In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance "in brief" of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Kenneth A. Bischoff, Chair; Craig L. Dearden; and Camille T. Cain.
Others Present: Linda G. Lunceford, Clerk/Auditor; David C. Wilson, Deputy County Attorney; and Fátima Blackford, Clerk/Auditor's Office, who took minutes.

D. Consent Items:
1. Purchase Orders in the amount of $202,688.98
2. Warrants #197565 - #197809 in the amount of $1,188,693.98
3. Request for approval of the minutes for the regular Commission meeting held January 18, 2005
Commissioner Cain moved to approve the consent items with the inclusion to the minutes of the time of the public hearings set for February 8, 2005; Commissioner Dearden seconded, all voting aye.
E. Presentation & Appreciation to the Weber County Commission from the National Cutting Horse Association
Jeff Hooper, Executive Director of National Cutting Horse Association, thanked the Commission for their support of the NCHA as the host for the Western National Championships, which was in its 11th year. He explained the competition process and outlined the economic impact to the community, including that on average the 787 entries brought approximately $1.9 million. Mr. Hooper said that the hospitality here was unmatched and he praised Jim Harvey, the Golden Spike Event Center manager. Mr. Hooper presented the Commission with a beautiful bronze sculpture, the official NCHA trophy. Jim Armstrong, member of the NCHA Board of Directors, indicated that the contestants, who came here from all over the U.S.A., competed against 70-80 people in each class. He stated that the support here had been fantastic and encouraged the community to watch the event. The commissioners said that it was a great privilege to have the cutters come to our community and expressed appreciation to them as well as to the county staff that work hard to make NCHA's stay a pleasant one.
F. Action Items:
1. Approval of amendment to Weber County Travel Expense Reimbursement Policy 9
David Wilson, Deputy County Attorney, presented amendments for clarification to the travel policy regarding per diem and employees receiving a car allowance who travel in excess of 140 miles round trip. Commissioner Cain asked if the county would adopt the IRS rate for mileage reimbursement and Dan Olsen, County Comptroller, noted that the county's policy called for that to occur and it became effective January 1. Commissioner Cain asked how per diem was handled for an employee when two of three meals in a day were provided at a conference. Mr. Olsen said that traditionally it had been left on the honor system and explained that there may be circumstances where the employee would not take that meal due to special diet needs, etc. Chair Bischoff noted that there were times where the county's per diem did not cover all the meals.
Commissioner Dearden moved to approve the amendments to the Weber County Travel Expense Reimbursement Policy 9; Commissioner Cain seconded, all voting aye.

David Wilson, Deputy County Attorney, presented items 2, 3 and 4 together. In the past, Mr. Wilson served as a Taxing Entity Committee representative for Weber County along with Ron Kusina, Executive Director of the Redevelopment Agency of Weber County. Dan Olsen, County Comptroller, had indicated his willingness to replace Mr. Wilson on those committees. The resolutions also appoint Commissioner Dearden as an alternate representative to act in case of absence of either of the two regular representatives. There are no new projects prompting these resolutions; Ogden City will be holding a Taxing Entity Committee meeting soon and it was an appropriate time to make the updates.
Commissioner Cain moved to adopt Resolutions 3-2005, 4-2005 and 5-2005 appointing two representatives to serve on the Taxing Entity Committee for all Redevelopment, Economic Development and Education Housing Development Project Areas in the cities of South Ogden, Ogden, and Roy, respectively; Commissioner Dearden seconded.

5. Contract by and between Weber County and Midway West Amusements for a Carnival at the Weber County Fair for August 10 - August 14, 2005 - Contract C2005-8
Jan Wilson, Weber County Fair, stated that the county had worked with this contractor last year and it was basically the same contract with a couple of changes. She said that the date the agreement was entered into needed to be changed to January 25, 2005 because it had last year's date. The contract had already been signed by the contractor with the changes.
Commissioner Dearden moved to approve Contract C2005-8 by and between Weber County and Midway West Amusements for a carnival at the Weber County Fair for August 10, 2005-August 14, 2005; Commissioner Cain seconded, all voting aye.
6. Recommendations of the Weber County Fair Board regarding prospective appointees
Jan Wilson, Weber County Fair, presented the Fair Board's recommendations for appointments and re-appointments to the Board. Chair Bischoff noted that most of these appointees had experience with the Fair. Most of the recommendations were made by current Board members.
Commissioner Cain moved to approve the recommendations of the Weber County Fair Board for appointees to the Board as follows: reappointments to serve a one-year term: Bud Favero and Len Allen; reappointments to serve a four-year term: Lisa Karam, Lynn Moyes, Mike Mathieu and Gene Greenfield; new appointments to serve a one-year term: Mayor Lynn Muirbrook, Chris Hipwell and Betty Barrow; new appointment to serve a four-year term: Jean Potokar; Commissioner Dearden seconded, all voting aye.
7. Approval of Evaluation Report of 2004 Weber County Fair
Jan Wilson, Weber County Fair, explained that after a Fair is held, staff sends out surveys and meets with the Board, the volunteers, the superintendents, etc., in an effort to fully evaluate the Fair. Subsequently, the Evaluation Report is prepared, which includes a Fair summary, evaluation comments, recommendations for the following year, a medical treatment summary, sponsorships, marketing and advertising report, attendance totals, etc. Chair Bischoff noted that attendance had remained fairly consistent, which was due to the diverse activities offered at the Fair. Ms. Wilson outlined some of the plans for this year's Fair. She noted that the survey conducted this year showed 497 reported volunteers and that some did not return their evaluations. The commissioners thanked Ms. Wilson and Stacey Skeen for all their hard work at the Fair.
Commissioner Cain moved to approve the Evaluation Report of 2004 Weber County Fair; Commissioner Dearden seconded, all voting aye.
G. Assign Pledge of Allegiance & Thought of the Day for Tuesday, February 1, 2005 at 10 a.m.
H. Public Comments:
Chair Bischoff recognized Justin Allen with Congressman Rob Bishop's office and Sandy Kester with Senator Orrin Hatch's office. Mr. Allen reported that Congressman Bishop had a new committee assignment in Washington, D.C. He is now on the Rules Committee, which apparently is a rare assignment for a second term congressman. This new assignment means that Congressman Bishop will have to relinquish his other committee assignments, including Armed Services, Resources, Science and Technology. He said that Congressman Bishop felt that overall it was a positive move and he would do all he could to defend Hill Air Force Base's interest relating the to BRAC process. Ms. Kester reported that Senator Hatch was no longer chair of the Committee on the Judiciary but there was a movement to retain him. Senator Hatch will retain his intelligence committee and will be assigned to new committees on finance and health and human services (overseeing Social Security, Medicare, senior citizen issues).
