; Commissioner Dearden seconded, all voting aye.
2. Notice of public hearing regarding intention of the Board of Commissioner of Weber County to establish a Special Service District to include all of Weber County, to be known as "Weber Area Consolidated Dispatch 911 and Emergency Services District"
David Wilson, Deputy County Attorney, noted that on March 29, 2005, at the request of municipalities within Weber County the Commission adopted a resolution indicating its intent to create a service district for the purpose of governing the Consolidated Dispatch Center. This resolution required each of the municipalities to consider the resolution in a public meeting and to adopt a resolution approving the certified one sent to them if they desired to be included in the district and to move forward with the process.
All municipalities within Weber County responded and Mr. Wilson had copies of those that adopted resolutions. The procedure now called for the Commission to set a public hearing, and that notice must be published in the newspaper three times, with the first publication being no more than 35 days but no less than 21 days before the public hearing. The Dispatch Center had suggested possible dates for the Commission to set the public hearing.
Commissioner Dearden moved to set a public hearing for June 21, 2005 at 6:00 p.m. regarding the intention of the Board of County Commissioner of Weber County to establish a Special Service District to include all of Weber County, Utah, to be known as the "Weber Area Consolidated Dispatch 911 and Emergency Services District"; Commissioner Cain seconded, all voting aye.
F. Public Hearing:
Commissioner Cain moved to adjourn the public meeting and convene a public hearing; Commissioner Dearden seconded, all voting aye. 1.
2. Public Hearing on Agricultural Protection Area Proposal #2 by Darrell Christensen
Fátima Blackford, Clerk/Auditor's Office, stated that an application for an Agriculture Protection Area in the western part of Weber County, north of Plain City, had been received. The statutory process had been followed, which included two different postings within the area and notices had been published, one of which invited written public comments but the Commission received none. The Advisory Board and Planning Commission also received no comments. They had no objections and recommended approval to the County Commission.
The petitioner, Darrell Christensen, stated that he was trying to hang on in the farming industry in that area but it was a losing battle. He was much in favor of open space and agricultural activities.
3. Commissioner Dearden moved to adjourn the public hearing and reconvene the public meeting; Commissioner Cain seconded, all voting aye.
4. Action on public hearing on Agriculture Protection Area #2 by Darrell Christensen:
Commissioner Cain noted that this land was currently being used for agricultural uses and consisted of about 10 parcels (approximately 107.05 acres). Any change in zoning in the future would require consent of those within the APA.
Commissioner Cain moved to approve the Agriculture Protection Area #2 application by Darrell Christensen; Commissioner Dearden seconded, all voting aye.
