6. Third Amendment to the Contract for Solid Waste Transportation and Disposal between Weber County and ECDC Environmental LC - Contract C2005-20
Gary Laird, County Operations Director, noted that the county has had a difficult time in getting the waste out of the transfer station by rail as necessary when the railroad gets busy, thus the county had been searching for other alternatives. ECDC had proposed that if the county would guarantee a waste flow, they would build a new landfill, which would be closer, thus the waste could be hauled by truck. Under this amendment, the tipping fee is reduced to $22/ton from the current $24.17, the annual CPI is changed to 60% of the percentage increase or decrease, less any fuel adjustment made (it generally averages 65%). Under this amendment, the county guarantees that the waste that comes through the transfer station will be transported to that landfill, less any onsite recycling. In anticipation of going to truck hauling, this contract is based on a $2/gallon rate for diesel fuel. If this increases by 10 cents/gallon, the tipping fee cost per ton will increase 14 cents, and if it decreases by 10 cents/gallon, the cost per ton will decrease 14 cents/ton.
Mr. Laird and Kirk Treece, ECDC, addressed the commissioners' questions regarding fuel costs. Mr. Treece explained that there was a trucking index adjusted by the trucking company monthly. Commissioner Dearden asked Mr. Treece if his concerns about Section Two, paragraph 2, that stated the county would "load acceptable waste only during county's regular working hours unless otherwise agreed to by the parties in writing" had been resolved. Mr. Treece said this had been discussed and proper protocol needed to be mutually agreed to. Because of the fluctuations with the waste coming to the transfer station, they wanted proper time to react when a lot of waste was received. His concern was that putting this in writing would be difficult. Mr. Laird indicated they would be working 10-hour days (staggered shifts) at the transfer station, which should work out. Commissioner Cain asked what the cost to the county would be to prepare for this change–trucking versus rail–and Mr. Laird responded there was the estimated $30,000 cost to change the scales and possibly other minimal adjustments to allow for the truck heights.
Commissioner Cain noted that the county could terminate this contract any time it could save 10% on the cost. Chair Bischoff pointed out another escape clause in the event the county purchased land and built its own landfill. He also noted the term of the current renewal period of the contract was extended until September 1, 2016. Upon expiration of that term, the county would have the option to extend for five additional five-year periods. Commissioner Cain asked when the contract would become effective and Mr. Laird stated that it would be upon approval by the Commission, however, the rate would not change until the landfill opened. There is a requirement that ECDC get the landfill operating by September 2005 and Mr. Treece anticipates it will be July 1, 2005. The rates remain the same in the interim and the county does not pay inflation. The CPI was waived for February and the CPI increase will not occur until 2007. Commissioner Dearden indicated this was the best that could be negotiated at this time.

2. Approval of Interlocal Agreement by and between Weber County and Brigham City for Library Services - Resolution 11-2005, Contract C2005-21
See the next related item, E.3. Lynnda Wangsgard, Weber County Library Director, presented this item and the following one for library services. These agreements are renewals and cover reciprocal borrowing only between these entities. There were no changes from the previous agreements. These agreements expand the resources that are available to the citizens and save interlibrary loan costs. To date, there are agreements with Davis, Morgan, and Summit counties and with Logan and Brigham cities. These borrowing agreements are reviewed annually by the Library Board. Ms. Wangsgard addressed general questions by the commissioners.

4. Request to ratify contract by/ between Weber County and Pinnacle Travel Command Performance Rodeo Contractor for the England Command Performance Rodeo held on February 16, 2005 at the Golden Spike Event Center - Contract C2005-23
Amy King, GSEC, presented this contract stating this was a co-sponsored event and has been held in the past at the Golden Spike Event Center successfully. Ms. King noted that legal counsel would like the contract redrawn in the future to better cover liabilities.
Commissioner Dearden moved to ratify a contract, C2005-23 by and between Weber County and Pinnacle Travel Command Performance Rodeo Contractor for the England Command Performance Rodeo held on February 16, 2005 at the Golden Spike Event Center; Commissioner Cain seconded, all voting aye.
5. Approval of contract by/between Weber County &the Weber State Rodeo Team for the Weber State Rodeo to be held March 3-6, 2005 at the Golden Spike Event Center -Contract C2005-24
Amy King, GSEC, presented this standard contract. The appropriate insurance naming Weber County as additionally insured was acquired.
Commissioner Cain moved to approve Contract C2005-24 by and between Weber County and the Weber State Rodeo Team for the Weber State Rodeo to be held from March 3 - March 6, 2005 at the Golden Spike Event Center; Commissioner Dearden seconded, all voting aye.
7. Consideration and/or action on a recommendation by the Western Weber County Township Planning Commission to revoke Conditional Use Permit CUP #17-99 for site leveling for future development
Chair Bischoff stated this item was being held. He and Kevin Hamilton, County Planning Department, had met with the attorney for this item this morning. The attorney had another commitment and they agreed to hold this item for two weeks, however, they had reviewed some timelines and requirements.
The letter of credit had been received by the county as stipulated by the Commission at the February 15, 2005 Commission meeting.
F. Public Hearing
1. Commissioner Dearden moved to adjourn the public meeting and convene the public hearing; Commissioner Cain seconded, all voting aye.
2. Continuation of a public hearing on Zoning Petition ZP #06-2002 by Daniel Favero, Paul Favero, and Edward Favero to amend the zoning map by rezoning property at approximately 2200 S. 4300 W. from Agricultural A-1 to Residential Estate RE-20 (The property consists of approximately 57.7 acres)
Kevin Hamilton, County Planning Department, stated a public hearing had been held in early February 2005 and the petitioner had new information to present today.
Sherry Lewis, representing the Faveros, stated that they were formally withdrawing this rezoning application tonight. They are planning to go back through the county process and submit either a standard subdivision or a cluster subdivision application.
3. Commissioner Dearden moved to adjourn the public hearing and reconvene the public meeting; Commissioner Cain seconded, all voting aye.

G. Assign Pledge of Allegiance &Thought of the Day for Tuesday, March 15, 2005, 10 a.m.
H. Public Comments:
Benjamin Bishop of South Ogden, wished to introduced himself. He works with the Kier Corporation in Ogden and outlined some of his work history. Mr. Bishop said they had a 48-acre parcel in the Eden area (the former Nordic Valley Golf Course) under contract. Currently, they have no specific plans for the land but are investigating what they can do under the current regulations.
