In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance "in brief" of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Kenneth A. Bischoff, Chair; Camille T. Cain, and Craig L. Dearden.

Commissioner Dearden moved to approve the consent items, less item D4; Commissioner Cain seconded, all voting aye.
E. Action Items:
D4 (from Consent Items section above): David Wilson, Deputy County Attorney, explained that this item related to the 50 ft. river/storm-water and public access easement on the Barrett property discussed at the 4/5/2005 Commission meeting. Mr. Wilson stated that he had discussed this matter with the county recorder's office to determine their process and requisite documents relating to extinguishing easements. It is the opinion of Doug Crofts, County Recorder, that the public access portion of the easement should be treated as the vacation of any public right of way and he suggested a public hearing and the subsequent adoption of an ordinance to complete the vacation of the public access if that is the desire of the commission subsequent to the hearing. Mr. Wilson indicated that he concurred in that opinion and requested that a public hearing be set no earlier than June 7th to ensure adequate time for publication. Imogene Barrett, who had petitioned to have the public easement extinguished, had indicated concern to county staff about the legal description provided by the county surveyor's office. Mr. Wilson reported that he would meet with Gary Laird and the Martin Moore, the County Surveyor, to ensure accuracy of the legal description. Ms. Barrett wanted the county to move forward with this item as quickly as possible.
Commissioner Cain moved to set a public hearing for June 7, 2005 at 10:00 a.m. to consider vacating the public easement on LSN 14-012-0060; Commissioner Dearden seconded, all voting aye.
1. Final approval of Mountain View Estates Phase 9, 12 lots at 3125 North 4975 East, and acceptance of a financial guarantee of $79,029.47
Kevin Hamilton, County Planning Department, stated that this subdivision was located to the north and east of Snow Crest Jr. High School in the Ogden Valley.
The Planning Commission had unanimously recommended approval of this item. All conditions for approval had been met. Mr. Hamilton addressed the commissioners' questions. He stated this subdivision had received preliminary approval prior to the zoning change in 1998 requiring the 3-acre minimum lot size.
Commissioner Dearden moved to grant final approval of Mountain View Estates Phase 9, 12 lots, located at 3125 North 4975 East, and to accept a financial guarantee in the amount of $79,029.47; Commissioner Cain seconded, all voting aye.
2. Request for approval of placing a historical monument sign at the Eden Park in the Ogden Valley
Kevin Hamilton, County Planning Department, showed a depiction of this historical monument requested to be placed in the northwest corner of the Eden Park by the Daughters of Utah Pioneers. The monument will speak of the original settlement of the Eden area. The zoning ordinance exempts this type of sign from standard sign requirements. This site is not specifically identified in the Ogden Valley Master Plan, thus it requires County Commission approval. The Eden Park committee approved this area for the monument. Chair Bischoff asked about public input and Mr. Hamilton said that there was no type of public notice on these types of monuments, that the ordinance simply allowed historical name signs for sites/structures designated by the Board of County Commissioners as having historical significance to the county. Commissioner Cain did not have concerns with the size and shape of the monument but stated the Commission did not have enough information on the historical value, language and placement of the monument. Mr. Hamilton explained that the Commission was making the determination at this time that it was a historical site. His understanding from the Daughters of Utah Pioneers was that the location was that of the original school. The Blacksmith shop across the street was named in the Master Plan as a location of historical significance.
The bell that will be placed on the top of the sign is the original bell from the original school in the Ogden Valley.
Commissioner Cain moved to approve placing a historical monument at the Eden Park in the Ogden Valley; Commissioner Dearden seconded, all voting aye.
F. Assign Pledge of Allegiance &Thought of the Day for Tuesday, May 10, 2005, 10 a.m.
G. Public Comments:
David Wilson, Deputy County Attorney, noted that the county tax sale would take place May 26, 2005, and that it would be helpful for the Standard Examiner to place a story about the need for people to carefully research the sale properties before they bid on such properties. Mr. Wilson indicated that due to the plethora of books on how to make quick money at a tax sale, inexperienced tax sale buyers often make decisions to purchase without performing sufficient due diligence. Mr. Wilson indicated that despite cautions and warnings from the clerk/auditor at the tax sale about completing appropriate due diligence before bidding, there always seem to be purchasers who recognize after they have completed a purchase that the property is not what they expected.
