In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance "in brief" of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Camille T. Cain, Chair, Glen H. Burton and Kenneth A. Bischoff.
Others Present: David C. Wilson, Deputy County Attorney; Margarit Nersisian, Clerk/Auditor's Office; and Fátima Blackford, Clerk/Auditor's Office, who took minutes.

Commissioner Bischoff moved to approve the consent items; Commissioner Burton seconded, all voting aye.
E. Recognition
Resolution Honoring Homer & Phidia Cutrubus on their 40th Anniversary of doing business in Weber & Davis Counties, also recognizing their continuing contributions to the culture & success of the community - Resolution 24-2004
Commissioner Bischoff read the resolution. The commissioners thanked Homer and Phidia Cutrubus on their outstanding contributions and years of service to our community. Homer expressed their thanks to the commissioners and Weber County.
Commissioner Bischoff moved to adopt Resolution 24-2004 honoring Homer and Phidia Cutrubus on their 40th anniversary of doing business in Weber and Davis Counties, and also recognizing their continuing contributions to the culture and success of the community; Commissioner Burton seconded.

F. Action Items:
1. Approval on the Vehicle Use and Maintenance Policy
David Wilson, Deputy County Attorney, referred to the policy before the Commission showing the changes that had been made as a result of input from the various departments. He discussed each change including the definition of preventable accident, seatbelt usage, the requirements to operate county vehicles and that employees/officials authorized overnight use of county vehicles shall, when away from work for more than five working days, return that vehicle to the custody of the county during that absence. This policy will replace the Fleet Management Policy 14.1. Gary Laird, County Operations Department Director, is working on the development of a motorized equipment policy that will parallel this policy.
Commissioner Burton moved to approve Policy 14.1, the Vehicle Use and Maintenance Policy; Commissioner Bischoff seconded, all voting aye.
2. approval of the Non-Discrimination and Anti-Harassment Policy
This policy was outlined last week. Brad Dee, Human Resources Department Director, reviewed this policy which will become part of the county's personnel policies and procedures manual and which brings the county into compliance. He noted that several policies had been recodified relating to discrimination and harassment and put into this one policy.
Commissioner Bischoff moved to approve the Non-Discrimination and Anti-Harassment Policy; Commissioner Burton seconded, all voting aye.
3. approval of a Reciprocal License Agreement by and between Weber County and Wasatch Front Regional Multiple Listing Service, Inc. - Contract C2004-140
Douglas Larsen, County Assessor's Office, explained previously there had been two separate agreements and Wasatch Front Regional Multiple Listing Service recommended merging the documents into one single agreement. This agreement defines the exchange of data between the County Assessor's Office and Wasatch Front Regional Multiple Listing Service, where the Assessor's Office obtains real estate market information. The contract had been reviewed by the County Attorney's Office. It will be renewed annually, and there is no fee associated with the contract unless either party defaults, in which case the fee will be $500. Commissioner Bischoff asked if there were any changes. Mr. Larsen said there were no significant changes, that it was basically to combine the two agreements into one.
Commissioner Burton moved to approve Contract C2004-140, Reciprocal License Agreement by and between Weber County and Wasatch Front Regional Multiple Listing Service, Inc.; Commissioner Bischoff seconded, all voting aye.
4. Request to surplus three properties:
LSN19-060-0028 located on Hemingway Drive in the Weber Industrial Park
LSN15-100-0008 located on 3300 So. and Pennsylvania, land containing .11 acres
LSN17-019-0016 located on 800 E. (2650 N.) in North Ogden, parcel landlocked
Gary Laird, County Operations Department Director, stated he had received requests to purchase these parcels which are in the county's name. He showed the plat maps.
LSN19-060-0028 - Ron Kusina, Executive Director of the Redevelopment Agency of Weber County, had contacted Mr. Laird regarding this parcel stating he would like to negotiate a sale for the property. Mr. Laird said that Mr. Kusina would also find out if there was an option to purchase or first right of refusal by Cerro Wire.
LSN15-100-0008 - Mr. Laird said that this parcel might be partially in the road and the County Surveyor was researching it.
LSN17-019-0016 - Mr. Laird said that this parcel was landlocked, it was in another property owner's back yard and it appeared to be a remaining parcel issue. It may not be owned by the county and the Surveyor's Office had recommended the county quit claim it to that property owner. Chair Cain asked for the size of this sliver and Mr. Laird said about 30ft. X 10 ft.
Commissioner Burton moved to declare surplus LSN19-060-0028 located on Hemingway Drive in the Weber Industrial Park, LSN15-100-0008 located on 3300 So. and Pennsylvania (land containing .11 acres), and LSN17-019-0016 located on 800 E. in North Ogden; Commissioner Bischoff seconded, all voting aye.
5. Contract between Golden Spike Event Center & Wasatch Slopes, Beehive Chariot, Skyline Chariot & Bear River Chariot for 2004-2005 season: December 11 and 18, 2004, January 1, 8, 15, 22, 29, and February 5 & 19, 2005 - Contract C2004-141
Jim Harvey, GSEC, gave an overview of this contract, stating that a lot of hard work had gone into it. All entities are insured. The contract had legal review.
Commissioner Bischoff moved to approve Contract C2004-141 between the Golden Spike Event Center and Wasatch Slopes, Beehive Chariot, Skyline Chariot and Bear River Chariot for the 2004-2005 season; Commissioner Burton seconded, all voting aye.
G. Assign Pledge of Allegiance & Thought of the Day for Tuesday, December 7,2004 at 5:30 p.m.
